Dannon parent sues Chobani over cold brew coffee slogan, packaging

NEW YORK, July 29 (Reuters) - The maker of Dannon yogurt sued rival Chobani on Tuesday for allegedly copying its "Bright & Mellow" slogan and yellow-and-black packaging for a competing line of ready-to-drink cold brew coffee.
Danone (DANO.PA), opens new tab said Chobani engaged in "knowing, calculated, and systematic" trademark infringement by using packaging for La Colombe-branded coffee that was "strikingly similar" to packaging for its own SToK coffee.
The lawsuit is at least the third between Danone and Chobani in the last decade.
In its complaint in Manhattan federal court, Danone said it began using "Bright & Mellow" in January 2021 to distinguish itself from Starbucks (SBUX.O), opens new tab and then-independent La Colombe, which emphasized roast levels and coffee bean origins.
It said that after buying La Colombe for $900 million in December 2023, Chobani substituted "Bright & Mellow" for that brand's "Bright & Flavorful" on coffee packaging, and now calls the product "light roast" instead of "medium roast."
Danone said this inevitably causes consumer confusion, especially among hurried shoppers scanning shelves in their local Kroger (KR.N), opens new tab, Target (TGT.N), opens new tab or Walmart (WMT.N), opens new tab.
The changes will "cause severe and irreparable harm to Danone and the goodwill it has built up in the Bright & Mellow mark over the past four and a half years," Danone said.
Chobani did not immediately respond to requests for comment.
Danone is based in Paris. Its U.S. unit is based in White Plains, New York, while Chobani is based in upstate Norwich, New York.
The lawsuit seeks an injunction to stop Chobani from selling products that could cause confusion, plus lost profits and triple damages.
The case is Danone US LLC et al v Chobani LLC, U.S. District Court, Southern District of New York, No. 25-06217.

Shares of Bright Smart dropped as much as 26.2% to HK$10.26 on Friday after the Wall Street Journal reported on Thursday that the deal could be delayed as more mainland Chinese regulators contemplate reviewing the proposal. Hong Kong-based Bright Smart also said in a filing on Friday that it had noticed media reports suggesting a possible delay of the acquisition and that the relevant procedures with regard to the deal with the relevant authorities were progressing as planned. Ant agreed to buy a 50.55% controlling stake in Bright Smart Securities for HK$2.81 billion ($359.37 million), according to a filing by the brokerage in April. Ant was founded by billionaire Jack Ma and is 33% controlled by Alibaba. It operates China's ubiquitous mobile payments app Alipay. Chinese authorities pulled the plug on Ant's $37 billion IPO in Shanghai and Hong Kong in 2020 and cracked down on Ma's business empire soon after a speech in Shanghai in October that year accusing financial watchdogs of stifling innovation. That subsequently led to a forced restructuring of Ant and a nearly $1 billion fine by Chinese regulators. NEW YORK, Aug 11 (Reuters) - Danone ( opens new tab is introducing an Oikos brand drink targeting U.S. consumers using weight loss medications such as Wegovy, pledging the dairy-based beverage helps address the common concern of retaining muscle. Patients on GLP-1 medications like Zepbound often shed valuable muscle rather than fat, worrying doctors and requiring diet changes, such as eating more protein. Danone's new drink, called Oikos Fusion, has nutrients such as vitamin D and whey protein that the French company says help build and maintain muscle. Danone is the latest food maker seizing the opportunity to sell new products to consumers dropping weight with GLP-1s, which users usually inject and are sometimes called "the shot." The market is set to grow as drug makers look to develop the appetite-suppressing medication in pill form. U.S. packaged food maker Conagra (CAG.N), opens new tab started labeling its Healthy Choice frozen meals "GLP-1" friendly, while rival Nestle (NESN.S), opens new tab launched Vital Pursuit to serve those on the medicine. Linking select regional airports to Toronto Pearson International Airport for smooth access to Air Canada's global network, travellers can relax with reclining leather seats, free Wi-Fi and more. Travellers departing from Hamilton and Waterloo Region airports can enjoy perks such as boarding pass and baggage tag printing on-site and disruption protection. Bonus: Aeroplan points can be earned on the Landline portion of the trip. The service is designed to make travel easier for residents of the Niagara region and nearby areas by removing the hassle of driving to Toronto, finding parking, or arranging alternative transportation to reach Pearson Airport. What is the new route for Air Canada? The motorcoach service connects Hamilton International Airport (YHM) and Region of Waterloo International Airport to Toronto Pearson International Airport. When will Air Canada's new route start operating? The new luxury motorcoach service will begin operating September 23, 2025, with two return trips daily. Since May 2024, Air Canada and The Landline Company have been operating intermodal services connecting Toronto Pearson with John C. Munro Hamilton International Airport and Region of Waterloo International Airport. With the latest expansion, Landline will now offer two daily non-stop round trips between Toronto Pearson and Kingston Norman Rogers Airport in eastern Ontario. Travellers departing from Kingston will check in as usual, receive boarding passes for their entire journey, and have their bags tagged. At a designated pick-up point at the Kingston airport, they'll board a premium Air Canada-branded motorcoach while their checked luggage is loaded. Aeroplan members will also earn points for both the ground and air portions of their journey, just like with any regular connecting flight.
