BDO suspended for sharing resignation letter alleging harassment during electoral roll revision

PATNA: The axe has finally fallen on a Block Development Officer (BDO) for sharing his resignation letter on social media, in which he accused his immediate senior of harassment during the ongoing Special Intensive Revision (SIR) of electoral rolls.
Hari Om Sharan, who serves as the BDO of Barsoi block in Katihar district, has been suspended with immediate effect. Departmental proceedings have also been recommended against him.
Confirming the disciplinary action, Katihar District Magistrate Manesh Kumar Meena said on Wednesday that BDO Hari Om Sharan's reply to the show-cause notice served on him earlier was found unsatisfactory. 'Hence, he has been put under suspension,' he added.
District Magistrate Meena said that the BDO would also face departmental proceedings for posting his personal grievances against his senior on social media platforms. The DM clarified that Sharan had never formally submitted his resignation letter to the office.
Meena further stated that it came to his notice that the BDO assumed duty after tendering an apology for his misconduct towards his senior, Dixit Shwetam, who is posted as Sub-Divisional Officer (SDO). 'The action has been taken for conduct unbecoming of a public servant,' he said.
The BDO had submitted a five-page resignation letter addressed to District Magistrate Manesh Kumar Meena, alleging harassment by the SDO Dixit Shwetam during the SIR work under his jurisdiction.
Sharan claimed that he was touring 10-12 panchayats every day for the SIR work, even while suffering from backache, and also inspected digitisation camps and carried out other related tasks.

New Delhi: There will be no discussion on Bihar voter list revision in Parliament despite the Opposition's demand, the government has indicated, underscoring a reason cited by former Speaker Balaram Jakhar, sources have said. The Opposition, which has been sticking to its demand for a discussion on Bihar's SIR, had raised the issue again today, and the row had delayed the discussion on Operation Sindoor. The Opposition wanted a concrete assurance from the government that it would discuss the Special Intensive Revision of Bihar's electoral rolls immediately after the special discussion on Operation Sindoor ends. At the time, the government had accused the Opposition of cheating. Later, at 2 pm, Parliamentary Affairs Minister Kiren Rijiju said if the rules allow and the Speaker is ready and it is decided in the Business Advisory Committee, the government was ready to discuss any topic. Because the government did not directly say it would discuss the issue of Bihar SIR, or refuse it, the Opposition found the assurance sufficient and the discussion on Operation Sindoor started in the Lok Sabha. Government sources, however, made it clear that the voter list revision -- being run by the Election Commission in Bihar -- cannot be discussed in Parliament. About this, three arguments are being considered by the government, sources said. The first is that the campaign being run by the Central Election Commission is not an election reform. Rather, it is an administrative step and the Election Commission has been taking such steps from time to time. The second reason is that even if a discussion is held in both the houses of Parliament on the intensive revision of the voter list, there is no one to answer the questions that the Opposition could raise. The Election Commission cannot come to the House to present its side, sources pointed out. And although the Law Ministry is the nodal ministry for the Election Commission, it generally looks after only administrative work, and does not interfere in policy matters. The third reason the government gave is that there are many such institutions which do not have a mechanism to present their side before the Parliament. In such situations, there cannot be a discussion about those institutions, sources said. Government sources recounted an earlier instance when there had been a demand to discuss the functioning of the Election Commission. In 1986, then Speaker Balram Jakhar had said comprehensive election reforms can be discussed in Parliament, but it is not possible to discuss administrative processes and decisions. The government is now of the view that the Bihar voter list revision cannot be discussed due to these reasons. The Opposition, however, is very aggressive on this issue and wait is on for the government's formal arguments.

The Supreme Court on Monday asked the Election Commission of India (ECI) to focus on "en masse inclusion" instead of "en masse exclusion" in the ongoing Special Intensive Revision (SIR) of electoral rolls in Bihar. The top court again asked the poll body to reconsider including Aadhaar and Election Photo Identity Card (EPIC) as admissible documents in the list of acceptable documents to prove identity of voters in the revision of electoral rolls. A division bench comprising Justices Surya Kant and Joymalya Bagchi, however, refused to stop the ECI from publishing the draft electoral rolls for Bihar on August 1 as per the schedule notified for SIR. Speaking for the bench, Justice Kant verbally remarked that "it is only a draft exercise". He added "it does not take away our power" to quash the entire roll if found erroneous in future. "Trust us... as soon as we know anything is wrong, we will quash everything," Justice Kant added, saying that the "interpretation" needs to be decided. Speaking on the exclusion of Aadhaar and EPIC, the senior SC judge orally observed that "any document on this earth can be forged. Tomorrow, you may see that not only Aadhaar but out of eleven (list of acceptable documents), other documents can also be forged. That is a separate issue. We will deal with it on a case to case basis." Urging the ECI to include the two cards in the list of acceptable documents, Justice Kant added: "Aadhaar and EPIC have a presumption of correctness." Questioning the counsel for ECI on exclusion of Aadhaar and voter cards, Justice Bagchi weighed in, saying, "You say none of the documents are conclusive as per SIR notification... suppose someone uploads the form with Aadhaar, why will you not include it in the draft?" The counsel for ECI contended that there are large scale issues with ration cards. He also said that EPICs also cannot be conclusive. The bench, however, questioned the poll body's stand. Live Events The SC adjourned the matter on account of paucity of time. The top court asked the counsels for the petitioners and ECI to give a timeline of their submissions following which the court will post the matter for final adjudication. At the last hearing earlier this month, the SC had refused to stay the SIR of electoral rolls being undertaken in Bihar. Referring to the ECI, the top court had said it "cannot stop a constitutional body" from conducting a "democratic process" and that it "will not second guess" the ECI.
