
SC stays order for removing apple orchards from forest land in HP
A bench of Chief Justice B R Gavai and Justices K Vinod Chandran and N V Anjaria was hearing a plea of former deputy mayor Tikender Singh Panwar and activist Rajiv Rai, a lawyer.
Appearing for Panwar, senior advocate P V Dinesh and advocate Subhash Chandran KR argued the high court had erred in its finding, which impacted lakhs of apple growers, especially in the monsoon season.
Panwar said the high court in its July 2 order directed the forest department to remove the apple orchards and plant forest species in their place, with costs ordered to be recovered from encroachers as arrears of land revenue.
'The order is arbitrary, disproportionate and violative of constitutional, statutory and environmental principles, thereby necessitating the intervention of the Supreme Court to prevent irreversible ecological and socio-economic harm in the ecologically fragile state of Himachal Pradesh," the plea said.
Such large-scale tree-felling, particularly during the monsoon season, significantly heightens the risk of landslides and soil erosion in Himachal Pradesh, a region characterised by its seismic activity and ecological sensitivity, it added.
'Apple orchards, far from being mere encroachments, contribute to soil stability, provide habitats for local wildlife and form the backbone of the state's economy, supporting the livelihoods of thousands of farmers," the plea said.
Panwar said the high court order, mandating the blanket removal of apple trees without conducting a comprehensive environmental impact assessment (EIA), was arbitrary and in contravention of the precautionary principle — a cornerstone of environmental jurisprudence.
The plea argued the destruction of these orchards not only threatened environmental stability but also the fundamental right to livelihood enshrined under Article 21 of the Constitution.
'The high court's order lacked the requisite EIA to assess its environmental and socio-economic impacts, thereby violating the principles of reasonableness and proportionality as elucidated in cases such as Coimbatore District Central Co-operative Bank," the plea said.
The petitioners further argued that the felling of apple trees during the monsoon season exacerbated ecological risks, including landslides and soil erosion, contradicting judicial mandates for environmental assessments as seen in T N Godavarman Thirumulpad v. Union of India.
The economic ramifications are equally severe, as apple cultivation is a vital component of Himachal Pradesh's economy, and its destruction threatens the livelihoods of small-scale farmers, thereby infringing upon their constitutional right to life and livelihood, the petitioners added.
Panwar said as on July 18, reports indicated over 3,800 apple trees were felled in areas like Chaithla, Kotgarh and Rohru, with plans to remove up to 50,000 trees across the state.
'The enforcement of this order, as evidenced in public reports, led to the destruction of fully fruit-laden apple trees, evoking widespread public distress and criticism," the plea said.
Himachal Pradesh Chief Minister Sukhvinder Singh Sukhu on July 17 said the state government was not in favour of felling apple-laden trees from encroached forest land, stressing time ought to be granted to auction the produce. PTI MNL MNL AMK AMK

The Congress on Wednesday said Rahul Gandhi's lawyer raised the issue of threat to his life without his consent and will take back the statement in court on Thursday. Rahul Gandhi's lawyer said that he will "file a formal application tomorrow for withdrawal of the said Pursis" before the Pune court. (PTI File) An application, filed before Judicial Magistrate (First Class) Amol Shinde in Pune by Gandhi's lawyer Milind Pawar, said that Gandhi could face harm from the followers of the ideology of Vinayak Damodar Savarkar and Nathuram Godse, and providing "preventive protection" is the state's constitutional obligation. Congress' media and publicity department head Pawan Khera said Gandhi's lawyer raised the issue of threat to his life in the court without his consent. "Mr Gandhi has strong objection to this and tomorrow his lawyer will take back this statement in court," Khera said in a post on X. He also shared a press release by the lawyer which said "the Pursis dated 13.08.2025 was filed by me in the Court without Instructions from the client". "The contents of the Pursis were drafted by me without consulting my client Shri. Rahul Gandhi. My client has taken strong exception to filing of this Pursis dated 13.08.2025 and has expressed his disagreement with the contents of the Pursis," Pawar said. "I shall file a formal application tomorrow for withdrawal of the said Pursis before the Hon'ble Court," he said. The case, the trial of which is yet to start, pertains to certain comments allegedly made by Gandhi against V D Savarkar, freedom fighter and Hindutva ideologue. The application said that complainant Satyaki Savarkar had admitted that he is also a direct descendant, through maternal lineage, of Nathuram Godse and Gopal Godse, principal accused in the assassination of Mahatma Gandhi. Rahul Gandhi is the Leader of Opposition in the Lok Sabha and recently held a press conference in New Delhi, placing before the nation evidence of "electoral fraud" by the Election Commission, the application said. Gandhi also staged a protest in the Parliament complex, raising slogans such as "vote chor sarkar". "In light of the documented history of violent and anti-constitutional tendencies linked to the complainant's lineage, and considering the prevailing political climate, there exists a clear, reasonable, and substantial apprehension that Rahul Gandhi may face harm, wrongful implication, or other forms of targeting by persons subscribing to the ideology of Vinayak Damodar Savarkar," the application stated. "In such circumstances, preventive protection is not only prudent but is a constitutional obligation upon the state," it added. Advocate Pawar had said earlier this 'Pursis' or application was submitted as a precautionary measure with the objective of "legally safeguarding the fairness, integrity, and transparency of the present proceedings".

Punjab CM flags off 500 women panchayat leaders for Maharashtra convention
Chandigarh, Aug 13 (PTI) Punjab Chief Minister Bhagwant Mann on Wednesday flagged off a train carrying a 500-member delegation of women sarpanches and panchs to Maharashtra for the national convention of women panchayats. Mann termed it a red-letter day, saying the delegation comprises representatives from high-performing panchayats and aims to enable them to gain new experiences through interactions with peers from other states. He said the visit will help the elected representatives ensure holistic development of their villages. Panchayats are pillars of democracy, directly managing schools, dispensaries, veterinary hospitals and other public welfare institutions in rural areas, the chief minister noted. Mann expressed hope the visit would boost the confidence of women representatives and help them gain new insights for development of villages. The government will also facilitate the delegation's visit to Takht Sri Hazur Sahib in Nanded, he said, adding the initiative commemorates the 350th martyrdom anniversary of Guru Tegh Bahadur. The state will bear all boarding and lodging expenses, he added. Earlier, Mann paid obeisance at Gurdwara Sri Fatehgarh Sahib and vowed to follow the footsteps of Sikh Gurus and martyrs for the welfare of all sections of society. He recalled that the shrine is associated with the martyrdom of the 'chotte sahibzadas' — Sahibzada Zorawar Singh and Sahibzada Fateh Singh, the younger sons of Guru Gobind Singh — who were bricked alive along with their grandmother Mata Gujri by the Mughal governor of Sirhind. Dy CM threatens legal action against Tejashwi over ‘false allegations'
Patna: The ongoing political confrontation between the BJP and RJD intensified on Wednesday, with deputy CM Vijay Kumar Sinha lashing out at the opposition over allegations related to the voter list revision and his educational qualifications. He also threatened legal action against those who made false allegations against him. Describing himself as the Hanuman of NDA, Sinha said, "I will not let the alliance suffer at any cost. The time has come to teach a lesson to the sons of Shakuni and Duryodhana. The answer will be given in the language they want."
