Himachal Pradesh high court (HC) refused to allow enrolment of a man as a lawyer after finding that he had secured admission for three-year LLB course before completing his graduation. 'No LLB without graduation' HC court denies enrolment to man
A law graduate, Inderpal Singh, had challenged the order of a single bench of HC refusing his enrolment as an advocate.
The division bench held that as per the Advocates Act and Rules of Legal Education of 2008, a person can be admitted to the three-year LL.B course only after passing the bachelor's degree. '....thus, the prescribed standards, cannot be permitted to be eased out or diluted, just to enable the appellant-writ petitioner to seek ratification or to undo his known and admitted wrongs or inactions…', the court in its order dated July 24, order made available now.
'Permitting or granting leverage either to the candidates and/or to the institutes to resort to admissions of ineligibles dehors the established and applicable norms, shall be an illegality, which shall adversely affect the standards of education and bring inefficiency in legal profession,' the order further read.
Singh told the court that he failed to clear a paper in the final year of his undergraduate studies in 2014 and was made to reappear for the exam the next year. However, in June 2014, before clearing the failed exam, he secured admission for the three-year law course.
He gave an undertaking to the college that if he fails to complete his graduation, the provisional admission may be revoked. The college accepted the undertaking. Singh cleared the paper in July 27, 2015, and the LLB course in November 2017. However, the Bar Council of Himachal Pradesh refused to enrol him stating that he had secured admission to law college before completing his graduation, and this was in violation of the law. Even the single bench of high court had rejected Singh's plea in July last year, upholding the Bar Council's stand.
'Diluting or easing out prescribed mandates, relating to eligibility for admission to a course shall lead to educational chaos, which shall result in disturbing the entire education system, except in eventualities, when, the same is expressly permitted under the Statute or Rules' added the judgment.
The order further read, 'Non-fulfilment of eligibility conditions prescribed in norms, governing admission to a course of study is an illegality and ignorance of law is no excuse and the appellant -writ petitioner (Inderpal) has neither any locus nor any right to seek rectification of an illegality in admission to LLB Course made dehors the norms, and this inherent ineligibility has resulted in rendering the appellant-writ petitioner ineligible for enrolment as an advocate in terms of the Statute and Rules.'

HC refuses to pass order on rally near state secretariat on first anniversary of RG Kar rape-murder

Kolkata, The Calcutta High Court on Thursday did not pass any interim order in a petition against a proposed protest rally near the West Bengal state secretariat 'Nabanna' on August 9. HC refuses to pass order on rally near state secretariat on first anniversary of RG Kar rape-murder On this day last year, the body of an on-duty doctor was found raped and murdered inside the state-run R G Kar Medical College and Hospital in Kolkata, sparking outrage nationwide. The court observed that the persons participating in the rally should protest peacefully as law-abiding citizens and not cause any harm to the police or government authorities, buildings and public properties. While not granting any interim relief as prayed for against the rally, a division bench presided by Justice Sujoy Paul said it will be open for the West Bengal government to implement a prohibitory order imposed in the area near Nabanna and inform the organisers about adequate alternative places for protest. The Kolkata Police arrested one person, and the CBI, which took over the investigation on a Calcutta High Court order, also made him the sole accused in the RG Kat rape-murder case. The trial court on January 20 sentenced the accused Sanjay Roy to life imprisonment till death. The central agency is continuing its investigation into the alleged conspiracy angle of the case. The court on Thursday noted that Article 51A of the Constitution contemplates that it is the duty of every citizen to "Safeguard public property and to abjure violence. The bench, also comprising Justice Smita Das De, directed that the state file a report, if any, in four weeks and the reply affidavit by the petitioner in 15 days therefrom. The court directed that the matter will come up for hearing again thereafter. The petitioner, a resident of Howrah city, sought issuance of an order prohibiting the state from allowing any rally or demonstration in the surrounding areas of the state secretariat. He also prayed that a direction be issued to the government for framing proper guidelines for ensuring public peace, safety and convenience during any such protest. The petitioner's lawyer submitted that following the gruesome crime at R G Kar hospital, a rally took place last year near Nabanna which created chaos and untoward incidents had taken place. Claiming that the protest is being projected on social media in the name of "Parents of RG Kar Student victim", the petitioner prayed that such a protest be prohibited by issuing an interim order. Appearing for the state, Advocate General Kishore Dutta argued that last year's protest march over the issue took an ugly shape and about 47 police personnel were injured. The AG also stated that government properties were destroyed and in this backdrop, it is better if the protest takes place in an alternative place in Howrah city and suggested three other locations - Mandirtala bus station, Howrah Maidan and under Bankim Setu flyover. During the course of hearing, both the petitioner and the state submitted that although the right to protest is a fundamental right under the Constitution, there must be some balancing of fundamental rights. The court noted that the Howrah police commissioner has invoked prohibitory orders under section 163 of Bhartiya Nagarik Suraksha Sanhita . "In our opinion, the government is best suited to take care of law and order situation," the bench observed. Delhi: Over 10k cops, anti-drone systems being deployed ahead of Independence Day

New Delhi: Robust security arrangements have been put in place across the national capital ahead of the Independence Day celebrations, with more than 10,000 security personnel being deployed to maintain law and order, Delhi Police officials said on Thursday. Delhi Police Commissioner SBK Singh has directed special police commissioner (law and order) and deputy commissioners of police to maintain a strict vigil in their respective jurisdictions, they said. A senior police officer said multiple layers of security will be in place at the Red Fort on Independence Day when Prime Minister Narendra Modi will address the nation. Apart from physical deployment, surveillance through CCTV cameras, drone detection systems, and facial recognition technology will be used to monitor the venue and surrounding areas, the officer said. Snipers and rooftop surveillance teams will be deployed to secure high-rises near the Red Fort, and movement in designated restricted zones will be strictly regulated through access control mechanisms, the officer added. Multiple security drills, night patrolling, enhanced foot patrolling, and plain-clothed surveillance teams are being mobilised to strengthen ground presence, especially in sensitive zones, said another officer. "Social media platforms are also being closely monitored by cyber units to detect and neutralise any possible online threats or misinformation campaigns that may disrupt peace," he added. Over 10,000 security personnel, including paramilitary forces and special commandos, have been assigned for duty during the week-long preparation and on the day of the celebrations, police said. Anti-sabotage checks, vehicle barricading, and verification drives are being intensified in coordination with intelligence agencies, said the officials. In his first major directive since assuming charge, Delhi Police chief Singh on Saturday issued an order banning the use of sub-conventional aerial platforms such as paragliders, hang-gliders, UAVs, drones, hot air balloons and other remotely piloted aircraft over Delhi skies between August 2 and August 16. "These aerial platforms can be potentially misused by anti-social elements or terrorist outfits for para-jumping or launching airborne attacks, posing a serious threat to public safety, VIP security, and critical installations during the Independence Day celebrations," the order noted. Singh has instructed all district police units to conduct foot patrolling in markets, metro stations, bus terminals, and other public gathering points. Senior officers have been told to remain on the ground and review the security arrangements personally. Surprise inspections and flag marches have also been planned across various districts to instil confidence among citizens and deter miscreants, said the officials. They further said that the Delhi Police is working in close coordination with central security agencies and intelligence units to ensure that no loopholes remain in security apparatus during this critical period. Special teams have been deployed at all major railway stations, inter-state bus terminals, airports, and metro stations for round-the-clock monitoring. Passenger screenings, baggage checks, and random identity verifications have been intensified, the officials said.

Can't allow mobocracy': Kerala HC orders police protection for Kizhakkambalam panchayat project site

Kochi: High court has stated that horrendous acts of mobocracy cannot be allowed to become the new norm and must be curbed with an iron hand, warning that if such acts are permitted, they would mark the beginning of the end of the democratic system and rule of law. Justice N Nagaresh made the remarks while granting police protection to the Kizhakkambalam grama panchayat, its officials, elected representatives, contractors, workers and suppliers to ensure the unhindered completion of the ongoing bus stand modernisation project at Kizhakkambalam junction. The court was considering a petition filed by the panchayat president seeking protection. The petitioner alleged that the project is facing obstruction from certain political parties and their affiliates. The project involves a bus waiting area, toilets and a cafeteria on the ground floor; a restaurant on the first floor; and a women's sales centre, e-facilitation centre and a 'She Gym' on the second floor. It was alleged that the former panchayat president, along with a political party leader, unlawfully entered the project site, dismantled barricades, and forcibly allowed buses to operate from the unfinished bus stand. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like If you have a mouse, play this game for 1 minute Navy Quest Undo They also erected a temporary waiting shed without any authority or approval. Taking note, HC stated that when a duly elected panchayat committee takes steps to discharge its statutory functions and public duties, such actions cannot be thwarted by physical force or unlawful interference. It warned that forces attempting to seize control of a panchayat today may, if unchecked, seek to challenge state or Union administrations tomorrow, posing a grave threat to the democratic polity. It further emphasised that police authorities cannot remain mute spectators in the face of such lawlessness and must act decisively to uphold the rule of law. Accordingly, the bench directed the Ernakulam rural SP and Kunnathunad police station house officer to provide effective police protection to the panchayat and other stakeholders to ensure completion of the project.
