The Madhya Pradesh High Court on June 30 set aside a trial court order from over 25 years ago that had deemed Saif Ali Khan, his sisters and mother as the successors to the properties in appeals by heirs of the elder brother of the erstwhile Nawab of Bhopal.
The heirs of erstwhile Nawab Hamidullah Khan of Bhopal, who passed away in 1960, as well as those of his elder brother, were seeking partition and succession of the private properties as per Muslim Personal Law (Shariat) Act, 1937, as was in force at the time of the then Nawab's death, and moved trial court in this regard in 1999.
Begum Suraiya Rashid, heir of Obaidullah Khan, the elder brother of the erstwhile Nawab of Bhopal Hamidullah Khan, and Qamar Taj Rabia Sultan, the Nawab's heir, represented by Advocate Aadil Boparia, filed appeals challenging a trial court order in 2000.
The court decreed two personal properties in favour of the heirs of Sajida Sultan, the second daughter of Nawab Hamidullah, and Saif's paternal grandmother. Sajida was declared Nawab following Hamidullah's death, and she died in 1995. The decision of the trial court had come in partition suits moved by the heirs of the Nawab's family in 1999.
After 25 years of the appeals being heard before the Jabalpur bench of the Madhya Pradesh HC, Justice Sanjay Dwivedi, in an order on June 30, allowed them. The bench, however, remanded all the parties back to the trial court, and granted the liberty to move an appropriate application before the trial court.
The appellant heirs contended that the trial court erroneously assumed that the private properties of the Nawab are part of the throne and will thus automatically pass on to the successor to the throne. They argued that the properties have nothing to do with succession, and the partition of the properties will be governed by the personal law of succession.
Concurring with the appellants' submissions, the Madhya Pradesh High Court said, '…The matters need to be remanded back to the trial Court for deciding it afresh because these are the suits for partition. And if ultimately, the trial Court comes to the conclusion that suits have to be allowed, then the share of the parties can be determined only by the trial Court while passing the preliminary decree, and that can be further finalised by the trial Court itself after carrying out the necessary formalities of partition.'
'Thus, in my opinion, the impugned judgment and decree deserve to be and are hereby set aside….It is made clear that since the suits were initially filed in the year 1999, therefore, the trial Court shall make all possible efforts to conclude and decide it expeditiously, preferably within a period of one year,' added the court.

It was said that as per the intention of the Act, schools were established for every 300 population within a radius of one km to provide the constitutional right to education and now the govt is closing down a large number of schools by merging them through an administrative order. It was argued that this act was against the provisions of Article 21A of the Constitution and the RTE Act . It was also argued that once schools have been established on a large-scale to fulfil the goal of the constitutional right under the Right to Education Act, the work done under the said Act cannot be reversed by a mere administrative order because it cannot supersede any legislative provision. Newly-appointed additional advocate general Anuj Kudesia and chief standing counsel SK Singh appeared for the state govt, while Sandeep Dixit appeared as the advocate of BSA Sitapur. The govt counsel justified the merger decision, citing low student enrollment in many schools, with around 56 schools having no students at all. However, the court questioned whether a survey had been conducted to arrive at this decision and asked to see the survey report if one had been done. When the report could not be presented and the govt counsel started presenting its case with half-hearted preparations, the court got irked and started reprimanding the govt lawyers.

Srinagar: State Investigation Agency (SIA) of J&K Police on Thursday carried out searches at the premises of two suspects in Anantnag district in connection with the non-local killing case. A statement by SIA said that these searches were carried out as part of an ongoing investigation into the brutal killing of Raja Sah on April 17, 2024, in Bijbehara. The searches aimed to uncover critical evidence to unravel the conspiracy behind this heinous crime and identify accomplices involved in the case registered under FIR No. 87/2024 under Section 302 IPC, 7/27 Arms Act, and 13, 16, and 20 of the Unlawful Activities (Prevention) Act of Police Station Bijbehara. The meticulously planned searches were executed with precision, adhering to legal procedures, and have yielded significant evidence that is expected to strengthen the investigation. 'These efforts will aid SIA Kashmir to bring the perpetrators of this terrorist act to justice and dismantle the terror module involved in such terrorist activities,' an official said. Kolkata: West Bengal chief minister Mamata Banerjee on Thursday wrote a letter to union home minister Amit Shah, raising her concern over the spike in provocative social media content and cybercrime. Mamata Banerjee had previously accused the Bharatiya Janata Party (BJP) of spreading misinformation and fake videos, especially during the violence in Murshidabad (PTI) 'I write to convey my deep concern over an issue that is increasingly posing serious challenges to public tranquillity and the social fabric of our nation – the proliferation of provocative content on some sections of the social media platforms and the alarming rise in cybercrimes,' Banerjee wrote in the letter. Banerjee had previously accused the Bharatiya Janata Party (BJP) of spreading misinformation and fake videos, especially during the violence in Murshidabad. 'Yesterday some news was spread that I have resigned. Police have registered an FIR. The jumla party only believes in divide-and-rule policy. Fake videos are being circulated every day. Earlier attempts were made to pass off videos of Gujarat riots as those from Murshidabad,' she had said on April 2. Police had suspended internet services in some parts of Murshidabad after violence broke out in West Bengal's Murshidabad district over the Waqf (Amendment) Act in April, to prevent the spread of misinformation. Videos of a mob attacking the block development office in Jalangi and ransacking the office of a railway gateman in Azimganj had surfaced on social media. Rioters were seen in video clips looting an outlet of a retail chain. Police had reportedly resorted to lathi-charge and tear gas after vehicles were torched, shops looted, and policemen attacked. 'Such content not only spreads misinformation but also has the potential to inflame communal sentiments, incite violence, disrupt societal harmony and indulge in crime against women,' Banerjee added. Banerjee also highlighted the surge in cybercrime and said it is 'growing both in complexity and in its detrimental impact.' Banerjee urged the home minister to launch large-scale awareness campaigns to promote responsible digital behaviour, alongside sensitisation programmes, digital literacy campaigns, and community engagement initiatives. 'This is a collective challenge requiring urgent and coordinated action to safeguard public order, national unity, and the integrity of our democracy,' the Trinamool Congress posted on X.
