SC directs Centre to set up special POCSO court on priority basis
New Delhi, The Supreme Court on Thursday directed the Centre to set up on "top priority basis" dedicated POCSO courts to exclusively deal with cases of sexual offences against children.
A bench of Justices Bela M Trivedi and P B Varale said due to the inadequacy of the number of exclusive courts for the Protection of Children against Sexual Offences Act cases, the timelines mandated under the law for completion of trials weren't adhered to.
"It is therefore expected that the union of India and the state governments shall take appropriate steps to sensitise the officials associated with the investigation of POCSO cases, and also to create dedicated courts to try POCSO cases on top priority basis," the bench said.
The top court further directed filing of chargesheets within the mandatory period stipulated in law besides completing trials within the prescribed time frame.
The apex court noted while majority states, with the funding from the Centre, complied with the directions for setting up exclusive courts for POCSO cases, in Tamil Nadu, Bihar, Uttar Pradesh, West Bengal, Orissa, Maharashtra, and a few other states, more POCSO courts were required given the pendency of such cases.
The top court had previously directed senior advocate and amicus curiae V Giri and senior advocate Uttara Babbar to submit state-wise details on the status of POCSO courts.
The apex court was hearing a petition underlining the "alarming rise in the number of reported child rape incidents" in a suo motu case.
The top court asked states to set up two designated courts in districts where the number of pending cases of child abuse under the POCSO Act was more than 300.
It made it clear that its July 2019 direction to set up one court in each district with more than 100 FIRs under POCSO Act meant a designated court would only deal with such cases under the law.

Iran's Supreme Court has handed down a death sentence to popular Iranian singer Amir Tataloo, born Amir Hossein Maghsoudloo, after convicting him of blasphemy, including insulting the Prophet Mohammed. Tataloo was earlier handed a five-year prison sentence on similar charges; however, the case was later reopened following a prosecutor's objection. After the review, the court overturned the previous ruling and issued the death penalty in January this year. Iranian singer Amir Tataloo Amir Tataloo was born on September 21, 1987, in Tehran's Majidieh neighbourhood. Due to his family's financial struggles, he balanced work and studies from a young age. At 14, he worked in a carpentry workshop and later, between 16 and 18, he was employed at a grocery store. After completing his studies, Tataloo pursued his passion for music, starting his career as an underground musician in Iran. He released his debut album 'Zire Hamkaf" in 2011 and went on to become one of Iran's most popular and controversial artists, known for blending pop, R&B, and rap. His first single, which he released in 2003, marked the beginning of his career as an underground musician. He recorded the song Manam Yeki az un Yazdahtam (I'm Also One of Those Eleven Players) for the Iranian National Football Team at the 2014 FIFA World Cup. Tataloo released 'Energy Hastei," a song supporting Iran's nuclear program, during the July 2015 Iran/5+1 nuclear talks in Vienna. The music video was filmed on the Iranian navy ship Damavand, and it topped Google's Persian trending searches. The song sparked controversy, particularly among Iranian Reformists, who drew comparisons to Mohammadreza Shajarian's songs backing the 2009 Iranian protests. He was arrested by the Iranian police in 2016, reportedly for promoting lyrics and a lifestyle that were seen as violating Islamic rules. Later, in 2023, Turkish authorities arrested him due to an expired passport and handed him over to Iranian authorities, who jailed him on charges including corruption. His first album, Zire Hamkaf, was released in 2021. Since then, he has put out 21 albums. He is the first Iranian to collaborate with Universal Music Group. He was given a 10-year prison sentence for encouraging prostitution. He was also charged with disseminating propaganda against the Islamic Republic and spreading obscene content. SC refuses immediate hearing as Tamil Nadu accuses Centre of withholding over Rs 2,150 crore in school funds
NEW DELHI: The Supreme Court has declined an urgent hearing request from the Tamil Nadu government regarding their plea against the central government. The state claims that Rs 2,151 crore in central education funds under the Samagra Shiksha Scheme for 2024-2025 is being withheld by the Centre. The state government sought immediate intervention from the Supreme Court in this matter on Monday. The dispute centers around the allocation and disbursement of funds meant for education initiatives in Tamil Nadu under the federal education scheme. A bench comprising Justices Prashant Kumar Mishra and Manmohan took note of the fact that the state government filed the petition in May alleging withholding of central funds for 2024 and this year also. "There is no urgency and it can be taken up after the 'partial working days' (the new name of summer vacation)," the bench said. In May, the Tamil Nadu government moved the top court against the Centre for allegedly withholding the funds. The top court, therefore, was urged to declare that the NEP and the PM SHRI Schools Scheme are not binding on the plaintiff state unless and until a formal agreement is entered into between the plaintiff and the defendant for their implementation within Tamil Nadu . The lawsuit has also sought a declaration that the action of the Centre to link Tamil Nadu's entitlement to receive funds under the Samagra Shiksha Scheme to the implementation of the NEP, 2020, and the PM SHRI Schools Scheme within the state are unconstitutional, illegal, arbitrary, unreasonable . It has also urged the top court to declare the Centre's letters of February 23, 2024 and March 07, 2024 as illegal, null, void ab initio and not binding on the state government. The plea sought a direction to the Centre to pay "Rs 2,291,30,24,769 (two thousand two hundred and ninety-one crore thirty lakhs twenty-four thousand seven hundred and sixty-nine) within a time frame to be fixed by this court" along with a future interest of 6 per cent per annum on the "principal sum of Rs 2,151,59,61,000 (two thousand one hundred and fifty-one crore fifty nine lakh and sixty one thousand) from May 1, 2025 until realisation of the decree". The dispute stems from the non-release of central funds under the Scheme, a flagship centrally sponsored programme for school education aimed at universalising quality education. The Project Approval Board (PAB) of the Ministry of Education had approved a total outlay of Rs 3,585.99 crore for Tamil Nadu for FY 2024 25, of which the Union Government's committed 60 per cent share amounted to Rs 2,151.59 crore. The plea said despite this approval, no instalments have been disbursed by the Centre as yet. The Centre, it said, unilaterally linked the release of these funds to Tamil Nadu's full implementation of NEP 2020 and the signing of an MoU for the PM SHRI Schools Scheme, conditions which were neither part of the original Samagra Shiksha Scheme nor agreed upon by the state. The reason for such non-disbursement is that the defendant has linked the release of Samagra Shiksha Scheme funds with the implementation of national education policy and NEP exemplary PM SHRI Schools' Scheme despite the fact that these policy/scheme are separate schemes, it said. Referring to the impact of non-release of Samagra Shiksha funds, the plea said paying salaries was crucial in maintaining competent and motivated teachers and supporting staff.
