ISLAMABAD: The Islamabad High Court (IHC) has disposed of a petition regarding a missing person Naseem Butt after it was told that he was in Adiala Jail on judicial remand in a case.
A single bench of IHC comprising Justice Muhammad Azam Khan conducted hearing of a petition filed by Saiqa Andleeb, wife of missing person namely, Muhammad Naseem Butt, and DSP Legal Sajid Cheema of the Federal Police appeared before the court and submitted the report.
During the hearing, the Islamabad police submitted the report to the court saying that the citizen, Naseem Butt, was arrested in the case of Rawalpindi Airport Police Station.
It said that Naseem Butt is arrested in the case of Rawalpindi Airport Police Station and Butt and others are accused of illegal transplantation of human organs. It added that Naseem is currently in Adiala Jail on judicial remand. Later, the IHC bench disposed of the recovery petition in light of the report.
The petitioner, Andleeb, wife of Naseem Butt, moved the court through her counsel Hafiz Kausar Hussain Gondal, advocate and cited federation of Pakistan and others as respondents. The petitioner, through the instant writ petition in the nature of habeas corpus, invoked the constitutional jurisdiction of this court, seeking production of the detente, Muhammad Naseem who is alleged to have been illegally detained or abducted.
In the petition, counsel for the petitioner contended that on 09.07.2025, unidentified armed persons forcibly entered the petitioner's house, assaulted the family, and abducted Muhammad Naseem Butt, whose whereabouts remained unknown since then. He added that despite lodging a complaint with the police, no effective action was taken. He contended that the detente was unlawfully picked up by state functionaries without due process, amounting to enforced disappearance and a violation of fundamental rights.

ISLAMABAD: A local court on Friday approved post-arrest bail for 12 Pakistan Tehreek-e-Insaf (PTI) workers in a case registered against them for holding a press conference without permission from the concerned authorities and conspiring to stage a protest. Duty judicial magistrate Imran Amir Abbasi, while hearing the post-arrest bail application of PTI workers, granted bail to 12 PTI workers against surety bonds of Rs 20,000 each in a case registered against them at Shehzad Town police station. PTI lawyer Mirza Asim, while arguing before the court said that a baseless case had been registered against our workers. The same legal sections had previously been applied in another case registered at Lohi Bher Police Station. All the accused are students and they were not staging a protest, he said. The court, after hearing arguments, granted bail to the PTI workers. Meanwhile, the same court adjourned the hearing of the case registered against PTI workers in connection with the PTI August 5 protest after police failed to produce the case record before it. Judicial Magistrate Imran Amir Abbasi, while hearing the post-arrest bail, adjourned hearing till today after he was informed that the police have not produced the record. The court expressed strong displeasure over the police's failure to present the case record during the hearing. Due to the non-submission of the record, arguments on the bail applications could not proceed. The case has been registered at the Lohi Bher Police Station under multiple sections. LAHORE: Justice Mirza Viqas Rauf of the Lahore High Court advised a petitioner Muskan Zahra to approach ex-officio justice of peace for remedy and held that the constitutional jurisdiction of the high court should not be exercised at the whims of the parties. Justice Viqas noted that now a day a trend has developed to bypass the alternate remedies and instead to approach the high court in constitutional jurisdiction. He observed that the high court shall not exercise its writ jurisdiction in the cases where the petitioner has access to an equally efficacious and adequate alternative remedy under the law. The petitioner has approached the court against his parent and police officials harassing her and her husband for contracting the marriage against the will of her parents. The court dismissed the petition in liming and advised the petitioner to approach ex-officio justice of peace as alternate remedy, which is neither illusory nor ineffective, the court added. The court observed that nobody can be allowed to bypass or circumvent the natural course of law by avoiding to avail remedy provided there under and to invoke constitutional jurisdiction of this court. The court ruled that it is an extraordinary jurisdiction which is only to be exercised in rare and exceptional cases but not as per convenience of the parties. This on the one hand absolves the relevant forum from performing its functions and duties and on the other, unnecessarily burdened the docket of the high court and deprives the litigants, who have their genuine causes to lay before the high court, the court added. The court also observed that the Police Order, 2002, regulates the police and the police officials have been made answerable with regard to performance of their official duties. In case of any negligence or omission, they not only have to face disciplinary proceedings but also to be confronted with conviction in the shape of imprisonment and fine as well, the court added. The court observed that grievance of the petitioner, as agitated in the instant petition, can easily be remedied through a petition before the ex-officio justice of peace or even she can approach against the respondent police officials, the concerned authorities under the Police Order, 2002. Even otherwise in presence of alternate remedy, a person desirous to invoke the constitutional jurisdiction of high court is obliged to demonstrate to the satisfaction of the court that such remedy is only illusory and not adequate at all, the court concluded.
