
After 10 years, HC frees main jailed for rape of minor
Bhopal/Jabalpur: A division bench of MP high court has acquitted a man who spent 10 years in jail after being convicted of raping a 12-year-old girl, citing a lack of conclusive evidence and inconsistencies in the prosecution's case.
Rinku alias Ghanshyam, in his revision petition filed in 2015 following conviction by a POCSO court, said the FIR about rape was lodged 10 days after the alleged incident, there was no plausible ground for delay in reporting the incident to police. Besides, he was held guilty and sentenced without a DNA report confirming rape with the minor girl.
It was alleged in the FIR that he dragged the girl to a corner while she was playing the residence of her friend and raped her and when she shouted for help, mother of the girl's friend came there and the accused ran away.
The division bench of justices Atul Sreedharan and Anuradha Shukla, in their order, said the delay in lodging FIR has been explained by the family of the girl stating that they were scared but the girl's mother visited the house of the convict after the incident to express her anger.
"If she were scared, she would not have not done it. The convict didn't threaten the girl at the time of the alleged incident or thereafter. Mother of the girl's friend had seen the incident and a lot of people in the village knew about it.

The girl's mother has also admitted that the Sarpanch of the village asked her to lodge an FIR against the accused.
An FSL report confirmed presence of sperm in the undergarment of the girl, but police didn't proceed to get DNA profiling done to substantiate the charge of rape on the convict.
Besides, delay in lodging FIR about a crime raises doubts over credibility of the charge. In the absence of credible evidence, the decision of the trial court was set aside and the convict was acquitted, the judges said in the ruling.

Lucknow, Eid-ul-Azha was celebrated across the state on Saturday with people offering namaaz amidst tight security. Similarly, in Sambhal and Bareilly, the Eid-ul-Azha namaaz was held peacefully amid heavy police deployment. "We had a peace committee meeting for Eid-ul-Azha. Everyone agreed to not sacrifice in public places. We have set up a three-tier security system and we spoke to maulanas, muftis, and representatives of mosques. There was an agreement to not sacrifice animals at public places and 19 designated places were agreed upon for sacrifice," Sambhal District Magistrate Rajender Pensiya told reporters at the Eidgah. In Amethi, prayers were conducted at 367 mosques and Eidgahs, with different timings established to ensure peaceful observance. Superintendent of Police Aparna Rajat Kaushik assured that people were celebrating the festival with great joy while maintaining peace.

Mentally unstable man dies by suicide after killing wife in Nalanda
Patna: A mentally unstable man killed his 35-year-old wife and then died by suicide after locking himself in his room at Madarchak village under Hilsa police station area in Nalanda district on Saturday morning. According to police, Chhathu Ravidas (40) first attacked his wife, Lachhu Devi, with a stone grinder (silwat) following an argument over a domestic dispute, and then pushed her off the roof of their house. Their children, who witnessed the violent altercation between their parents, fled the house and informed neighbours about the incident. Hilsa SDPO, Ranjan Kumar, said, "Upon receiving information about the incident, the local police arrived at the spot. They broke open the room and found Ravidas unconscious. He was rushed to the sub-divisional hospital, where doctors declared him dead." The SDPO further said that the initial investigation revealed that Ravidas was undergoing treatment for mental illness in a Ranchi hospital about two years ago. At the time of the incident, his parents were in Patna, where his mother was receiving medical treatment. The couple is survived by five children, he said. "While local residents suspect that Ravidas might have consumed poison to kill himself, no evidence of toxic substances was found in the room, nor were there any visible signs such as froth at his mouth. The exact cause of Ravidas's death will be known after the postmortem. The bodies have been sent to Bihar Sharif Model Hospital for the autopsy. Police have launched a thorough investigation into the case," the SDPO added. According to police sources, Ravidas was showing signs of mental disturbance for the past few days leading up to the incident.
