SMRT Trains fined $240,000 over accident that killed technical officer

Rail operator SMRT Trains was fined $240,000 on May 5 over an accident at Bishan Depot in March 2020 that killed one of its technical officers.
The company was convicted of an offence under the Workplace Safety and Health Act, as it had failed to take reasonable measures to ensure its employees' safety at the depot in Bishan Road.
On March 23, 2020, Mr Muhammad Afiq Senawi, 30, and a colleague were using a hydraulic press machine (HPM) to replace some train-related components.
Mr Afiq had placed a component into the machine, and activated the piston to carry out the task.
However, he had failed to remove a similar older component. Due to a pressure build-up, a spacer rod that weighed nearly 3kg flew out of the machine, broke through the fencing gate near the machine, and struck his face.
Mr Afiq was rushed to Tan Tock Seng Hospital, where he died of face and chest injuries at 10.15am that day.
Coroner Christopher Goh later ruled his death to be an unfortunate misadventure.
Among other things, an investigation later revealed that SMRT Trains had failed to install a pressure gauge for the HPM after dismantling it for repairs.
On May 5, Ministry of Manpower prosecutor Kimberly Boo told the court that the spacer rod had not been secured to any other component, adding: "There was thus a hazard of the spacer rod displacing from its position and shooting out during operations."
She also said that a maintenance work record dated June 11, 2018, stated that the hydraulic pressure gauge was damaged.
As a result, there was no indication of the pressure of the HPM available when it was in operation.
The damage was reported to an engineering maintenance manager, who instructed for the gauge to be dismantled. However, he later overlooked its reinstallation.
Another work record dated Dec 16 that year stated that the pressure gauge was sent for calibration.
Court documents stated that the most recent maintenance of the HPM prior to the tragedy was carried out on Jan 2, 2020. The gauge was still not installed then.
Ms Boo said: "(SMRT Trains) had failed to ensure that a pressure gauge, which was a safety measure identified in the HPM operation manual, was installed for the HPM. Once the activating lever was pulled by the operator, the piston would continually move downwards to generate a downward push motion.
"Even though HPM operators were not required to monitor the exact pressure involved in the operation, the presence of a pressure gauge would provide an indication to operators on whether the force applied in any installation or removal had increased disproportionately."
SMRT Trains had also failed to limit the pressure setting of the HPM, which would reduce operators' exposure to a force far beyond what was necessary for its intended use, thus lowering the risks of harm the operators are exposed to.
SMRT Trains was charged in court in 2023.

SINGAPORE — A man who was on death row for drug trafficking has had his death sentence commuted to life imprisonment after succeeding in his petition for clemency, which is rarely granted. Tristan Tan Yi Rui, 33, was sentenced to death in February 2023 after he was found guilty of trafficking 337.6g of methamphetamine. His conviction and sentence were upheld by the Court of Appeal. In response to queries from The Straits Times on Friday (Aug 15), the Ministry of Home Affairs (MHA) said that on Aug 14, President Tharman Shanmugaratnam, on the advice of the Cabinet, granted a pardon to Tan. The statement said the Cabinet was advised that the sentence imposed on Tan was legally sound. "Nevertheless, a recommendation was made to grant clemency to him because of the specific facts and circumstances of the case," said MHA. The statement said Tan was arrested as part of a Central Narcotics Bureau (CNB) operation which involved the arrest of several other subjects. One of the other subjects arrested in the operation, who was tried separately on a capital charge, eventually received a non-capital sentence. "The Cabinet decided to advise the grant of clemency to Tan to reduce the disparity in their respective outcomes," the MHA said. The statement added: "Clemency is an exceptional power that is exercised as an act of executive grace." The Constitution provides that the President may, on the advice of the Cabinet, grant a pardon, reprieve or respite of the execution of the sentence, or remit the whole or any part of the sentence, penalty or forfeiture imposed by law. In cases involving death row prisoners, a sentence of death may be commuted to a sentence of imprisonment or fine or both, said MHA. The statement did not identify the subject who was given a non-capital sentence. Tan was arrested on Sept 27, 2018, by CNB officers in Tampines. He was behind the wheel of his car, a white Volkswagen, while another man was in the front passenger seat. The officers found 499g of a crystalline substance in a packet, which was analysed and found to contain not less than 337.6g of methamphetamine. The prosecution contended that Tan intended to traffic in the drugs. It relied on evidence showing that he had made arrangements with his drug supplier, known to him as "Hari", to take possession of the drugs. This included messages found on a mobile phone which involved negotiations with Hari regarding the sale and handover of the drugs. The defence argued that Tan did not know the nature of the drugs nor intended to traffic in them. Tan said the drugs were bought by members of Hari's group, and that he had merely been acting as a driver for the man who was tasked to collect the drugs. Tan testified that he was a regular drug user and that Hari sometimes gave him drugs for free in exchange for favours such as ferrying Hari's friends around in his car. He said the mobile phone was left in his car by one of Hari's friends. In convicting Tan, the High Court found that he was the sole user of the mobile phone, had actual knowledge of the nature of the drugs and had failed to rebut the presumption of possession for the purpose of trafficking. In imposing the mandatory death sentence, the judge said Tan's role was not limited to that of a courier. Moreover, the prosecution did not certify that he had substantively assisted the CNB in disrupting drug activities, which could allow him to be given a life sentence and caning instead of the death penalty. SINGAPORE – A police assistant superintendent, with a history of traffic offences including careless driving and speeding, drove a car after consuming alcohol in 2023 and it struck a motorcyclist. Instead of stopping to help the woman who suffered multiple fractures, Bernard Tan Bee Sen, 53, drove away but was caught in his home after Traffic Police (TP) officers tracked him down. A test on a breath analysing device at the TP headquarters showed he had 78 micrograms (mcg) of alcohol per 100 millilitres of breath, more than double the prescribed limit of 35 mcg of alcohol. On Aug 15, Tan, who has since been suspended from work, was sentenced to a year and two months' jail, and a fine of $6,000. He was also disqualified from holding or obtaining all classes of driving licences for a period of seven years from his release date. He had pleaded guilty to one count each of drink-driving, causing grievous hurt to the motorcyclist while driving without due care and attention, and failing to help her after the accident. He was driving along Bartley Road East towards Tampines Avenue 10 shortly before 11.50pm, when he lost control of the vehicle , which veered to the left and struck a concrete barrier. The car then swerved to the right and struck a motorcycle. The 28-year-old rider was flung off, and Tan drove away. A 29-year-old car driver saw the woman on the ground and Tan's car travelling about 50m ahead of the accident scene. The DPP said: 'The witness suspected that the car was involved in the accident. After ensuring that someone else was tending to the victim, the witness followed the car and took a picture of (it). 'The witness then returned to the accident scene and found a side mirror cover that matched the colour of the car. The witness subsequently made a police report.' The victim was conscious when an ambulance sent her to Changi General Hospital, where she was found with fractures to her left shoulder blade and multiple ribs. She was warded for 18 days and was later given 163 days of medical leave. The court heard that after the accident, TP officers went to Tan's home in the wee hours of Aug 19, 2023, and he failed a breathalyser test. He was brought to the TP headquarters for a second test, which showed his alcohol readings. On Aug 15, defence lawyer CK Teo told the court that Tan was remorseful. Mr Teo also said that his client intends to appeal against his sentence. Tan's bail has been set at $20,000.
