Karnataka high court confirms bus conductor's dismissal for repeated misconduct

Time of India2 hours ago
Bengaluru: Karnataka high court has upheld the dismissal of P Basha, a conductor with KSRTC, citing his repeated instances of misconduct that had spiralled to over 55. "Given the past conduct of the appellant, the punishment imposed cannot be considered disproportionately excessive," a division bench comprising Chief Justice Vibhu Bakhru and Justice CM Joshi stated while dismissing the appeal filed by Basha.
Basha, a resident of Peresandra village in Chikkaballapur district, was appointed as a driver-cum-conductor with KSRTC on March 12, 2009. On Jan 13, 2019, while on duty on a bus travelling from Bengaluru to Gowribidanur, officials conducted a check at Yelahanka stage point and found 34+1 passengers on the bus. Two passengers, travelling from Mehkri Circle to Gowribidanur, had not been issued tickets. Basha failed to collect the fare of Rs 71 each from the two passengers and was charged with misconduct.
He contested the proceedings, stating that after issuing tickets, he had counted the passengers and found two in excess. Basha claimed that the two passengers were wearing headphones and were preoccupied with their mobile phones, causing them to forget to obtain tickets. Despite this, he was proceeded against, citing 57 instances of misconduct, including five serious red mark cases and three red mark cases. On March 5, 2020, a dismissal order was issued.

Basha challenged the dismissal before the labour court, which on March 25, 2022, partly allowed his petition, setting aside the dismissal and directing his reinstatement with the withholding of three annual increments and all other consequential benefits.
The KSRTC management appealed the labour court's decision in the high court, which on Dec 20, 2023, upheld the dismissal order. Basha's subsequent request for a review was rejected, leading him to file a writ appeal.
The division bench reviewed the case records and noted that the enquiry officer had followed due procedure, establishing Basha's misconduct. The labour court had examined the fairness of the procedure and the merits of the findings, deeming them justifiable. "In view of the above, the only question that is to be addressed is whether the punishment is shockingly disproportionate. At first blush, it appears that the punishment of dismissal on account of non-issuance of tickets of an aggregate value of Rs 142 is harsh.
However, it is also necessary to bear in mind the past conduct of the appellant. A show-cause notice dated July 3, 2019 issued to the appellant listed 57 instances of misconduct. One of the cases was pending, but penalties were imposed on the appellant in the other 56 cases. Most of the cases were over non-issuance of tickets as well. The appellant was called upon to improve his conduct, but, apparently, there was no improvement," the bench observed.
"Clearly, the employer can't be compelled to suffer repeated misconduct on the part of its employee and to continue the employment of an employee who has steadfastly failed to improve... Viewed in this perspective, the punishment imposed on the appellant does not shock the conscience of this court," the division bench said, dismissing the appeal.

Patna man ‘abducts' minor relative to pay off unpaid loan

A 12‑year‑old boy was allegedly abducted by his cousin by marriage in Patna's Phulwarisharif Saturday to recover a loan of Rs 12 lakh, the police said. According to Patna City (West) SP Bhanu Pratap Singh, an FIR was lodged immediately at Phulwarisharif Police Station, and a Special Investigation Team (SIT) was formed under SHO Ghulam Shahbaz Alam. Within six hours, the boy was found safe and the prime accused, Ramesh Ranjan, 43, was arrested. Police also recovered a car, a knife, two mobile phones, and Rs 6,420 in cash from him. 'There was minor assault by the accused during captivity, for which the child received medical attention. Behind the crime was the accused's intent to clear a substantial outstanding loan by seeking ransom,' SP Singh added. The boy allegedly told police that Ranjan called and lured him outside under the guise of visiting his maternal grandparents. 'After placing him in a car, Ranjan attempted to make the child unconscious using chloroform as they drove away,' the officer said. During interrogation, Ramesh Ranjan allegedly revealed that he had earlier taken a total loan of Rs 15 lakh for his beauty shop on Jagdeo Path and that he had 'engineered the abduction' to get the money to pay off the Rs 12 lakh that remained. The suspect 'had initially planned to abduct someone else', but after failing to do so, he resorted to kidnapping the child, the officer said.

UP police seize liquor worth Rs 25 lakh bound for Bihar, two arrested

Agency: Etawah (UP), Aug 18 (PTI) A consignment of illicit liquor worth nearly Rs 25 lakh was sized here, with police informing that the alcohol was allegedly being smuggled to Bihar, a dry state scheduled to go to assembly polls later this year. Senior Superintendent of Police Brijesh Kumar Srivastava said a joint team of the Special Operations Group (SOG) and Bakewar police intercepted a maxi truck during checking near Vishal Dhaba on the Agra-Kanpur six-lane highway on the intervening night of August 17 and 18. Upon inspecting the vehicle, police recovered 103 cartons of Royal Green whisky and 4,944 pouches of Rajasthani liquor. The stolen truck on which the liquor was being carried was also impounded. The total value of the seizure is estimated at Rs 25 lakh, the officer said. The truck was allegedly being used to transport the liquor from Bharatpur in Rajasthan to Bihar, according to police. The truck driver, Manvendra alias Mannu Singh and his associate Ankit alias Neta were arrested on the spot. Both face multiple criminal charges in Agra, Mathura, Kasganj, Unnao and Etawah districts, he said. Police said three other accomplices managed to escape and efforts are on to trace them. A case has been registered under relevant sections of the Bharatiya Nyaya Sanhita and the Excise Act at the Bakewar police station, Srivastava said. Days after he sought action against online betting apps, AAP leader held for gambling

Days after he submitted a representation to the district police seeking action against online gaming and betting apps, the district youth president of the Aam Aadmi Party (AAP) in Panchmahal of Gujarat was arrested, along with six others, by the Local Crime Branch on Monday in an alleged case of gambling. According to Panchmahal police, the AAP leader, Ashish Kamdar, and six others were arrested during a raid at a house in Vaijnath Society of Godhra, while gambling. Panchmahal district LCB said in a statement, 'After a tip-off from a local source, the house was raided and seven persons were caught red-handed while gambling… A cash of Rs 98,700 was recovered from the accused along with a sum of Rs 11,300 that had already been placed in the bet during the session… Three mobile phones and playing cards were also recovered.' The other accused have been identified as Jigar Shah, Dharmendra Gosai, Ashwin Goswami, Vijay Patel, Mahesh Patel and Vikram Vanzara — all residents of Godhra. After getting bail in the case, Kamdar on Monday took to Facebook and criticised his 'detractors' within the AAP for not standing by him in the 'false case' filed against him. Kamdar, in the video message, said, 'The truth will come out during the trial in the court… A handful people in the AAP in Panchmahal as well as the BJP have passed a judgment and tried to malign my image as if I have committed some heinous crime. This false case against me is a usual mechanism of the ruling party to suppress voices.' On August 14, Kamdar had submitted a representation to the district police, seeking immediate action against online gaming and mobile betting apps, stating that the apps were making youth victims of the 'greed of the mobile app owners'. Gujarat AAP chief spokesperson Karan Barot said, 'We have learnt about Kamdar's arrest on Monday evening. He is the Panchmahal District Youth President of the party… We are awaiting instructions from the party level on the further steps in the case.'
