
PHC annuls 'discriminatory' medicines contract
The Peshawar High Court (PHC) has annulled the award of a multimillion rupee medicine supply contract, calling the process "engineered", "discriminatory," and a "quintessential case of mis-procurement".
The decision may shake the Khyber Pakhtunkhwa (K-P) health procurement system.
The K-P Health Department had awarded a contract to M/s Frontier Dextrose Ltd for supply of hospital medicines for the fiscal year 20242025.
A citizen, Waqar Ahmad, filed a pro bono publico whistle-blower petition through Shumail Ahmad Butt Advocate challenging the legality of the public procurement process.
A PHC division bench comprising Justice Syed Arshad Ali and Justice Dr Khurshid Iqbal set aside the bid awarded to M/s Frontier Dextrose Ltd through an order dated March 25.
In its 10-page detailed order, the bench directed the K-P Health Department to cancel the existing award and reinitiate the procurement process strictly in accordance with the law.
"We allow this petition and direct respondent No 3 to cancel the bid offered by respondent No 6 for the supply of medicines for the financial year 2024-25 and to reinitiate the process of procurement of the medicines strictly in accordance with the law," it said.
The bench noted that the director general drugs and director general health services, who were present in court, were repeatedly asked to explain the rationale behind substituting the contents of an affidavit.
The affidavit was to include an undertaking stating: "The undersigned has not manufactured/supplied any batch of Medicine(s), Drugs, Medical Device(s), Surgical Disposable, Cotton, and related goods, etc., that have been declared spurious/adulterated by
the DTL (Drug Testing Laboratory) of the K-P or any other public DTL in Pakistan".
The order said the said officers were unable to provide any satisfactory response, apart from contending that such an eventuality was addressed under the Act of 1976.
"Notably, they neither offered an explanation nor placed any record before the court to demonstrate what necessitated the omission of this essential criterion.
"Likewise, it is perplexing that when this lapse was brought to the notice of the procurement authority, it admitted that such an omission should not be repeated in the future and directed that the said clause be reinstated in Bid Form-III (Affidavit).
"However, it condoned the omission in the present procurement solely on the ground that no competing bidder had raised an objection during the bidding process.
"It must be emphasized that it was not the responsibility of a competing bidder to raise this concern; rather, the authority ought to have sought comments from the procuring entity regarding the justification for the deletion/omission of the said clause," it said.
According to the order, upon careful consideration, it became evident that this omission was deliberately made to enable the participation of M/s Frontier Dextrose Ltd in the bidding process.
"This constitutes a quintessential case of mis-procurement, rendering the impugned procurement contrary to the public interest," it said.
The judgment referred to an Islamabad High Court's (IHC) decision which highlighted ethical obligations of procuring agencies while also condemning any practice that compromises the integrity of the process, including the acceptance of gifts from suppliers.
"The cited case-law collectively establishes that public procurement must adhere strictly to principles of transparency, fairness, and non-discrimination, ensuring that public resources are utilized efficiently and equitably.
"Thus, under no circumstances can any procurement process funded by public resources be deemed valid if it falls short of integrity, lacks fairness and transparency, is tainted with favoritism and nepotism, or is tailored to benefit a specific individual," it said.
The court found that a key clause in the tender documents was deliberately omitted to facilitate the eligibility of one bidder, with no plausible justification on record.
"This constitutes a quintessential case of mis-procurement, rendering the impugned procurement contrary to the public interest."
Citing a series of landmark judgments from the Supreme Court and high courts across Pakistan, the bench reinforced the constitutional necessity of transparency, fairness, and competition in all public procurement. The court emphasized that public funds cannot be dispensed through tailored or manipulated tendering processes.

Nepra allows relief for Karachi, raises tariff for the rest
The National Electric Power Regulatory Authority (Nepra) on Thursday issued two separate notifications, reducing the power tariff by Rs2.99 per unit for the consumers in Karachi, while increasing the rate by Rs0.93 per unit for the rest of the country. The changes in the tariff had been done on account of fuel adjustment for the month of March in case of Karachi and for the month of April for other parts of the country. In any case, the new changes would be reflected in the current month's electricity bills. According to one notification pertaining to the tariff of the K-Electric, the authority "decided to allow a negative FCA of Rs2.9898/kWh (negative Rs4.045 billion) for March 2025, to be passed on to the consumers in the billing month of June 2025". Nepra said the negative FCA would apply to "all the consumer categories except lifeline consumers, domestic protected consumers, Electric Vehicle Charging Stations (EVCS) and prepaid electricity consumers of all categories who opted for pre-paid tariff". It said that the KE would reflect the fuel charges adjustment in respect of March in the billing month of June. "The adjustment would be shown separately in the consumers' bills on the basis of units billed to the consumers in the respective month to which the adjustment pertains," it added. According to a separate notification, the authority "has reviewed and assessed a National Average Uniform increase of Rs0.9306/kWh in the applicable tariff for Discos [Distribution Companies] on account of variations in the fuel charges for April". The notification added that the FCA should apply to all the consumer categories except lifeline consumers, protected consumers, EVCS and pre-paid electricity consumers of all categories who opted for prepaid tariffs. Non-developmental schemes: SCBAP concerned over allocation of enormous funds in budget
ISLAMABAD: The Supreme Court Bar Association of Pakistan (SCBAP) expressed concern over allocation of enormous funds for non-developmental schemes in the upcoming budget. SCBAP President Mian Muhammad Rauf Atta, in a statement, issued by his office on Thursday, said these schemes must be strictly controlled and actively discouraged, as they create a clear pathway for corruption. 'It is also concerning to note that federal government has taken significantly higher loans compared to the previous year — a move that could have dire consequences on the economy,' he added. The SCBAP chief stated that in order to discuss these issues, the association will call a meeting of its Executive Committee soon, and announce further course of action. The SCBAP demanded that the increase of toll rates be withdrawn immediately; saying if this does not happen then the association will challenge this decision on appropriate forums in competent Court of law. He stated, 'The SCBAP firmly believes that the NHA's move to drastically increase toll taxes for motorways and highways is tantamount to extortion from an already burdened public grappling with prevalent inflation.' 'This imposition of an additional 50 percent tax is entirely unjustifiable and deserves unequivocal condemnation.' The NHA, a day ago, announced a 50 percent increase in toll taxes for vehicles without M-Tag or with low balance, effective 15 June 2025, as part of a move to implement a 100 per cent M-Tag system across the country's motorways. Further, this move is a classic example of how a non-political figure, primarily concerned with property business, is given the responsibility to govern serious matters instead of genuine political leaders who should prioritize the welfare of the populace. Rauf stated that a critical examination of this decision shows that same is the case here where a Ministry of Communications is being run by a person, who is known for his property business and NHA falls under the purview of the same ministry. Nepra allows partial claims in response to KE write-off petition
ISLAMABAD: The National Electric Power Regulatory Authority (Nepra) has issued its decision on K-Electric's write-off petition, allowing partial claims of PKR 50 billion against the company's claims worth PKR 76 billion pertaining to the Multi-Year Tariff (MYT) control period spanning FY17-23. The power utility company had revised claims of unrecoverable amount of Rs 76.034 billion in receivables spanning seven years (2017–23) from Rs 67.902 billion pertains to the period prior to 2022 by including Rs 8.131 billion additional write-off claims for 2023. According to KE, it is important to highlight that the consumers were not paving overdue balances despite efforts and the settlement scheme/conversion of hook connection to metered connection given to incentive consumers, which was necessary for recovery of long outstanding dues from the defaulted consumers and/or to make them regular payers. If the Company had not offered settlement scheme/conversion of hook connection to metered connection to the defaulted consumers, these consumers would have continued to consume electricity without payment of dues hence, resulting in further accumulation of dues. In that case the amount claimed or write-off would have been higher than the amount of write-off currently being c aimed by the Company. Moreover, in case of correction of bills/detection billing, the amounts and units billed to consumers are reversed in system and are recorded as reversal of revenue. KE claimed Rs. 15.211 billion including GST for metered connections on account of settlement schemes out of the current MYT billing. According to KE, initially these connections were disconnected but reconnected after settlement schemes/consumer agreeing to convert to metered connections as per the categories of write off claims verified by the Auditors. This includes consumers in Payment Loyalty Reward (PLR) Schemes, overdue debts on account of consumption through single bulk connection and settlement schemes and consumers agreeing to convert hook connections to metered connections. According to K-Electric CEO Moonis Alvi, 'with this decision, majority of items pending to the previous control period have come to a close. KE looks forward to the MYT for the control period spanning FY 24 to FY 30, committed to meeting its serviced territory's energy needs.' The decision was released after public hearings and extensive deliberations that allowed all stakeholders to voice their concerns that were addressed by KE management. The submissions to Nepra underwent strict internal scrutiny as well as external verification by well-accredited and renowned audit firms as required by the Nepra in line with KE MYT 2017-2023. 'These costs were part of the Multi-Year Tariff awarded to the utility for the period 2017-2023, and have been approved after stringent benchmarks, audits and fulfillment of conditions laid down by Nepra in its tariff determination,' said Muhammad Aamir Ghaziani, Chief Financial Officer at KE. Arif Bilwani, Munem Zafar, Ameer Jamaat-e-Islami ,Rehan Javed and some other consumers had challenged the write-off claims of KE. Majority of the stakeholders objected to the additional and pending write off claims. The representative of JI raised the issue of bogus bills which are subsequently claimed as write off and referred his letters of May27, 2024 and January 3, 2025. Arif Bilwani also raised similar concerns regarding bogus billing. Bilwani also highlighted that there is a substantial increase in the write off claims in later years of the MYT as compared to the initial years. KE clarified that the reason for such increase is the increase in sales revenue. For example, sales revenues of private consumers increase from Rs. 169 billion in FY 2017 to Rs. 411 billion in FY 2023, thereby more write offs in FY 2023 as compared to FY 2017. On the other hand Shahid Khaqan Abbasi, ex-Prime Minister and former head of Task Force on KE issues, Omar, Junaid Ameen, Areeba Shahid and Bilal Asghar supported the claim of KE. NERPA further stated that it is 'conscious of the fact that all possible efforts have already been made by K-Electric, as confirmed by the auditors. Copyright Business Recorder, 2025
