Teenager charged with murdering mother, brother and injuring younger brother

MELAKA: A 17-year-old boy is accused of killing his mother and biological elder brother, besides injuring his younger brother at the Ayer Keroh Magistrate's Court here today.
For the first and second charges, the teenager is accused of causing the death of his 51-year-old mother and 21-year-old biological brother at No 7, Jalan RM3, Taman Rambai Mutiara, in the Melaka Tengah district between 5 and 5.30 am on June 12.
He is charged under Section 302 of the Penal Code for murder which provides for the death penalty or imprisonment for not less than 30 years but not more than 40 years, and if not sentenced to death, can be whipped not less than 12 strokes.
No plea was recorded from the accused when the charge was read out in Mandarin by the court interpreter as the murder charge falls under the jurisdiction of the High Court.
Meanwhile, for the third charge, the accused is charged with intentionally causing grievous bodily harm to his 13-year-old younger brother by using a folding knife at the same location on the same date and time.
He is charged under Section 326 of the Penal Code for causing grievous bodily harm which provides for a maximum prison sentence of 20 years and a fine or whipping.
The teenager, however, pleaded not guilty to the charge.
The prosecution was conducted by deputy public prosecutor Farah Nabihah Sofian while the accused was represented by lawyer Cassian Anthony, with no bail offered for all three charges.
Magistrate Uthman Abd Ghani set July 24 for the case to be mentioned again.
On June 12, the media reported that a female teacher and her eldest child died while her youngest child was seriously injured, believed to have been stabbed by a teenage boy who was also the victim's second child at their home.
The incident is believed to have occurred at around 5 am and the single mother and her son were found lying in a pool of blood in the living room.
Police arrested the suspect who was found outside the house in a daze at the time and the weapon, a 20 cm folding knife with blood stains, believed to have been used in the incident, was found kept in a school bag outside the house.

Muniandy will rule on whether to grant a discharge not amounting to an acquittal (DNAA) or allow the trial to proceed in full against the former prime minister over the charges, which relate to funds allegedly channelled into his personal bank account in 2014. A DNAA means the accused is released from the charges without being formally acquitted, leaving the door open for future prosecution for the same offences. The hearing is scheduled to begin at 9am. Najib's lawyer, Tan Sri Muhammad Shafee Abdullah, had recently requested the court to grant a DNAA due to the prolonged uncertainty surrounding the case. This follows the Attorney-General's Chambers' decision to reject Najib's representation letter seeking to have the charges, filed in 2019, dropped. At the last hearing, deputy public prosecutor Mohd Ashrof Adrin Kamarul informed the court that while the prosecution was prepared to proceed with a full trial, more time was needed to organise documents related to the case. However, Shafee argued that granting a DNAA would be the most appropriate course of action for now, allowing the prosecution to resume proceedings once all documents are in order and it is fully prepared to move forward. Najib was charged on Feb 3, 2019 with three counts of money laundering involving RM27 million, allegedly received through three AmPrivate Banking accounts at AmIslamic Bank Berhad, AmBank Group Building, Jalan Raja Chulan, on July 8, 2014. He was charged under Section 4(1)(a) of the Anti-Money Laundering and Anti-Terrorism Financing Act 2001, which carries a maximum fine of RM5 million, imprisonment for up to five years, or both upon conviction. The former Umno president is currently serving a prison sentence in Kajang for misappropriating RM42 million in SRC International funds. He filed a petition for a royal pardon on Sept 2, 2022. On Jan 29 this year, the Pardons Board reduced his sentence from 12 years to six and lowered his fine from RM210 million to RM50 million.

KOTA KINABALU (June 19): A 36-year-old man escaped the gallows after the Court of Appeal here on Thursday substituted his death sentence with 35 years' imprisonment and 12 strokes of the cane for the murder of a teenage girl in Semporna seven years ago. A panel of three judges — Datuk Azman Abdullah, Datuk Azhahari Kamal Ramli and Datuk Noorin Badaruddin — unanimously dismissed Alkadzman Maksidi's appeal against the Tawau High Court's decision. Alkadzman was ordered to serve the jail term from the date of his arrest on November 29, 2018. On November 23, 2022, he was sentenced to death by the Tawau High Court after being found guilty of murdering a14-year-old girl in an orchard in Semporna on November 29, 2018. He was charged under Section 302 of the Penal Code. Following amendments to the section, courts may impose a prison term of not less than 30 years and not exceeding 40 years, along with a mandatory minimum of 12 strokes of the cane, if the death sentence is not applied. Alkadzman was represented by counsel Mervyn @ Hasan Sainy.

Justice Dato' Hj Azman Abdullah, who sat with Justices Datuk Azhahari Kamal Ramli and Datuk Noorin Badaruddin, unanimously set aside Anthony Chan Wei Onn's death sentence for drug trafficking and substituted it with a conviction for drug possession. The court held that the original conviction under Section 39B(1)(a) of the Dangerous Drugs Act 1952 was unsafe. 'But we find evidence to support a conviction under Section 39A(2). Therefore, the conviction under Section 39B(1)(a) is set aside and substituted with Section 39A(2),' the panel ruled. Chan, 31, was ordered to serve his sentence from the date of his arrest on July 12, 2019. On May 23, 2023, he had been sentenced to death by the High Court here after being found guilty of trafficking 2,129.1 grams of syabu at a premises along Jalan Lintas on July 12, 2019. Previously, Chan was charged under Section 39B(1)(a) of the Dangerous Drugs Act 1952, which carries the mandatory death penalty or, if not sentenced to death, life imprisonment and not less than 15 strokes of the cane upon conviction. He was represented by counsel Hamid Ismail.
