Supreme Court acknowledges ‘mental health crisis in educational institutions', calls student suicides ‘systemic failure'

The Supreme Court on Friday described the ongoing loss of young lives to suicide as a 'systemic failure' that must not be overlooked. A bench comprising Justices Vikram Nath and Sandeep Mehta issued a series of nationwide directives aimed at addressing the crisis.
Citing the 2022 National Crime Records Bureau (NCRB) report titled 'Accidental Deaths and Suicides in India', the Court said the data reveals a 'deeply distressing picture' of the mental health landscape among youth, according to a report by PTI.
"The continued loss of young lives, often due to preventable causes rooted in unattended psychological distress, academic overburden, social stigma, and institutional insensitivity, reflect a systemic failure that cannot be ignored," it said.
India recorded 1,70,924 reported suicide cases in 2022, of which 7.6 per cent, approximately 13,044, were student suicides.
The bench said notably, 2,248 of these deaths were attributed directly to failure in examinations.
The NCRB data further reflected the suicides among students in the last two decades, increasing from 5,425 in 2001 to 13,044 in 2022.
"Considering....situation of an increasing number of suicides in educational institutions, inter alia, including schools, coaching institutes, colleges, and training centres, we feel obliged to acknowledge and address the gravity of the mental health crisis afflicting students in educational institutions across the country," the bench said.
The bench was acting on an appeal against an Andhra Pradesh High Court order rejecting the plea to transfer the investigation into the unnatural death of a 17-year-old National Eligibility-cum-Entrance Test aspirant, preparing in Vishakhapatnam, to the CBI.
The top court said the NCRB data revealed a distressing pattern of rising student suicides.
It said mental health was an integral component of the right to life under Article 21 of the Constitution.
The bench said given the pressing nature of the crisis, particularly in cities like Kota, Jaipur, Sikar, Vishakhapatnam, Hyderabad, and Delhi, where students migrate in large numbers, immediate interim safeguards are the call of the day.
It issued 15 guidelines, which included that all educational institutions shall ensure optimal student-to-counsellor ratios.
"Dedicated mentors or counsellors shall be assigned to smaller batches of students, especially during examination periods and academic transitions, to provide consistent, informal, and confidential support," it said.
The bench said all educational institutions shall establish written protocols for immediate referral to mental health services, local hospitals, and suicide prevention helplines.
"Suicide helpline numbers, including Tele-MANAS and other national services, shall be prominently displayed in hostels, classrooms, common areas, and on websites in large and legible print," it said.
It said all teaching and non-teaching staff shall undergo mandatory training at least twice a year, conducted by certified mental health professionals, on psychological first-aid, identification of warning signs, response to self-harm, and referral mechanisms.
The bench said all educational institutions shall ensure that all staffs are adequately trained to engage with students from vulnerable and marginalised backgrounds in a sensitive, inclusive, and non-discriminatory manner.
"This shall include, but not be limited to, students belonging to Scheduled Castes (SC), Scheduled Tribes (ST), Other Backward Classes (OBC), Economically Weaker Sections (EWS), LGBTQ communities, students with disabilities, those in out-of-home care, and students affected by bereavement, trauma, or prior suicide attempts, or intersecting form of marginalisation," it said.
The bench said every such institution shall constitute an internal committee or designated authority empowered to take immediate action on complaints about sexual harrasment, ragging and others and provide psycho-social support to victims.
It said all educational Institutions shall regularly organise sensitisation programmes (physical or online) for parents and guardians on student mental health.
It said mental health literacy, emotional regulation, life skills education and awareness of institutional support services shall be integrated into student orientation programmes and co-curricular activities.
"All educational institutions shall maintain anonymised records and prepare an annual report indicating the number of wellness interventions, student referrals, training sessions, and mental health-related activities," the bench said.
It said examination patterns shall be periodically reviewed to reduce academic burden and to cultivate a broader sense of identity among students beyond test scores and ranks.
It said all educational institutions, including coaching centres and training institutes, shall provide regular, structured career counselling services for students and their parents or guardians.
"All residential-based educational institutions, including hostel owners, wardens and caretakers, shall take proactive steps to ensure that campuses remain free from harassment, bullying, drugs....," the bench said.
It asked the Centre to file a compliance affidavit before the court within 90 days.
The continued loss of young lives...reflect a systemic failure that cannot be ignored.
'The affidavit shall also indicate the expected timeline for the completion of the report and recommendations of the National Task Force on mental health concerns of students,' it said.

New Delhi: The Supreme Court on Tuesday extended by four weeks the interim bail granted to Vikas Yadav, undergoing a 25-year jail term in the 2002 Nitish Katara murder case, to attend to his ailing mother. A bench of Justices M M Sundresh and N Kotiswar Singh asked Yadav to approach the Delhi High Court for seeking remission in the case. The top court has been extending interim bail to Yadav on medical grounds. The Supreme Court on Tuesday extended by four weeks the interim bail granted to Vikas Yadav, undergoing a 25-year jail term in the 2002 Nitish Katara murder case, to attend to his ailing mother. The AIIMS in its opinion said if the patient failed to respond to conservative management (physiotherapy and medications), then surgical decompression of the lumbar spinal canal was recommended. The top court then extended the interim bail granted to him to look after his mother. On April 24, the top court granted interim bail to Yadav to meet his ailing mother and directed that she be examined by a medical board of AIIMS doctors. Imposing conditions, the top court directed the convict to remain confined to his house in Ghaziabad and not get in touch with the case's witnesses, including Katara's mother Neelam Katara. The apex court granted him the relief subject to depositing a bail bond of Rs 1 lakh and a surety of the like amount. Vikas is the son of Uttar Pradesh politician D P Yadav. His cousin Vishal Yadav was also punished for the kidnapping and murder of business executive Katara. The duo was against Katara's alleged affair with Bharti Yadav, sister of Vikas, as they belonged to different castes. Another co-convict Sukhdev Pehalwan was given a 20-year jail term without any remission benefit. Earlier, the Delhi High Court, while upholding the life imprisonment awarded to Vikas and Vishal Yadav by the trial court, specified a 30-year sentence, without any remission, to both of them. It had awarded a 25-year jail term to the third convict, Pehalwan. The Delhi prisons administration had last year rejected Yadav's remission request after his conduct was found to be unsatisfactory.

Patna: A residence certificate was recently issued in rural Patna in favour of one four-legged 'dog babu', born to parents with similar canine nomenclature, prompting a red-faced administration to lodge an FIR against all persons concerned. The certificate of residence was issued last week in Masaurhi circle, falling under the eponymous sub-division, apparently as part of a scramble for such documents during the special intensive revision of electoral rolls in Bihar. Under the Bihar Right to Public Service Act, citizens can apply for a certificate of residence online and the same would be issued by the officials concerned after due verification. Screenshots of the certificate, carrying a photograph of 'Dog babu', a stray canine, with parents named 'kutta babu' and 'kutiya devi', have gone viral on social media, with many people taking the opportunity to question why, instead of allowing such madness, the Election Commission was not accepting Aadhaar cards and ration cards, as suggested by the Supreme Court recently. The district administration on Monday came out with a statement that the certificate, dated July 24, "was cancelled as soon as the matter came to light". "Besides, an FIR has been lodged at the local police station against the applicant, the computer operator who fed the information into the system and the official who went on to issue the certificate". It added, "The sub-divisional officer of Masaurhi conducted a detailed investigation and it was found that the application was made appending the Aadhaar card of a woman living in Delhi." As such, the services of the computer operator, who forwarded the online application for processing without an application of mind, have been terminated, the district administration said. A recommendation has been made to the revenue and land reforms department for suspending the official who went on to issue the certificate despite the obvious anomalies in the application, it added.

CBI begins probe into custodial torture of J&K constable

S RINAGAR: A CBI team reached Srinagar on Monday and began its investigation into the alleged custodial torture of J&K Police constable Khursheed Ahmad Chohan in Kupwara in 2023. Officials said, following Supreme Court directive, CBI registered a case on July 26 against six J&K Police personnel, including DSP Aijaz Ahmad Naiko and SI Riyaz Ahmad, posted at the Joint Interrogation Centre (JIC) in Kupwara in Feb 2023. The FIR against them includes charges of criminal conspiracy, attempt to murder, voluntarily causing grievous hurt by dangerous weapons or means, and wrongful confinement for more than three days. After Chohan filed a petition, the Supreme Court, on July 21, ordered CBI to register a case about illegal detention and custodial torture at JIC from Feb 20 to Feb 26, 2023. Chohan had earlier approached J&K High Court seeking registration of FIR, but his plea was dismissed, prompting him to move apex court. The CBI's FIR includes translation of a complaint filed by Chohan's wife, Rubeena Akhter, on March 1, 2023. She had filed the complaint in Urdu, which CBI translated in English and made it part of the FIR. In her complaint, she stated her husband was illegally detained and subjected to brutal torture. She alleged Chohan was beaten with iron rods and wooden sticks, given electric shocks and left in a near-death condition. She alleged his private part was severed, iron rods inserted into his body, red chili powder forced into his rectum, and repeatedly electrocuted. In its order, SC directed CBI to arrest those responsible "forthwith and not later than a period of one month.' The court has given the agency a 90-day deadline to complete the investigation.
