Kolkata: The Calcutta High Court on Thursday ordered an interim stay on the proposed demolition of an illegal four-storey building owned by Kamarhati Trinamool leader Jayanth Singh on Pratap Rudra Lane of Ariadaha.

Justice Kausik Chanda stayed the proposed demolition for two weeks until the matter came up before the regular bench of Justice Gaurang Kanth on June 23.
Justice Kanth earlier ordered the demolition of the illegal building and chastised the Kamarhati Municipality for not taking action. Kamarhati Municipality served notice to Singh. Meanwhile, Prasant Singh, claiming to be a resident of the building, moved the division bench of Justice Rajasekhar Mantha and Justice Ajay Kumar Gupta on June 10. He submitted that the municipality didn't serve notice to him when West Bengal Municipal Act provides for prior notice and an opportunity for the owner or the person responsible to be heard before issuing a demolition order.
Justice Chanda on Thursday held the regular bench would hear the main matter, and stayed the proposed razing.

Most cases have been drawn up under sections 189(2) (unlawful assembly), 191(3) (force or violence used by an unlawful assembly), 121(1) (voluntarily causing hurt), 132 (criminal force to any person being a public servant in the execution of his duty), 109 (attempt to murder), 61(2) (criminal conspiracy) of the BNS Act, 3 PDPP Act, and 9 WB MPPO Act. Those involved in the assault near J L Nehru Road might soon face organised crime charges, sources said. In Kolkata, six FIRs were lodged at New Market police station and one at Hare Street police station. While cops didn't specify if any names were mentioned in the FIRs, BJP claimed names of their functionaries like Ashok Dinda, Agnimitra Paul and Kaustuv Bagchi — who were seen at the J L Nehru Road flashpoint — were named in the suo motu complaints by police. Varma was at the hospital to check on police constable Prasanta Poddar (36) — the security guard of DC SSD Bidhisha Kalita. Poddar was among the three policemen admitted to the hospital after they sustained injuries at the hands of the vandals on Saturday. "He sustained head injuries but is otherwise stable," said Varma. Earlier on Friday, Lalbazar issued a photograph of Poddar being pinned to the ground by a protester while another protester was seen stomping his head. Sometime later, he was seen being rescued and escorted away by policemen while he was bleeding from his head. In total, five policemen were injured. Apart from Poddar, two others — ASI Jagabandhu Saha (58) and home guard Chaitanya Mahanta (30) — were also admitted to the trauma care centre of the hospital. Two other policemen — constable Nimai Mondal (44) of Tollygunge traffic guard and constable Mithun Ghosh (38) of Shakespeare Sarani police station — were discharged after preliminary treatment from the hospital. Ahead of the 'Nabanna Abhijan', police warned of strict action if Calcutta High Court's orders were disobeyed. Saturday saw a day-long chaos. City cops have filed seven FIRs but are yet to make any arrest. On Friday, Calcutta High Court reiterated that the protesters will ensure a peaceful protest and that the police will maintain the law-and-order situation. Various trader groups of Howrah Maidan, MG Road, Brabourne Road, and CR Avenue moved the HC, anticipating disruptions due to the march, considering last year's experience when the protest took an ugly turn and about 47 police personnel were injured and one lost his eyes. When asked about leader of opposition Suvendu Adhikari abusing Varma publicly, the police commissioner avoided the issue, saying, "The matter is under investigation, and at this moment, it would be inappropriate to comment." Kolkata: The Kolkata Police have registered seven FIRs against BJP MLAs for violating the Calcutta High Court's order for a peaceful Nabanna Avijan on August 9 and assaulting on-duty policemen. The city police have claimed that as many as five constables were injured after the march to the state secretariat turned violent. The police said on Sunday that the FIRs have been registered against BJP MLAs Ashok Dinda, Agnimitra Paul, and BJP leader Koustav Bagchi and others at the New Market Police Station. The leaders have been accused of destroying public property, preventing government officials from discharging their duties, threatening on-duty policemen, verbally abusing them, assaulting constables, and violating the high court order for a peaceful protest. The police said that five policemen were injured during the Saturday protest march. Of them, three have been admitted to the state-run SSKM Hospital for treatment. On Monday morning, Kolkata Police Commissioner Manoj Kumar Verma paid a visit to the injured policemen at the hospital. Speaking to the media persons outside the hospital, Verma said that five policemen were injured. 'Two have been discharged, while three are undergoing treatment as they had head injuries. So far, seven FIRs have been registered against those who were present at yesterday's rally for violating the Calcutta High Court's order, assaulting policemen, threatening some of them, and damaging government and private properties," said Verma. Following the high court's order for a peaceful protest, the Kolkata Police had earmarked two places for the proposed 'Nabanna Avijan' programme on August 9 -- one at Santragachi Bus Stand under Howrah Police Commissionerate and the other at Rani Rashmoni Avenue in the Kolkata Police area. However, the protesters ignored the police directive and marched towards Nabanna from Dorina Crossing in central Kolkata. However, the march was marred by massive violence after a scuffle broke out between protesters and policemen at Park Street and Jawaharlal Nehru crossing. The most unfortunate part was that the victim's mother had to be hospitalised after she fell ill amid police action against the protesters. She alleged that she was beaten up by policemen. City police commissioner Manoj Verma said that they are examining the footage of the CCTV cameras and video footage to ascertain whether the victim's mother was beaten up or not. "It is a part of our investigation. We are assessing yesterday's video footage. Action will be taken based on the assessment. We are checking footage from all angles, even drone camera footage. Unless we verify all the footage, we cannot make any assessment. But it is a part of our investigation," said Verma.

Thousands of people are set to hit the streets of Kolkata on Saturday and march to the State Secretariat (nabanna buildings) demanding justice for the doctor who was raped and killed at R.G. Kar Medical College and Hospital a year ago. The parents of the doctor, who will lead the march, have appealed to the public to join the protest. 'Nabanna Abijaan marks one year since we lost our daughter. However, we are unsure of whether we will be able to reach Nabanna, considering how the police are barricading roads throughout Kolkata and Howrah ahead of the rally. We can take out a peaceful protest if we can reach the venue,' the victim's father told The Hindu on Friday. He added that they have received positive response from people across the socio-economic and political spectrum. He said the family sent written invitations to several political parties except Trinamool, and received 'affirmative responses from even 'Trinamool-associated' people, especially women.' 'People from all walks of life and all political backgrounds are welcome to join the march without flags. We are expecting a heavy footfall,' he said. The victim's family is also likely to join the night-long protest gatherings and memorials being organised at Shyambazar Crossing and RGKMCH to mark one year of the crime, on Friday night. The police on Friday said they will enforce prohibitory orders, which is already in place around the State Secretariat. Prohibitory orders 'Howrah police has issued prohibitory orders under Section 163 of the Bharatiya Nagarik Suraksha Sanhita. Therefore, in the area surrounding Nabanna, any protest rallies, gatherings, meetings, or marches are prohibited and illegal, as made clear by the Calcutta High Court order,' said Additional Director General of Police, South Bengal, Supratim Sarkar. On Thursday, a Division Bench of the Calcutta High Court, while hearing a petition seeking prohibition of Nabanna Abhijaan, held that the right to protest is fundamental. However, the court order on August 7 also noted that 'it will be open for the government to implement the said prohibitory order in accordance with the law and inform the organisers about adequate alternative place for protest.' Referring to the court's directions, Mr. Sarkar said the police have marked Howrah's Santragachi Bus Stand and Kolkata's Rani Rashmoni Avenue as alternative venues for the protest rally. 'The protest may be carried out at these venues in a lawful, democratic, and peaceful way, without damaging public property or harming police and government officials. This is our request to the organisers. There is no doubt that police will take action if protesters break the law in any way,' Mr. Sarkar said.
