New formula for N.Y. State education aid turns out to be bad news for NYC

A revised formula doling out $26.4 billion to New York school districts that public education advocates had been lobbying for will, as it turns out, deliver hundreds of millions less to New York City than had the old formula remained intact.
The new plan, passed Thursday by state lawmakers, was supposed to be a welcome development, as the past two schools chancellors and their backers had long been pushing for reforms to the state's per-pupil funding, known as Foundation Aid. But in a twist, the deal reached between Gov. Hochul and the Legislature will leave a gaping hole between what the city expected and what it ultimately receives.
An earlier estimate projected the difference at about $350 million. All in all, though, the budget agreement still results in an overall Foundation Aid increase of about 5% for the city's public schools, according to the governor's office.
'While an overhaul of the outdated formula is sorely needed, the limited changes make matters worse — shortchanging NYC students as a result,' Kim Sweet, executive director of Advocates for Children, said in a statement.
The budget bill updated the formula's poverty weight by replacing decades-old census data with a new metric known as Small Area Income and Poverty Estimates, or 'SAIPE.' It also substitutes school lunch eligibility with a broader category of 'economically disadvantaged' students.
'We're not using the old data that was used before because it was leading to unfair outcomes,' Hochul said at a media gathering earlier this week. 'We're going to be using the most up-to-date poverty estimates. That'll be the major change.'
Both changes were first proposed by the governor in January. But the Adams administration warned of the $350 million gap, in part because the federal guidelines for poverty do not account for the local cost of living.
City Hall and the Education Department did not return a request for comment on Thursday afternoon.
'I'm not going to argue for the old way of counting [poverty], because it was based on the 2000 census. So yes, we should do away with relying on data from the 2000 census,' said Michael Rebell, executive director of the Center for Educational Equity at Columbia University Teachers College, who was an attorney in the landmark school funding lawsuit that prompted the Foundation Aid formula.
Rebell added that an index that better accounts for the regional costs in New York City could have helped offset the difference. But ultimately, lawmakers only updated the measure for Westchester County.
'That's why I say do the whole formula. You don't do it piecemeal,' Rebell said.
The plan also expands the weight for students learning the English language, restoring an estimated $30 million — though that is far short of the $350 million and a recent proposal by the Assembly, according to estimates by Advocates for Children.
'You're going to have people who see the glass as half full and as half empty. On the one hand, it's a significant amount less than what New York City schools would've received under the old Foundation Aid,' said Sen. John Liu (D-Queens), chairman of the Education Committee. 'On the other hand, it is about $540 million more than last year.'
Asked which camp he falls in, Liu said: 'I'm happy that we were able to get a substantial amount more money for New York City public schools.'
Rebell and Liu both agree that more changes are needed. Rebell is working on a new funding formula, while Liu is pushing for further reforms: 'We all understood that the Foundation Aid formula, which is almost 20 years old, at this point requires updates and possible overhauls. I think the executive budget and enacted budget did not go far enough in truly updating the formula,' the senator said.
Apart from Foundation Aid, the budget also finalized changes to the educational standards for religious schools, such as yeshivas, including pushing back the timeline of real consequences for not providing basic instruction in subjects such as reading and math.
It also signed into law a new school cell phone ban, with a $13.5 million state investment to assist with implementation.

The Port of NEOM has received Saudi Arabia's first fully automated, remote-controlled cranes, marking a key step in boosting Red Sea trade, automation, and tech-driven job creation, the company announced this week on LinkedIn. The Red Sea corridor is a major shipping route linking Asia via the Indian Ocean, to Europe and Africa via the Suez Canal. Oxagon's proximity to the canal, which facilitates almost 12% of global trade, provides it with a strategic edge, according to Blackridge Research & Consulting, an Indian-based specialized market research firm. The port is part of an envisioned cutting-edge industrial city which will fully rely on renewable energy and aims to host some 90,000 inhabitants by 2030, according to the government's vision. Saudi Arabia's Crown Prince Mohammed bin Salman had announced the establishment of Oxagon in 2021. "It will contribute to Saudi Arabia's regional trade and commerce, and support creating a new focal point for global trade flows," Al-Arabiya's English website quoted him as saying. Neom's Green Hydrogen Company (NGHC) is developing the world's largest green hydrogen facility-a $8.4 billion project- at Oxagon. Melissa Blake, Port Director at Neom wrote on Linkedin: "Port of Neom is excited to receive the first batch of cranes and other cargo handling equipment as we come another step closer to delivering our vision." Saudi Arabia's Government Vision 2030's website: "Sitting at the crossroads of 3 continents, Oxagon is a place where people, nature and technology come together in harmony." Vishal Wanchoo, CEO of Oxagon said in May: "Industrial development cannot continue at the expense of people or the environment. We're offering a compact, mixed-use city where industry, nature, and community coexist." The port is planned to act as the main trade gateway to northwestern Saudi Arabia, with a smart logistics hub, connects Asia, Europe, and Africa. Trump's war against DEI isn't going so well in Virginia

Apparently when President Trump says 'illegal DEI,' he means lawful and common-sense efforts to integrate public schools. At least, that's the takeaway from the Department of Education's new investigation against Fairfax County Public Schools. Trump officials claim Fairfax County violated federal law when it adopted an admissions policy designed to 'change the demographic make up' of its most competitive high school. This theory, which equates integration with segregation, dates back to Barry Goldwater, who remarked in 1964 that 'the Constitution is color-blind … and so it is just as wrong to compel children to attend certain schools for the sake of so-called integration as for the sake of segregation.' It seems Trump agrees. Unfortunately for him, the Supreme Court does not. Just last year, the court declined to overturn a ruling for Fairfax County. As I explained at the time, that decision made sense. Even as the Supreme Court has shifted hard right, decades of conservative case law — including from Chief Justice John Roberts — condone racial goals such as diversity, equality and inclusion. The new investigation tracks Trump's disregard for courts and his tendency toward bluster over substance. But in important respects, it also exposes that Trump's war on DEI lacks any moral and legal basis. Some context is helpful. For decades, Black advocates sought to desegregate Thomas Jefferson High School, one of the nation's top-ranked public schools. As recently as 2012, the NAACP filed a civil rights complaint alleging that the school's admissions policies discriminated against African American and Hispanic students and students with disabilities. Things shifted in 2020. As racial justice protests erupted across the globe, local leaders grappled with the fact that in a county with roughly 100,000 Black residents, Thomas Jefferson High School admitted so few Black students that the number was too small to report. The state convened a task force to examine the causes of this ongoing exclusion at Thomas Jefferson and other Virginia schools. Following a series of hearings, the board revised the school's admissions process, eliminating a $100 application fee and a standardized testing requirement. Contrary to ongoing claims that the new policy compromised 'merit,' the board raised the minimum GPA for admission from 3.0 to 3.5 and added an honors course requirement. The new policy also implemented a holistic evaluation that included new 'experience factors,' such as whether the applicant qualified for reduced meals or is an English language learner. The updated process also ensured that each middle school receive a number of seats equal to 1.5 percent of its eighth-grade class. The school board resolved that '[t]he admission process must use only race-neutral methods that do not seek to achieve any specific racial or ethnic mix, balance or targets.' This means that admissions officials are not told the race, ethnicity, sex or name of any applicant. In Supreme Court parlance, the entire admissions process was 'colorblind.' The new process produced promising results. In its inaugural year, Thomas Jefferson High School received 1,000 more applicants than the prior cycle. This larger applicant pool also 'included markedly more low-income students, English-language learners, and girls than had prior classes at TJ.' Consistent with the heightened GPA requirement, the admitted class's mean GPA was higher than in the five preceding years. The new process also yielded greater racial diversity. Black students comprised 10 percent of the applicant pool and received nearly 8 percent of offers and Hispanic students comprised 11 percent of the applicant pool and received over 11 percent of offers. The overall percentage of Asian American students decreased from the preceding year, but Asian Americans continued to enjoy the highest percentage yield of all racial groups. And as the Fourth Circuit detailed, Asian American students from historically underrepresented middle schools 'saw a sixfold increase in offers, and the number of low-income Asian American admittees to TJ increased to 51 — from a mere one in 2020.' In short, Thomas Jefferson High School adopted a 'race-neutral' process to pursue a set of goals that included increasing Black and Hispanic representation. This is the precise type of practice the Trump administration denigrates as 'illegal DEI.' Efforts to promote racial diversity do constitute DEI. But they are far from illegal. In fact, Students for Fair Admissions v. Harvard — the 2023 decision striking down Harvard University's formal consideration of applicant race — supports most of the DEI policies Trump now targets. Writing for the majority, Chief Justice Roberts deemed Harvard's underlying goals as 'worthy' and 'commendable.' Justice Brett Kavanaugh made the point more directly; writing for himself, Kavanaugh noted that 'racial discrimination still occurs and the effects of past racial discrimination still persist' and that 'universities still can, of course, act to undo the effects of past discrimination in many permissible ways that do not involve classification by race.' The actions of the high school square with Kavanaugh's call for policies that attend to race but do not differentiate between individual students on this basis. This should short-circuit the Department of Education's investigation against Fairfax County. But it is unlikely to stall Trump's desire to outlaw integration. The Pacific Legal Foundation, which initiated the lawsuit against Fairfax County and remains a force on the right, wants to revive Goldwater's hostile approach to integration. Consider the following FAQ on Pacific Legal's website: 'schools may use or not use standardized tests, essays, interviews, or auditions, as long as their reasons for using or not using them are not racial.' By this logic, a high school could lawfully eliminate an admissions fee if motivated by public relations concerns, but it would be unlawful to take that same action if done to decrease racial barriers that exclude low-income Black and Hispanic students. Now consider higher education. Per Pacific Legal, Harvard University could eliminate admissions preferences for the children of alumni and wealthy donors if done to appease alumni pressure. But it would be unlawful for Harvard to take the same action if the goal is increasing the number of Asian American students or mitigate unearned racial preferences that flow to wealthy white applicants. The upshot is that affirmative efforts to reduce racial inequality — everything Trump dubs 'illegal DEI' — remain legal and morally just. So, at least for now, integration does not equate to segregation. Jonathan Feingold is an associate professor at Boston University School of Law. Authorities in the second-largest city in Kyrgyzstan, Osh, have removed a towering statue of Vladimir Lenin thought to be the tallest of the revolutionary Soviet leader in Central Asia. The 23-meter (75-foot) monument was erected in 1975 when Kyrgyzstan was part of the Soviet Union. Photos appeared online Saturday showing the statue flat on the ground after being lowered by a crane. While many countries formerly part of the Soviet Union have moved to downplay their ties to Russia as part of efforts to reshape national identity, the monument was taken down with little public fanfare and officials in Osh framed the removal as routine city planning. In a statement, Osh City Hall called the move 'common practice' aimed at improving the 'architectural and aesthetic appearance' of the area. Officials also noted that Lenin monuments have been 'dismantled or moved to other places' in Russian cities including St Petersburg and Belgorod, and said that the issue 'should not be politicized.' The monument, they said, will be replaced by a flagpole, as was the case when a different Lenin statue was relocated in the capital, Bishkek. The move came a week after Kyrgyzstan's ally Russia unveiled a monument to brutal Soviet dictator Joseph Stalin at one of Moscow's busiest subway stations.
