U.S. Department of Education investigates UW over admittance of KKG transgender member
CHEYENNE – The University of Wyoming is under investigation by the U.S. Department of Education's Office for Civil Rights over the admittance of a transgender sorority sister at Kappa Kappa Gamma in 2022, according to a Monday news release. The U.S. Department of Education declared June as 'Title IX Month' on Monday, in recognition of the 53rd anniversary of the Title IX of the Education Amendments of 1972. 'June will now be dedicated to commemorating women and celebrating their struggle for, and achievement of, equal educational opportunity,' states U.S. Department of Education news release. In light of this recognition, the department's Office for Civil Rights (OCR) launched investigations into UW and Jefferson County Public Schools in Colorado. The latter is currently being sued by Alliance Defending Freedom, a conservative legal advocacy group, over a policy implemented by JeffCo that assigns overnight school trip sleeping arrangements based on gender identity, not biological sex, according to Denver7. 'The Department is recognizing June as 'Title IX Month' to honor women's hard-earned civil rights and demonstrate the Trump Administration's unwavering commitment to restoring them to the fullest extent of the law,' U.S. Secretary of Education Linda McMahon said in the news release. 'This Administration will fight on every front to protect women's and girls' sports, intimate spaces, dormitories and living quarters, and fraternal and panhellenic organizations.' The former grabbed nationwide attention after six sorority sisters launched a federal lawsuit against their parent organization over the admittance of its first transgender sorority member, Artemis Langford. In response to the federal investigation, the university stated it 'doesn't control decisions about sorority and fraternity membership,' a UW spokesperson told the Wyoming Tribune Eagle in an emailed statement. 'Appropriately, the university has not been a participant in litigation in federal court regarding the legality of the sorority's decision to admit the transgender student,' UW spokesperson Chad Baldwin said in an email. 'The Office for Civil Rights' initiation of an investigation is not itself evidence of a violation of federal civil rights laws and regulations.' Baldwin referred to University Regulation 11-4, which states that the university 'does not control or accept responsibility for the activities nor endorse the programs of student organizations,' including sororities and fraternities. The university maintains it has been and is in compliance with Title IX, but will fully comply with the federal investigation. The Independent Women's Forum, a right-wing policy group, supported the move by the federal education department in a Monday news release. Its affiliate, the Independent Women's Law Center, involved one of its lead attorneys, May Mailman, in the original lawsuit field by the sorority sisters. "Women deserve single-sex spaces where their privacy and safety are respected, and universities must be held accountable when those protections are compromised," stated Beth Parlato, senior legal advisor for IWLC, in the news release. "This investigation is a necessary step to ensure that federal policies meant to protect women are being properly enforced and not undermined in the name of political ideology." The lawsuit In 2023, six sorority sisters filed a lawsuit against KKG for admitting a transgender sorority member. The lawsuit was dismissed without prejudice in August 2023 by U.S. District Court Judge Alan B. Johnson. Johnson gave the sorority sisters an option to amend their complaint and refile the lawsuit. Instead, the plaintiffs appealed their lawsuit in the 10th Circuit U.S. Court of Appeals. Last June, Judge Carolyn B. McHugh found the case was not appealable without a final order from Johnson. She gave the plaintiffs two options: stand on their existing complaint and seek a final decision from the Wyoming judge, or amend their complaint and continue their case at the federal district court level. It's been nearly a year since the sorority sisters' appealed case was dismissed by the 10th Circuit. In early May, Johnson gave the appellants 30 days to submit their amended complaint, or have the case dismissed permanently. The sorority sisters have until June 9 to submit their amended complaint.

Trump shows that loyalty is all that matters to him
Last week, the Court of International Trade delivered a blow to Donald Trump's global trade war. It found that the worldwide tariffs Trump unveiled on 'Liberation Day' as well his earlier tariffs pretextually aimed at stopping fentanyl coming in from Mexico and Canada (as if) were beyond his authority. The three-judge panel was surely right about the Liberation Day tariffs and probably right about the fentanyl tariffs, but there's a better case that, while bad policy, the fentanyl tariffs were not unlawful. Please forgive a lengthy excerpt of Trump's response on Truth Social, but it speaks volumes: 'How is it possible for [the CIT judges] to have potentially done such damage to the United States of America? Is it purely a hatred of 'TRUMP?' What other reason could it be? I was new to Washington, and it was suggested that I use The Federalist Society as a recommending source on Judges. I did so, openly and freely, but then realized that they were under the thumb of a real 'sleazebag' named Leonard Leo, a bad person who, in his own way, probably hates America, and obviously has his own separate ambitions. … In any event, Leo left The Federalist Society to do his own 'thing.' I am so disappointed in The Federalist Society because of the bad advice they gave me on numerous Judicial Nominations. This is something that cannot be forgotten!' Let's begin with the fact that Trump cannot conceive of a good explanation for an inconvenient court ruling other than Trump Derangement Syndrome. It's irrelevant that the International Emergency Economic Powers Act, the 1977 law the administration invoked to impose the relevant tariffs, does not even mention the word 'tariff' or that Congress never envisioned the IEEPA as a tool for launching a trade war with every nation in the world, the 'Penguin Islands' included. Also disregard the fact that the decision was unanimous and only one of the three judges was appointed by Trump (the other two were Reagan and Obama appointees). (The decision has been paused by an appeals court.) Trump is the foremost practitioner of what I call Critical Trump Theory — anything bad for Trump is unfair, illegitimate and proof that sinister forces are rigging the system against him. No wonder then that Trump thinks Leonard Leo, formerly a guiding light at the Federalist Society, the premier conservative legal organization, is a 'sleazebag' and 'bad person.' Note: Leo is neither of those things. But Trump's broadsides at Leo and the Federalist Society are portentous. Because Congress is AWOL, refusing to take the lead on trade (and many other things) as the Constitution envisions, it's fallen to the courts to restrain Trump's multifront efforts to exceed his authority. That's why the White House is cynically denouncing 'unelected' and 'rogue' judges on an almost daily basis and why Trump's political henchman, Stephen Miller, is incessantly ranting about a 'judicial coup.' The supreme, and sometimes seemingly sole, qualification for appointments to the Trump administration has been servile loyalty to Trump. But that ethos is not reserved for the executive branch. Law firms, elite universities and media outlets are being forced to kneel before the president. Why should judges be any different? Trump has a history of suggesting 'my judges' — i.e., his appointees — should be loyal to him. That's why he recently nominated Emil Bove, his former personal criminal lawyer turned political enforcer at the Department of Justice, for a federal judgeship. The significance of Trump's attack on the Federalist Society and Leo, for conservatives, cannot be exaggerated. The legal movement spearheaded by the Federalist Society has been the most successful domestic conservative project of the last century. Scholarly, civic-minded and principled, the Federalist Society spent decades developing ideas and arguments for re-centering the Constitution in American law. But now Trump has issued a fatwah that it, too, must bend the knee and its principles to the needs of one man. The law be damned, ruling against Trump is ingratitude in his mind. Speaking of ingratitude, the irony is that the Federalist Society deserves a lot of credit — or blame — for Trump being elected in the first place. In 2016, the death of Antonin Scalia left a vacancy on the Supreme Court. Many conservatives did not trust Trump to replace him. To reassure them, Trump agreed to pick from a list of potential replacements crafted by the Heritage Foundation and Federalist Society. That decision arguably convinced many reluctant conservatives to vote for him. In the decade since, the Heritage Foundation has dutifully reinvented itself in Trump's image. The Federalist Society stayed loyal to its principles, and that's why the Federalist Society is in Trump's crosshairs. @JonahDispatch

Ukraine Deliberately Blindsided Trump Before Massive Drone Attack on Russia
President Donald Trump was deliberately left in the dark about Ukraine's unprecedented drone strike in Russia on Sunday, which destroyed nearly a third of the Kremlin's strategic bomber fleet in a surprise attack. The large-scale drone attack saw a fleet of drones scattered all across Russia carry out simultaneous attacks on five airbases, wiping out 40 irreplaceable military bombers worth an estimated $7 billion, which have been used to reign terror upon Ukrainian civilians. 'Operation Spider-Web' took over 18 months to plan and was personally overseen by Ukrainian President Volodymyr Zelensky, a source told CBS News. Drones were smuggled deep into Russia in wooden crates on the back of trucks, which were later opened remotely, allowing the drones to take off. Among the targets hit was the Belaya air base in Russia's far-east Irkutsk region, located more than 2,500 miles away from Ukraine. During his evening address on Sunday, Zelensky said 117 drones had been deployed in the attack, and that Ukraine's base of operations in Russia had even been located next to a branch of the FSB, Russia's intelligence agency. The White House however has declined to comment on the attack—with an administration source confirming to NewsNation on Sunday that Trump was not informed about the operation before it had taken place. While no official reason has been given for the snub, it comes just months after the U.S. announced it would stop sharing military intelligence with Ukraine unless progress was made on peace talks. Trump's longtime fondness for Vladimir Putin and public dislike of Zelensky is also likely a key factor in Kyiv's reluctance to share information with the President. Following the strike, Secretary of State Marco Rubio spoke with Russian Foreign Minister Sergey Lavrov to reiterate Trump's call for peace between the two nations, Axios reported on Sunday. Both Russian and Ukrainian officials will meet in Istanbul on Monday to engage in peace talks. 'We are doing everything to protect our independence, our state, and our people,' Zelensky wrote in a post on X. 'I outlined the tasks for the near term and also defined our positions ahead of the meeting in Istanbul on Monday.' The Ukrainian president said his priorities included 'a complete and unconditional ceasefire' and the return of abducted prisoners and children. Operation Spider-Web follows a similarly huge drone strike from Russia on Sunday night, in which the Kremlin launched 472 drones and seven missiles at Ukrainian military bases and infrastructure—the biggest drone attack in the war to date. 12 military personnel were killed in the attack and 60 more injured.
