Supreme Court
's judgment fixing deadlines for President and governors in granting or withholding assent to bills passed by assemblies, Centre on Saturday warned impermissible invasion of constitutionally conferred high plenary zone on the top constitutional post holders by SC in the garb of judicial review powers would destabilise the balance of powers among the Legislature, the Executive and the Judiciary.
"A wide-ranging judicial review of assent procedures, either post-assent or at a stage anterior to the grant of assent, would potentially destabilise the constitutional balance between organs of State. It would create an institutional hierarchy and upset the constitutional balance of powers between the three organs," it said, adding the judiciary does not hold keys or solutions for every conundrum that may arise in a democratic society.
Objecting to the manner in which SC used its exclusive powers under Article 142 to arrogate itself the power to amend the Constitution to fix deadlines for the President and governors in granting or withholding assent to bills and grant "deemed assent" to 10 Tamil Nadu bills, the Centre said, "Article 142 does not empower the court to create a concept of 'deemed assent', turning the constitutional & legislative process on its head.

In its written submissions filed Saturday in support of President Droupadi Murmu's reference raising 14 queries to situations arising after the contentious Apr 8 judgment by Justices J B Pardiwala and R Mahadevan, Centre said exercising judicial powers over decisions of the President and governors in relation to bills would confer supremacy on judiciary, which is against the Constitution's basic structure, a red line that cannot be crossed by any organ of governance.
"The classical notion of judicial review cannot be lifted and applied to assent as the factors at play during the grant or withholding of assent have no legal or constitutional parallel. The unique duality of assent thus deserves a uniquely calibrated judicial approach," it said. It said each of the three organs of governance derive power from the Constitution, which does not assign any higher pedigree or superiority to any one organ that would enable judiciary to relegate the high position of gubernatorial post to a subservient one.
Issues relating to bills, with regard to decisions of the President and governors, "deserve political answers and not necessarily judicial," the Centre said.
Certain political questions may arise in the exercise of the core functions of any of the three organs, and these would have been answered through democratic remedies under the Constitution. The judiciary, in the zest of finding a solution to every problem, cannot brush aside the essential constitutional feature of separation of powers, the Centre said.
Though some overlap has happened over the years despite clear separation of powers envisaged by the Constitution, the powers and limitations of these three organs flow from the same constitutional text without ascribing "any higher pedigree or superior legitimacy to any organ", it said. Notwithstanding the overlap, certain zones remain exclusive to each - Legislature, Executive and Judiciary, it said, adding none can trench upon the domain exclusive to another.
Disapproving the manner in which the Tamil Nadu governor was treated in SC's Apr 8 judgment, the Centre said governors are not foreigners in states, not just emissaries of the Centre but represent national interest and democratic will in states as part of national fraternity.
"When the Constitution seeks to impose time limits for taking certain decisions, it specifically mentions such time limits. On the other hand, when it designedly sought to keep the exercise of powers flexible, it did not impose any fixed time limit. Since the text of Art 200 or 201, does not provide a specific time limit, no form of judicial review or judicial interpretation can impose the same." it said.

The Supreme Court has overturned the result of a 2022 gram panchayat election in Haryana after issuing summons for the Electronic Voting Machines used during the polls and directing its registrar to conduct a recount of the votes. The case pertained to an election in November 2022 for the post of sarpanch of Buana Lakhu village in Panipat district. After the registrar recounted the votes in the Supreme Court, the defeated candidate Mohit Kumar was found to have obtained 51 more votes than Kuldeep Singh, the candidate who had been declared the winner. Subsequently, a bench of Justices Surya Kant, Dipankar Datta and N Kotiswar Singh on August 11 ordered the Panipat deputy commissioner-cum-election officer to issue within two days a notification declaring the defeated candidate as the elected sarpanch. The Supreme Court also said that the newly-elected sarpanch, who was the petitioner in the matter, would be entitled to assume his office immediately and perform his duties. It added that the result was subject to the final judgement of the election tribunal. The bench said that there was 'prima facie no reason to doubt the report submitted by the OSD [officer on special duty/registrar] of this court, especially when the entire recounting has been duly videographed and its result is signed by the representatives of the parties'. It added: '…we are satisfied that the appellant deserves to be declared as the elected sarpanch' in the election held in November 2022. During the hearing, Kant said that the candidate who was earlier declared as the winner of the election was not to be blamed as the 'blunder' happened only in one booth, Live Law reported. '…complete mess created by returning officer/the counting officer, it is he who committed a blunder,' Live Law quoted the judge as saying. 'In these kind of matters, the only solution is, you go for thought that High Court will write 15 pages to deny recount!' The case In 2022, a candidate Kuldeep Singh was declared the winner of the gram panchayat election in Buana Lakhu. However, the returning officer suo motu ordered a recounting of votes on the same day because of an error in the preparation of the result by the presiding officer at one of the booths, Live Law reported. Following this, another candidate named Mohit Kumar was declared elected. Kuldeep Singh had challenged the result the Punjab and Haryana High Court, which noted that the outcome of the election could not be suo motu changed by recounting the votes once a candidate was declared elected. The appropriate remedy available to an aggrieved party was to file an election petition, it added. The bench had set aside Kumar's election and directed authorities to notify Kuldeep Singh as the elected sarpanch. In response, Kumar filed an election petition, after which Kuldeep Singh raised a preliminary objection on the grounds of limitation. The matter eventually reached the Supreme Court, which rejected Kuldeep Singh's objection and directed the election tribunal to decide the case within four months, Live Law reported. In April, the election tribunal held that there was a need to recount the votes at one of the booths and the deputy commissioner-cum-election officer was directed to conduct the exercise. However, this order was set aside by the High Court after Kuldeep Singh filed an appeal. Subsequently, Kumar moved the Supreme Court against the High Court order. In July, the Supreme Court ordered the production of the EVMs before a nominated registrar, Live Law reported. The registrar was directed to recount the votes for all five booths and this exercise was videographed. The report submitted by the registrar after the recount indicated that Kumar had secured 51 votes more than Kuldeep Singh in the revised result. On August 11, the Supreme Court reversed the earlier results but added that since one of the petitioners contended that certain other issues remained to be adjudicated, the parties were at liberty to present it before the tribunal.

Prime Minister Narendra Modi on Sunday underlined the need to transform New Delhi into a 'Vikas Model' (development model), saying the national capital should embody the aspirations of a nation determined to become 'Viksit (developed)'. Addressing a large public gathering during the inauguration of the Dwarka Expressway and Urban Extension Road-II (UER-II), PM Modi congratulated residents of the national capital on the occasion. He mentioned that the farmers and labourers would be the ones who would get the most benefits from the newly constructed projects. He drew a cultural connection while noting, "The highway is named Dwarka Expressway, the name of the place is Rohini, the occasion is Janmashtami, and by coincidence, I am also from the land of Dwarkadeesh. Poora mahaul bahot Krishnamay ho gaya hai (the entire atmosphere is filled with devotion towards Lord Krishna)". Emphasising the importance of the new infrastructure, he said, "Delhi got the connectivity of UER-II and Dwarka Expressway, which will ease the lives of the people of the NCR. Travelling to offices will become easy, and it will save a lot of time. Our farmers, labourers and businessmen will benefit a lot from it." Linking the projects to his Independence Day address, PM Modi said India's economic momentum is being recognised globally. "The entire world knows what the new India is thinking, it is aspiring to be, what its resolutions are. When the world sees India, the first thing they think about is our capital, Delhi. This is why we have to make Delhi a 'Vikas Model', which shows that it is the Capital of India, which is aspiring to become 'Viksit'," he said. Reflecting on the government's efforts over the past 11 years, the Prime Minister said the BJP-led Centre has been "relentlessly" working on multiple fronts to develop Delhi. Citing examples of infrastructure, he added, "Take connectivity, for instance. In the last decade, the connectivity in Delhi-NCR has seen historic progress. From modern and wide expressways to one of the world's largest metro networks and Namo Bharat. This shows how ease of connectivity has been put in place in Delhi-NCR." Earlier in the day, PM Modi held a massive roadshow at the Mundka-Bakkarwala Village Toll Plaza in the national capital, just hours before the inauguration of two major highway projects. Hundreds of people thronged the roadsides to catch a glimpse of the Prime Minister as he greeted the crowd. During the visit, he also interacted with the workers engaged in the construction of the highway section, acknowledging their efforts in shaping the project. The Prime Minister reviewed the progress of UER-II alongside Union Road Transport and Highways Minister Nitin Gadkari, Delhi Chief Minister Rekha Gupta, and Haryana Chief Minister Nayab Singh Saini.
