
IAS officer's ‘harassment': Digital proof to be saved
Delhi High Court
has ordered
Delhi Police
to preserve digital evidence, including call logs of a senior IPS officer accused of misbehaviour and harassment by a woman IAS officer.
In a recent order, Justice Swarana Kanta Sharma allowed the plea filed by the IAS officer and noted that in the "interest of justice and to ensure that relevant material, if ultimately found admissible and necessary, remains available for scrutiny by the courts, this court is inclined to direct the respondent/state to ensure preservation of the digital evidence, i.e.
IPDRs, CDRs, tower location data, mobile and landline usage logs, and Wi-Fi logs" of the officer as well as the cops who investigated her case and filed a closure report before the trial court.
The court said the digital evidence would be preserved for the period from July 2023 to Sept 2023. It clarified that "the present order is being passed solely for the limited purpose of securing preservation of digital evidence and shall not be construed as an expression of opinion on the merits of the case".

The judge also clarified that "the direction to preserve data does not create any rights or equities in favour of either party. The relevance, authenticity, and admissibility of such data will be considered at an appropriate stage".
Last year, a magistrate's court had accepted the cancellation report filed by Delhi Police over the allegations of misbehaviour levelled by the IAS officer against the police officer. The trial court noted that the woman officer never disclosed to the investigating officer or the magistrate court that she made a call to the accused on Oct 17, 2023, just a day before the registration of the FIR. In response, she took the plea that her husband called the accused from her mobile number to harshly reprimand him.
After the trial court's order, the IAS officer appealed in the high court.

NEW DELHI: In a significant ruling, the Supreme Court has set aside an order of the Jharkhand High Court which granted anticipatory bail to a man, allegedly accused of cruelty and attempt to murder of his wife, on the condition that he would resume conjugal life with her and maintain her with dignity and honour. A two-judge bench of the apex court, headed by Justice Dipankar Datta and Justice Augustine George Masih, held that conditioning the grant of pre-arrest bail on the accused resuming conjugal life with his wife is improper and not permissible under the law. The court quashed the order passed by the Jharkhand High Court. 'The spouses seemingly, at one point of time, had drifted apart and resided separately for some time. Imposing a condition that the appellant (accused husband) would maintain the respondent no.2 (wife) with dignity and honour is beset with risk in that it can generate further litigation. In such state of affairs, we are of the considered opinion that the High Court should have considered the prayer of the appellant for pre-arrest bail entirely on its own merit instead of imposing a condition,' the court observed in its order. According to the prosecution, the husband, Anil Kumar, was allegedly an accused in a case registered under Sections 498-A (cruelty), 323 (voluntarily causing hurt), 313 (causing miscarriage without consent), 506 (criminal intimidation), 307 (attempt to murder), 34 (common intention) of the Indian Penal Code, along with Sections 3 and 4 of the Dowry Prohibition Act, 1961.

Ex-film producer arrested for duping Delhi woman of over ₹12.85 lakh
A 25-year-old former Marathi film producer was apprehended from Maharashtra's Pune for allegedly duping a resident of Delhi of over ₹12.85 lakh through a fake cryptocurrency investment scheme, an official on Saturday said. A team from Delhi Police conducted a raid in Pune and apprehended Kale.(Unsplash/representational) The accused, identified as Akshay Ashwin Kale, posed as a financial advisor and lured unsuspecting victims into investing in fake cryptocurrency schemes, he said. Deputy Commissioner of Police (DCP), West, Vichitra Veer, said that a complaint was received on May 20 at the Cyber Police Station in which a Delhi resident alleged that he was defrauded of ₹12.85 lakh by a man posing as a crypto investment consultant. "The complainant was promised lucrative returns. He was contacted through social media and guided to invest money in what appeared to be a legitimate cryptocurrency trading platform. Trusting the process, the complainant deposited ₹12.85 lakh in multiple tranches," he added. The DCP said that access was denied when the complainant attempted to withdraw his investment. Police traced the flow of funds during investigation and found that the money had been dispersed across 29 different bank accounts, said the officer, adding that a breakthrough came when one of the accounts was found actively withdrawing funds via ATMs in Pune. A team from Delhi Police conducted a raid in Pune and apprehended Kale. Further investigation revealed that Kale, who had previously worked as a producer in the Marathi film industry, suffered significant financial setbacks and subsequently turned to cybercrime for quick money. "He created a web of fake bank accounts and used cryptocurrency as a front to collect funds. He would then siphon off the money by converting it through multiple channels to avoid detection," the DCP said. Kale reportedly exploited his background as a financial advisor to build credibility among his targets. He targeted people with promises of high returns on crypto investments, only to disappear once funds were transferred, police said. Kale had earlier produced a few Marathi films before shutting down operations due to losses, they said. Further investigation is underway to identify other victims and associates involved in the racket, said police suspecting that more people may have fallen prey to this scheme.

HC upholds charges against suspended Delhi govt official Khakha
NEW DELHI: The Delhi High Court has reportedly refused to quash the charges framed against suspended Delhi government official Premoday Khakha, who allegedly raped a minor girl several times. The High Court also upheld the charges of causing the minor girl's miscarriage and the disappearance of evidence framed against the official's wife, Seema Rani. It further refused to set aside the charge against his two children and wife under Section 21 of the POCSO Act for failure to report the offence despite having knowledge. 'This court is of the considered opinion that there is no perversity or legal infirmity in the order passed by the sessions court framing charges against petitioner Premoday Khakha for offences under Sections 376(2)(f), 376(3), 323, and 354 of the IPC, and Sections 6 and 8 of the POCSO Act,' Justice Swarana Kana Sharma said in the judgment passed on July 15 and made available on July 28.
