Ex-San Jose city councilman Omar Torres remains in jail with no bail

SAN JOSE, Calif. (KRON) — Ex-San Jose Councilmember Omar Torres was slated to enter a plea on Friday at the Hall of Justice to face child sex abuse charges. After his defense attorney requested a delay, Torres' arraignment was pushed back until February 14 and Torres returned to his jail cell.
The disgraced politician has been held in custody without bail ever since his arrest on November 5, 2024. A judge previously ruled that Torres remains a danger to minors.
A police affidavit obtained by KRON4 contains text messages from Torres in which he says he had oral sex with a 17-year-old. The texts were exchanged with a 21-year-old Chicago man, Terry Beeks, who Torres had an online sexual relationship with, the affidavit said.
While he was serving as a city councilman, Torres allegedly asked Beeks about 'finding minors,' Beeks told police. On April 8, 2022, the two men texted about plans to meet for a sexual encounter with multiple people. According to the affidavit, the ex-councilman wrote, 'U got any homies under 18. I want hella homies u will see i'm wild in bed.'
His defense attorney told KRON4 in October that the texts were 'outrageous fantasy and role play,' and 'do not reflect any real-world actions or intentions.'
Charges filed against Torres stem from incidents that occurred between 1990 and 1999, when he allegedly raped a minor victim. In a recorded conversation between Torres and the victim, Torres admitted to sexually assaulting the victim 20 to 25 times, investigators said.
The incidents began when the victim was just 4 years old, a police report states, and continued until 1999, when Torres was 18 and the victim was 13.
Defense attorney Nelson McElmurry said a plea deal is possible to resolve the charges. 'He wants to accept responsibility (and) do the right thing. We just want to make sure the plea agreement is fair and consistent with charges of this type.'
The San Jose Police Department is still investigating to find out if the ex-councilman committed crimes in connection to the 2022 Beeks communications.
Torres represented District 3 until he resigned in November. This week, the City Council chose Carl Salas to fill the vacant seat for District 3. Salas will hold the seat until a special election is held in June.
If convicted, Torres is facing a maximum sentence of 24 years in prison.

Arenas played 11 seasons in the NBA, most notably with the Washington Wizards. If convicted, he could face up to five years in federal prison for each charge. 'At this point in the case, he is presumed innocent, right?' his attorney Jerome Friedberg said outside the courthouse, per the Associated Press. 'He has the same right as any other citizen to that presumption and that's how he should be treated.' Former CIA Director John Brennan and former Director of National Intelligence James Clapper responded sharply Wednesday to Trump administration allegations that they cooked intel in the sprawling Russia investigation that dominated the president's first term. "That is patently false. In making those allegations, they seek to rewrite history. We want to set the record straight and, in doing so, sound a warning," the pair wrote in a guest essay for The New York Times. Director of National Intelligence Tulsi Gabbard has alleged former President Barack Obama and members of his administration, including Clapper and Brennan, promoted a "contrived narrative" that Russia interfered in the 2016 election to benefit Trump, which led to the sprawling collusion investigation that consumed Trump's presidency. Trump has described the alleged actions by Obama, Clapper, Brennan and Comey as "serious treason." "While some external critiques have noted that parts of the Russia investigation could have been handled better, multiple, thorough, years-long reviews of the assessment have validated its findings and the rigor of its analysis," Brennan and Clapper wrote, arguing the most "noteworthy" example was the bipartisan Senate Intelligence report on the investigation. "Every serious review has substantiated the intelligence community's fundamental conclusion that the Russians conducted an influence campaign intended to help Mr. Trump win the 2016 election," the pair continued. "Although the misrepresentations and disinformation of the administration are too numerous to address here, let us set the record straight on three. To be clear, we are writing here in our personal capacities, and our views don't imply the endorsement of any federal agency." Brennan and Clapper argued that the Steele Dossier, which was authored by ex-British intelligence officer Christopher Steele and funded by Hillary Clinton's presidential campaign and the DNC, was not used as a source or taken into account for any of the analysis. However, they added it was included as a "separate annex only to the most highly classified version of the document that contained the assessment," at the direction of the FBI. The intelligence officials also said that their assessment made "no judgment" about the impact of the Russian operation on the outcome of the 2016 election. "Russian influence operations might have shaped the views of Americans before they entered the voting booth, but we found no evidence that the Russians changed any actual votes," Clapper and Brennan wrote. Clapper appeared on CNN to dispute the allegations, telling host Kaitlan Collins that the claims were false. Brennan joined MSNBC earlier this month and said he was "clueless" as to why he would be investigated. "Finally, and contrary to the Trump administration's wild and baseless claims, there was no mention of 'collusion' between the Trump campaign and the Russians in the assessment, nor any reference to the publicly acknowledged contacts that had taken place," Clapper and Brennan added. The pair insisted the "real politicization" was coming from members of Trump's administration, specifically Gabbard and CIA Director John Ratcliffe. "The real politicization is the calculated distortion of intelligence by administration officials, notably Mr. Trump's directors of national intelligence and the C.I.A., positions that should be apolitical. We find it deeply regrettable that the administration continues to perpetuate the fictitious narrative that Russia did not interfere in the 2016 election. It should instead acknowledge that a foreign nation-state — a mortal enemy of the United States — routinely meddles in our national elections and will continue to do so unless we take appropriate bipartisan action to stop it," Clapper and Brennan concluded. Michael Donilon, a longtime aide to former President Joe Biden, is sitting down with House investigators in Oversight Committee Chair James Comer's autopen probe on Wednesday. Donilon is one of Biden's most enduring confidantes, with a working relationship that began in 1981 when the former president was a U.S. senator from Delaware. He's also no stranger to Washington, D.C., having earned both his Bachelor's Degree and Juris Doctor from Georgetown University. Donilon later worked on both Biden's 2020 and 2024 campaigns as a chief strategist and is one of the key people to have gone on the offensive against his fellow Democrats after they cast Biden out following his disastrous June 2024 debate against now-President Donald Trump. "Now, lots of people have terrible debates," Donilon said during a Harvard University event. "Lots of people have terrible debates. Usually the party doesn't lose its mind, but that's what happened here. It melted down." It earned him rebukes from fellow left-wingers, including ex-Obama advisor and CNN political commentator David Axelrod, who called Donilon's comments "delusional" on X. And while his work for Biden made him a national-level figure, Donilon spent years working on other notable Democratic campaigns. He played a role in the electoral successes of both former President Bill Clinton in 1992 and ex-Virginia Gov. Douglas Wilder in 1989, among others. But it's the four-year period during which Donilon served as senior advisor to the Biden White House, and then his stint on Biden's short-lived 2024 campaign, that's captured the attention of the House Oversight Committee. He was dubbed a member of Biden's "Politburo" by Axios reporter Alex Thompson and CNN host Jake Tapper in their book "Original Sin" – described as a small group of insiders who reportedly helped run the White House while covering signs of Biden's decline from others. "The president valued Mike Donilon's advice so much that aides would later joke that if he wanted, he could get Biden to start a war," the authors wrote. Donilon was also paid $4 million to work on Biden's re-election bid, according to the book. The Wall Street Journal reported in Dec. 2024 that Donilon was also a key intermediary between Biden and his pollsters during that short-lived campaign. And he was with Biden until the very end of his administration, reportedly as one of the aides in Rehoboth Beach, Delaware, joining the then-president when he drafted the explosive letter that ended his campaign. Since that ended, Donilon took up a role as a Spring 2025 Resident Fellow at Harvard University's Institute of Politics.
