Mumbai metro trying to extract monopolistic, extortionate rents for mobile network: COAI

New Delhi, May 18 (PTI) COAI on Sunday accused Mumbai Metro of trying to extract monopolistic and extortionate rents on provision of mobile network, as the industry body argued that under stipulated rules, a public authority cannot deny providing Right of Way to telecom operators in a public place.
As per the new Telecommunication Act and Right of Way (RoW) rules, a public authority cannot deny providing Right of Way to TSPs in a public place 'which is exactly what is being done by the Mumbai Metro', COAI Director General S P Kochhar said.
'One must note that deploying of such network(s) are a norm, even in important places like the PWD tunnel in Pragati Maidan or the Central Vista, wherein the TSPs are laying infrastructure without paying any cost to anyone (including any third party),' according to COAI.
COAI claimed that Mumbai Metro was quoting precedence for appointing a third party vendor and denying RoW to telcos.
'It may be noted that wrong precedence does not make a legitimate one and the industry is separately addressing the issue of such monopolies being created, with a view to stop such extortionate practices,' said the association – whose members include Reliance Jio, Bharti Airtel and Vodafone Idea.
Telecom service providers are always willing to incur capex for setting up network inside the Metro, despite no any additional incremental revenue.
'However, paying extortionate rates to Mumbai Metro for such a network is not viable,' COAI said.
Further, COAI pointed out that services were being offered on a trial basis by all TSPs, pending finalisation of a formal agreement.
'…to support uninterrupted connectivity for Mumbai Metro commuters, TSPs had proposed providing mobile connectivity Free of Cost without any payment to either the third party vendor or Mumbai Metro, until commercial terms could be mutually agreed upon. Chief Minister Devendra Fadnavis said that the stretch from Mantralaya to Vidhan Bhawan encompassing ministerial bungalows will be developed as an administrative district of Maharashtra through a state-of-the-art development plan. Fadnavis said this at the Express Adda event held on Wednesday in Mumbai. He added that the design and development plans are already underway with an objective to create more space to accommodate administrative offices within the same premises. 'The Bombay High Court will be relocated to Bandra, but Mantralaya will remain in the same premises,' the chief minister said. However, he said, there are plans to make a new Mantralaya. The chief minister also said that Mumbai Metro projects criss-crossing through the city and its suburbs will change the mobility bringing huge relief to the Mumbaikars. With 70 lakh passenger capacity, it is almost parallel to Mumbai local trains which can carry 90 lakh passengers. The chief minister indicated that there are plans to make all local trains air-conditioned. The process of upgradation of local trains has led to better amenities to the commuters, he said. Almost 12 foreign universities are likely to become a part of the hub. We have signed up with at least five best universities,' he said. According to Fadnavis, the Navi Mumbai airport will be completed in the next six months. The entire coastal road works will also be completed in the same tenure. 'The infrastructure driven development will not only help in connectivity and reduce travel time but also encourage people to switch to public transport. We are bringing integrated single ticket system which will allow people to use Metro, local train, bus or mono rail using the same ticket,' he said. According to the CM, the water taxi which is high on the government agenda will become a reality soon. Recalling how RoRo services was initiated during his first tenure, Fadnavis said the water taxi jetty work will be taken up near Radio Club. He lamented that there were some protests from South Mumbai residents. 'But gradually, once the Bombay Port Trust is developed, we will shift the water taxi infrastructure there,' he said. Fadnavis said that the land acquired for the coastal road stretch will be essentially preserved only for stated projects with environmental safeguards. 'We will not allow any real estate development on this claimed land,' he said, adding, 'The Race Course at Mahalaxmi will be preserved and not opened for any real estate development.'

TRAI initiates discussion on assignment of microwave spectrum in lower 6 GHz, E and V Bands
New Delhi, May 28 (PTI) Telecom regulator TRAI on Wednesday floated a consultation paper on assignment of the microwave spectrum in lower 6 GHz, 7 GHz, 13 GHz, 15 GHz, 18 GHz, 21 GHz bands, as well as E and V bands. TRAI has fixed June 25, 2025 as deadline for comments and July 9 for counter comments. Post that, TRAI had released a consultation paper on assignment of spectrum in E&V bands, and Microwave Access (MWA) & Microwave Backbone (MWB) for soliciting comments of stakeholders on the subject. Meanwhile, the Telecommunication Act, 2023 was enacted in December 2023. In light of the provisions of the Telecommunications Act, 2023 in respect of radio backhaul for telecommunication services, TRAI, via a letter in February 2024, conveyed that the telecom department may want to review its 2022 reference. "In response, DoT, through a fresh reference letter dated 13.09.2024, while agreeing to the TRAI's observation that backhaul spectrum is a part of the First Schedule of the Telecommunications Act, 2023 for which the assignment method would be administrative, requested TRAI to provide recommendations under Section 11(1)(a) of the TRAI Act, 1997," TRAI said. The aspects included demand assessment and scope of service/ usage for 57-64/ 66 GHz (V-band) and 71-76 GHz/ 81-86 GHz (E-band) and accordingly methodology of assignment of spectrum and associated terms and conditions. Other facets included spectrum charges and related terms and conditions such as spectrum cap, carrier aggregation for assignment of spectrum in the six bands for backhaul purposes of commercial telecom services. A typical public telecommunication network consists of the access network; core network; and backhaul links. The access network is the last mile connectivity to consumer devices, while core network connects the access network to global public networks. The backhaul links are used to connect the access network with the core network. In all, TRAI has put over 50 questions to stakeholders for views. These include level of demand of the spectrum in these traditional backhaul bands; the commercial services for which these bands should be assigned; and the method for such assignment. Other queries raised include the associated terms and conditions, validity period of assignment, and rollout obligations. "As the 7125-8400 MHz range in the 7 GHz band and the 14.8-15.35 GHz range in the 15 GHz band are being considered for IMT in WRC27, whether there is a need to review the usage of 7 GHz and 15 GHz microwave backhaul bands at this stage itself, or should the review be undertaken after considering the outcome of WRC-27," TRAI asked.
