
Habitual Kuching druggie gets five years behind bars, two lashes
KUCHING (June 13): A 29-year-old habitual drug user was today sentenced by the Sessions Court here to five years in jail and two strokes of the rotan for amphetamine and methamphetamine abuse last year.
Judge Musli Ab Hamid convicted Ahmad Faizzirul Ahmad Suhardian Syah on his own guilty plea to an offence under Section 15(1)(a) of the Dangerous Drugs Act (DDA) 1952, which is punishable under Section 39C(1)(b) of the same Act.
Section 15(1)(a) of the DDA 1952 provides for a fine of up to RM5,000, or up to two years in prison, or both, while Section 39C (1)(b) of the same Act provides for up to seven years' jail and not more than three strokes of the cane upon conviction.
In passing the sentence, Musli also ordered Ahmad Faizzirul to undergo supervision for two years after serving his custodial sentence.
He committed the offence at the Kuching District Police Narcotics Crime Investigation Department on Jan 18, 2024, at around 6pm.
Ahmad Faizzirul has two previous convictions on Jan 4 and Jan 30, 2023 for the same offence framed under Section 15(1)(a) of the DDA 1952.

State JPJ director Zulkifly Ismail said the crackdown, dubbed Ops Luxury, targeted business owners and VIPs, including Datuks, since it began in June. 'The Rolls Royce was confiscated for two offences – expired road tax and without valid insurance,' he told a press conference at JPJ Seberang Jaya yesterday. Other vehicles seized included BMWs and Porsches, also found to be without valid licences. Action was taken under Section 23 of the Road Transport Act for road tax offences and under Section 90 for insurance-related offences. Zulkifly said the operation aimed to prevent national revenue losses and protect other road users. 'Some owners claimed they forgot but in several cases, the documents had expired for six months, a year and even up to two years. 'So the excuse is lame and no longer valid,' he said. Zulkifly also said JPJ would continue to carry out such operations from time to time and that stern action would be taken against those flouting regulations.

Cabbie jailed for injuring adopted daughter
SEREMBAN: A 46-year-old taxi driver was sentenced to three months' jail and fined RM10,000 after pleading guilty to using a belt to strangle his 14-year-old adopted daughter, causing injuries to her neck. The accused pleaded guilty to the charge in the Sessions Court here before judge N. Kanageswari. He committed the offence at about 2pm on Sept 15, 2024, at his rented house in Bandar Seremban Selatan. He was charged under Section 31(1)(a) of the Child Act 2001, which carries a jail term of up to 20 years, a fine of up to RM50,000 or both, upon conviction. In mitigation, defence lawyer Shah Wira Abdul Halim pleaded for leniency, saying the accused had saved the court's time by admitting guilt. 'A lengthy trial has been avoided with the accused, who is also a first-time offender, pleading guilty. He may have acted out of frustration as the victim ignored his advice to reduce excessive social media use,' he said. Shah Wira added that the accused, who suffers from a physical disability and earns about RM1,500 a month, is the sole provider for his ailing mother, wife and another nine-year-old adopted child. 'A lengthy custodial sentence would cause hardship to his mother, who relies heavily on him,' he said, adding that the accused was remorseful and wished to turn over a new leaf. Deputy public prosecutor Siti Khairiah Abdul Razak urged the court to impose a sentence reflecting the seriousness of the crime. 'In such cases, public interest must take precedence over personal interest. As a guardian, the accused should never have injured the child, even in the name of discipline,' she said. Kanageswari also ordered the accused to serve an additional six months in jail if he failed to pay the fine. He was further ordered to enter into a RM3,000 good behaviour bond for one year and to complete 36 hours of community service within six months.

Wireman charged with beating stepsons with pipe
SEREMBAN: A 44-year-old wireman claimed trial in the Sessions Court here to three charges of intentionally causing physical harm to his three stepsons with a weapon. The accused pleaded not guilty after the charges were read to him separately before judges Surita Budin and N. Kanageswari. He was charged with using a PVC pipe to cause injury to the boys aged 19, 16 and 15. The offence is said to have taken place on Aug 15 at their house. He was charged under Section 324 of the Penal Code for voluntarily causing hurt by dangerous weapons or means, read together with Section 326A. The offence carries a jail term of up to 10 years, or a fine, or whipping upon conviction. Section 326A provides for a prison term twice as long as the maximum term under Section 324. Deputy public prosecutor Norazihah Asmuni told Surita that her team was not offering bail to the accused as he may disturb the boys, who lived in the same house. The victims, she claimed, had suffered soft tissue injuries after being allegedly hit by the accused. If the court were to allow bail, she said her team was proposing RM50,000 for each charge. The accused, in pleading for a lower bail, said he had no choice but to discipline the alleged victims as the older boys had a habit of vaping despite being told not to do so. He said he had been providing for them for the past three years. Surita then set bail at RM18,000 for two of the charges in one surety each and fixed Sept 24 for remention. She also ordered the accused not to live in the same house with them and to report at the nearest police station once a month till the case is disposed of, as well as to surrender his passport to the court. Kanageswari allowed the accused bail of RM15,000 with one surety for the third charge and ordered him to stay away from the alleged victims and witnesses. Earlier, deputy public prosecutor Siti Khairiah Abdul Razak proposed bail at RM20,000 after informing the court that the full medical report of the alleged assault was not ready. The accused, who was unrepresented, had also pleaded for a lower bail as he did not have an income at present and was a person with special needs as he could not bend his left leg following an accident. Kanageswari fixed Sept 29 for remention. The 39-year-old mother of the alleged victims was also charged before Kanageswari with causing hurt to her 16-year-old son with a knife at the same place and time. She claimed trial to the charge. The court fixed bail at RM15,000 in one surety and ordered her to adhere to the same conditions set for the first accused.
