Supreme Court sets aside Kerala HC judgement cancelling election of A Raja as MLA
Raja, opposing the plea, had contended that he belonged to the Hindu Parayan community in relation to the state of Kerala and the caste certificate issued by Tahsildar, Devikulam proved the same.
He had also contended that the Returning Officer rightly rejected the objection by Kumar to the nomination paper filed by him.
The CPI(M) leader also claimed that his parents had never converted to Christianity, he was never baptised, his wife was a Hindu and that his marriage was according to Hindu rites which included lighting of a customary lamp and tying of 'thali' around his wife's neck.
In his plea, Kumar had alleged that Raja was a Christian, baptised at a CSI church in the hill district, and submitted a fake certificate to prove that he belongs to an SC community.
Kumar, who was defeated by a margin of 7,848 votes in the 2021 polls by Raja, had also claimed that even the wife of the CPI(M) leader was a Christian and they were married in accordance with Christian religious rites.
Agreeing with the contentions of the Congress leader, the high court had said it was well evident from the evasive answers given by Raja regarding his marriage and the ceremony that there was a "conscious effort" on his part to conceal the truth.
The dress worn by him and his wife are indications of a Christian marriage, the court had noted.
The court had also said that all the documents placed before him "would sufficiently show that the respondent (Raja) was actually professing Christianity at the time when he had submitted his nomination and converted to Christianity long before its submission".
"As such, after the conversion, he cannot claim to be a member of Hindu religion. On that score also, the Returning Officer ought to have rejected his nomination," the court had said.
It had also held that there was "utter failure" on the part of the CPI(M) leader to show and prove that his predecessors (grandparents) migrated to Kerala prior to promulgation of the 1950 order by the President of India by which Hindu Parayans in Kerala were declared as a part of SC community.
"In short, on both the grounds, it is clear that the respondent is not a member of 'Hindu Parayan' within the state of Kerala and not qualified to be chosen to fill a seat -- the Devikulam Constituency -- in the Legislative Assembly which is reserved for a Scheduled Caste, the court had said."
Hence, the election of respondent (Raja) as the returned (elected) candidate for the said Constituency in the year 2021 is declared void under Section 98 of Representation of People Act, 1951.
"There is no claim for the petitioner (Kumar) for declaring him as the returned candidate from the said Constituency, hence, no such issue was taken up for consideration," it had said.

Rijiju launches portal for registration, monitoring of waqf properties
Union minority affairs minister Kiren Rijiju on Friday launched a portal for the registration and monitoring of waqf properties, calling it a symbol of dedication to transparency and good governance. The Unified Waqf Management, Empowerment, Efficiency, and Development (UMEED) portal seeks to bring all stakeholders onto a single digital platform and streamline the management of waqf properties by ensuring real-time data collection and open access to verified information. 'We are taking a firm step toward ensuring that waqf properties are used for the benefit of the intended communities,' said Rijiju at the portal launch in the presence of minister of state for minority affairs George Kurian. Waqf properties are required to be registered on the portal within six months of the launch date. Rijiju asked representatives of state waqf boards, who were present at the launch virtually, to ensure adherence to the six-month limit. Respective state boards will have to carry out the registrations. Properties not registered within six months may get up to a two-month extension in exceptional cases such as technical delays. Those that remain unregistered beyond the extended deadline will be classified as disputed and referred to the Waqf Tribunal. Minority affairs secretary Chandra Shekhar Kumar said the portal will allow submission of documents for registering a property to prevent the inclusion of illegal or encroached land. He added the custodians of properties without documentation will be required to approach the tribunal for verification. 'Since land is a state subject, it will ultimately be up to the state governments to confirm or deny whether the land in question is indeed waqf,' Kumar said. Kumar said that women, children, and economically weaker sections will be among the primary beneficiaries of Waqf assets. The portal, which includes a field asking whether a property is on government land, was launched weeks after the passage of the Waqf (Amendment) Act. Petitions challenging the law's constitutional validity are pending in the Supreme Court. On April 17, the court declined to stay the law after the government submitted that certain provisions would not be enforced for now. Rijiju refused to comment on the challenges to the law, saying the matter is sub judice. 'I hope the court recognises that this is a landmark law... The opposition must accept this and cooperate with the government to ensure smooth implementation. As for the waqf rules, it is a natural process. We are actively working on it.' The waf properties have to be registered with details such as dimensions and geotagged locations. Properties recorded in the names of women will be ineligible to be declared as waqf. The portal will generate a 17-digit unique identification number for each property based on the state and district codes, property type, etc. The portal features dropdown-based structured data input and an online grievance redressal mechanism. The public will have access to the property information. A three-tier user verification process has been instituted for the portal. The mutawalli or an authorised person of a waqf board will initiate data entry. The checker will be a district-level officer or a designated official to verify the data, and the approver will be the CEO or an officer to grant final approval. Data protection and privacy regulations will cover the portal. A toll-free helpline has been made available for technical assistance and support.

New Delhi, CPI Rajya Sabha MP P Sandosh Kumar on Friday wrote to President Droupadi Murmu alleging "misuse' of gubernatorial authority in the opposition-ruled states. Mentioning a recent incident in Kerala where a portrait of 'Bharat Mata' was used at an event at the Raj Bhavan, leading to a boycott of the function by a state minister, Kumar expressed serious concern over the "continued misuse of gubernatorial authority in the opposition-ruled states". Kumar said it was most recently reflected in the conduct of the Kerala governor during the Environment Day celebrations at the Raj Bhavan, where a "particular version of the Bharat Mata image" was displayed without consulting the state government. "The arbitrary imposition of a particular version of the Bharat Mata image – without consultation with the elected government – forced Agriculture Minister P Prasad to boycott the event," Kumar said.
