
Is the taste of YOUR favourite drink about to change? Sugar tax extension 'will force recipe tweaks' - with Pepsi and Irn Bru among those now in the firing line
The Treasury has confirmed plans to extend the soft drinks industry levy (SDIL) to milkshakes and other dairy-based drinks.
It has also proposed reducing the maximum amount of sugar allowed in drinks before they become subject to the levy from 5g to 4g per 100ml.
The toughened rules are set to impact a whole swathe of drinks on sale in supermarkets, including Pepsi, Ribena, Fanta and Starbucks caffe latte iced coffee.
The Government suggested the changes, which have been put out to consultation, would see manufacturers continue to further reduce sugar in their recipes.
But industry figures hit out at a 'muddled and damaging shifting of the goalposts' that would have 'questionable positive health outcomes'.
Chancellor Rachel Reeves said in her Budget in October that Labour would consider broadening the tax, which was introduced by the Tories in 2018 as part of anti-obesity efforts.
In a consultation document published yesterday, the Treasury said the latest analysis showed there were 866 products with between 4g and 4.9g of total suger per 100ml.
There are 203 pre-packed milk-based drinks on the market, which make up 93 per cent of sales within the category, with a total sugar content of 5g or above per 100ml.
These are all likely to be hit with the tax under the new proposals unless their recipes are altered to reduce sugar content.
As a result of widespread reformulation after the initial announcement of the SDIL, 89 per cent of fizzy drinks sold in the UK do not pay the tax, the Treasury added.
The exemption for milk-based drinks was initiall=ly included because of concerns about calcium consumption, particularly among children.
But the Treasury said young people only get 3.5 per cent of their calcium intake from such drinks, meaning 'it is also likely that the health benefits do not justify the harms from excess sugar'.
'By bringing milk-based drinks and milk substitute drinks into the SDIL, the Government would introduce a tax incentive for manufacturers of these drinks to build on existing progress and further reduce sugar in their recipes,' it added.
Fizzy drinks such as Old Jamaica Ginger Beer, Lucozade Energy Original, Pepsi, Rubicon Sparkling Mango, and San Pellegrino Limonata all contain more than 4g of sugar per 100ml.
Meanwhile, Starbucks Caffe Latte Iced Coffee and Muller Frijj Chocolate Milkshake are also likely to fall foul of proposed new rules for dairy-based drinks.
These are set to take account of the average lactose content of semi-skimmed milk, which is 4.8g lactose per 100ml.
The Treasury set out how a drink containing 75 per cent milk will get an allowance of 4.8g x 75 per cent, which equals 3.6g per 100ml.
This lactose allowance would then be added to the SDIL threshold of 4g per 100ml, which gives a total of 7.6g of total sugar per 100ml.
Christopher Snowdon of the Institute of Economic Affairs said: 'The sugar tax has been such a dramatic failure that it should be repealed, not expanded.
'It has been costing consumers £300million a year while childhood obesity rates have continued to rise.
'To claim it has been a success on the basis of a hypothetical reduction of one calorie a day is absurd.
'Sugar taxes have never worked anywhere. What happened to Sir Keir Starmer's promise to not raise taxes on working people?'
A spokesperson for the British Soft Drinks Association said: 'This decision is a muddled and damaging shifting of the goalposts which risks undermining years of reformulation investment with questionable positive health outcomes.
'More than seven out of every 10 soft drinks sold in the UK are low or no sugar and the total sugar removed from soft drinks between 2015 and 2024 is just under three quarters of a billion kilograms.
'Lowering the SDIL threshold to 4g – on top of the previously-announced, backdated 27 per cent increase to the levy – comes at a time of major and unprecedented financial headwinds for our members, from record-high inflation and NIC increases, to spiralling ingredient costs and incoming trade tariffs.
'Such cost increases have already impacted our members' ability to grow their businesses and boost employment, and the lowering of the SDIL threshold risks making this even more challenging.'
A spokesperson for the Food and Drink Federation said: 'We welcome the opportunity to input to the Government's consultation on the SDIL, to share our sector's views and technical expertise.
'Soft drink manufacturers have already made significant progress reducing the amount of sugar in their drinks, including milk-based drinks.
'Thanks to many years of investment in research and development, manufacturers have reduced sugar in drinks that are subject to the levy by 46 per cent in the last five years.
'Significant progress has also been seen in pre-packed milk-based drinks, which are not subject to the levy, with a 30 per cent sugar reduction in the last three years.
'Food and drink manufacturers are facing a series of inflationary pressures and government must continue to create the right conditions for businesses to innovate and also be clear about their long-term goals to promote business confidence.
'A predictable regulatory environment is vital to ensuring our sector can continue to invest in developing healthier options.'
Dr Hannah Brinsden, of The Food Foundation, said: 'SDIL has been a major public health success, removing tonnes of sugar from soft drinks and in turn our diets, while also raising money for children's health.
'It's only right that we keep ensuring it is working as well as possible; removing exemptions on milk-based drinks and changing the sugar thresholds where the tax is paid are two important improvements.
'However, sugar in our diets comes from a range of food, not just soft drinks.
'If the Government is serious about improving diets, our health and the economy, they're going to need to be more ambitious and consider extending SDIL to food as the next step.'
The Government consultation on the plans will run from Monday until July 21.

Post Offices face axe under government shake-up
Post Offices across the UK are at risk as Labour considers scrapping a rule forcing ministers to protect thousands of branches. The Government is consulting on whether to axe the requirement to keep at least 11,500 Post Offices open, suggesting that a 'smaller' network could be better suited to meet 'market trends'. The minimum branch requirement was introduced by the Tory-led coalition in 2010, after Labour oversaw thousands of cuts to the network in the 2000s. Scrapping the limit is not Labour's preferred course of action, with the Government saying it would rather keep things as they are. However, it is a 'lower cost option' being considered by ministers to help achieve policy objectives. Dame Harriett Baldwin, the shadow business minister, said the review would threaten 'the future of branches nationwide', putting vital services for vulnerable people at risk. Under the proposal, the exact size of the network would become an 'operational decision' for the Post Office. However, it would still need to ensure that at least 99 per cent of the population stays within three miles of a full service branch. The Government said the Post Office would have 'more flexibility to adapt to market trends' as its resources would be 'less thinly spread'. But it acknowledged that a 'modestly smaller network' would likely be a concern to people living nearby. The consultation document said: 'As set out at the beginning of the chapter, there are already changes happening in the network to allow Post Office to make the most of opportunity in the parcels market. 'Too much change at the same time could lead to instability for Post Office as well as communities and so it might be preferable to wait to see how the network evolves in the short term before reviewing the overall size and for any longer-term changes to be phased in over time.' Instead, ministers have said they would prefer to maintain all existing requirements, with the Government continuing to subsidise loss-making branches to ensure everyone has access to a Post Office. At the beginning of the millennium, there were 18,393 Post Offices. By 2023, this had dropped to 11,684. The biggest fall was at the height of the financial crisis, between 2008 and 2009, when the total dropped by 1,615. Dame Harriett, who has been a vocal campaigner for the Post Office network, said: 'Labour's extensive Post Office review threatens the future of branches nationwide. 'And this will put vital services at risk. Especially for pensioners, rural communities, and small businesses who rely on them most. 'I've been an advocate for Post Offices, those who work there and those who rely on them all my political career. And for the last 15 years the number of Post Offices has been kept stable at 11,500. Labour are now consulting on reducing that number.' She added: 'The closure of Post Offices could once again leave pensioners, small businesses and rural communities cut off from vital services. With bank branches closing, often it's Post Offices that provide vital banking services. 'I'd encourage all Telegraph readers to respond to the Government's consultation and I've also started a petition which has already attracted 100,000 signatures.' The petition, called Save Your Post Office, urges people to push back against the potential closures.

Rumoured tax raid spooks another industry
A new tax has appeared on the horizon, its advocates claiming it could raise £3.2bn for the Treasury. On Wednesday, Gordon Brown took to the airwaves, championing a tax rise on the 'undertaxed' gambling industry. The former Prime Minister is backing calls from the think tank Institute for Public Policy Research, which is claiming raising various gambling taxes could earn the Treasury enough money to cover the cost of scrapping the two-child benefit cap. The policy – perhaps unsurprisingly – is relatively popular. A YouGov survey found 42 per cent of respondents polled to be strongly in support of higher taxes on online gambling, while 28 per cent would somewhat support the increase. Dr Christopher Snowdon of the Institute of Economic Affairs warns against the seduction of supporting a so-called sin tax to fund a noble cause, or the hypothecation of a particular tax stream. If the tax works and reduces consumption, it reduces the Treasury's tax intake, leaving less money for the cause it was meant to fund. 'HMRC have made it clear that hypothecation is the antithesis to everything they believe in', he tells me. But also, is the industry about to be decimated before Rachel Reeves manages to collect her golden eggs? Such is the jitter across businesses as the Chancellor hunts around for tax revenue to plug a black hole worth as much as £50bn in the economy that by Friday the country's biggest gambling companies had lost over £4bn in value, ' amid fears of a tax raid on the sector in the next Budget '. One of these companies, Flutter, which lost over £4.2bn in value, paid nearly £750m in taxes in 2024. Never mind raising more money, is the Treasury about to lose a chunk of its tax take as some of these companies fold or move their operations off-shore to escape a tax raid? Back in November, when the rumours of a so-called Gambling Tax had first surfaced, the Betting and Gaming Council had set out the case for its members: '[t]he proposed levy rate for independent bookmakers is a hammer blow to the 500 small independent betting shops and the 2,500 people who work in them, which risks job losses and venue closures, while contributing a small amount to the overall levy total.' Dr Snowdon shares these concerns. Rachel Reeves has a habit of pursuing policies 'without looking at third-order effects', he tells me. If the anticipated tax rise pushes up the cost of gambling online on UK websites, punters could very easily make use of a Virtual Private Network or VPN to access gambling sites in other countries. There may be public support for taxing the gambling industry into oblivion. But who does the Chancellor then turn to in order to fill the resulting hole in her tax intake? Rachel Reeves cannot afford a repeat of the non-dom debacle, nor can ordinary taxpayers.

Treasury targeting inheritance tax reforms to help plug UK deficit
The Treasury is looking at ways to raise more money from inheritance tax amid growing pressure on the country's finances ahead of the autumn budget, sources have told the Guardian. Officials have been tasked with examining whether tightening rules on the gifting of money and assets could be one way of addressing a gap between revenue and spending that is estimated to reach more than £40bn. Although no decisions have been taken, the government has been careful not to rule out tax rises later this year amid slowing economic growth, higher-than-hoped inflation and unemployment at a four-year high. Labour MPs have been pushing the idea of a wealth tax, but changes to inheritance tax (IHT) thresholds could be similarly controversial. Rachel Reeves and Keir Starmer have already prepared the ground for tax rises in recent interviews, suggesting the pressure on public finances is too great to rule them out. However, the government's pledge not to raise taxes on 'working people' in its election manifesto has left the chancellor with limited options for how to tackle a yawning deficit cause by factors including Donald Trump's tariffs, higher debt interest payments and a series of U-turns on welfare cuts. Among the moves being considered are changes to how wealth or assets can be given away prior to death to reduce inheritance tax liablities. This includes examining the possibility of a cap on lifetime gifting. At present, gifts made seven years before someone dies are not subject to IHT, while those given three to seven years before death are taxed on a sliding scale known as 'taper relief', with the rate reducing each year from 32% to 8%. A lifetime cap could be introduced to limit the amount of money or value of assets an individual can donate as part of their IHT planning and the Treasury is also reviewing rules around the taper rate, people familiar with the matter said. A source with knowledge of the work told the Guardian: 'With so much wealth stored in assets like houses that have shot up in value, we have to find ways to better tap into the inheritances of those who can afford to contribute more. 'It's hard to make sure these taxes don't end up with loopholes that undermine their purpose. But we are trying to work out what revenue might be raised and how to ensure it's a fair approach.' The source added: 'IHT can raise more, and even if we do nothing, it will raise more money as the threshold for paying it stays frozen. But we have to look at the levers for taxing wealth if the aim of the government is to avoid hitting earnings from work as much as possible.' IHT changes have provoked a strong public response in the past, even though fewer than one in 20 estates paid it in recent years. In the late 2000s the Conservatives enjoyed a significant swing in opinion polls when they proposed raising the threshold at which IHT would kick in. Then party leader David Cameron made it a hot-button issue, putting pressure on the Labour prime minister, Gordon Brown, with headlines about the 'death tax'. More recently, Reeves has faced fierce criticism and protests over the past year in response to her decision in last autumn's budget to slash tax breaks for farmers passing on their businesses. She defended her decision in an interview in Northern Ireland on Tuesday, saying she believed those farmers with more than £3m to pass on 'should make a contribution' and would still continue to pay a lower rate of IHT than others. Only 4.6% of deaths resulted in IHT being paid in the tax year 2022-2023, according to the latest figures from HMRC. The average effective tax rate was 13%, after accounting for all the different reliefs and exemptions that might apply depending on the individual circumstances. That compares with the headline rate of 40%. The government is trying to work out how it can tap into the vast wave of wealth that will be transferred from baby boomers when they die, fuelled by large pension pots, as well as house prices that have risen sharply over their lifetimes. From April 2027, most unused pension pots and death benefits will be subject to the tax. This leaves large loopholes, however, if sums are withdrawn and gifted instead, and officials are increasingly concerned about large cash sums being extracted from these pots. Another possible revenue stream being looked at is whether to increase capital gains tax rates by a few percentage points. However, this would be accompanied by some kind of CGT allowance for investors who put money into British businesses, as the Treasury tries to strike a balance between tapping into wealth to fund public services without deterring investment into the UK. There is growing anecdotal evidence that some wealthy people and company directors may have already left the UK following recent tax changes, including the end of the 'non-dom' status, though there is no official data yet available. The Guardian was first to reveal that the government was considering major changes to business property relief and agricultural land tax in 2024, a step then brought in by Reeves. These changes may have a significant impact on how much money is raised by IHT going forward, but it is unclear how they might alter behaviour. Meanwhile CGT rates were not raised as high as many senior Labour party figures had hoped in 2024, with the government stepping back from bringing it closer to levels of income tax. Still, some senior government figures believe that there is a political deal to be done to create a path towards equalising its levels with income tax. They believe there is room for this a compromise after Reeves signalled that a flat rate wealth tax – of the kind proposed by backbenchers last month of 2% on assets over £10m – had more or less been ruled out. In a recent interview, Reeves pointed to IHT and CGT as the UK alternatives to a headline wealth tax such as that in countries like Switzerland. 'We have inheritance tax. We have capital gains. We've just got rid of the non-dom tax status that doesn't exist any more in our tax system. So we do have taxes that tax the wealthy. I'm not keen to do what Switzerland has done and replace those with a wealth tax because I think there's the risk of actually losing money by doing those things,' she told LBC's Iain Dale on 2 August. A Treasury spokesperson said: 'As set out in the Plan for Change, the best way to strengthen public finances is by growing the economy – which is our focus. Changes to tax and spend policy are not the only ways of doing this, as seen with our planning reforms, which are expected to grow the economy by £6.8bn and cut borrowing by £3.4bn. 'We are committed to keeping taxes for working people as low as possible, which is why at last autumn's budget, we protected working people's payslips and kept our promise not to raise the basic, higher or additional rates of income tax, employee national insurance or VAT.'
