'Unique case of rampant corruption in CBI, ED': Delhi HC sends CBI officials to agency's custody

In an unusual development, the
Delhi High Court
has remanded three CBI officials to the custody their own probe agency in a corruption case and said it "shakes the edifice of the machinery" whose primary duty was to bring the culprits to book. Justice Neena Bansal Krishna, in an order on April 25, said, "It is one of the unique cases of rampant corruption in CBI, ED and such other departments, which shakes the entire edifice of our executive and the investigating machinery which have the primary duty of investigations in crime and bring the culprits to face the penalty corruption."

The complaint showed it was not a stand alone case of corruption by the government officials but reflected a "large conspiracy" amongst the officials of various departments who took bribes to give undue advantage or impact and interfere in investigations and the functioning of these departments.
"It is, therefore evident that in certain situations as in the present case which is to unearth the larger conspiracy, the custodial interrogation at the initial stage of investigation to unearth the material facts cannot be denied. Considering the gravity and the magnitude of the alleged conspiracy, two days police custody/remand of the three respondents is granted to CBI," the court said.
The order came on a CBI plea against a trial court order refusing custody of the three accused officials to the agency.
The complainant alleged the accused CBI officials demanded Rs 50 lakh as bribe from him to "settle" two cases involving him, which was subsequently reduced to Rs 35 lakh.

He further claimed another official in the Finance Ministry demanded illegal gratification of Rs 50,000 for influencing ED officers in another case.
While one of the CBI officials was caught red-handed accepting Rs 3.5 lakh bribe from the complainant on behalf of the other official, the ministry official allegedly accepted Rs 50,000 through GooglePay.
On April 10, the trial court remanded the accused persons to judicial custody and on April 15 denied the CBI's plea for their custody.
CBI sought a 10-day remand of the accused on the ground that the case related to senior CBI officials trying to manage the investigations of the agency and if the same was not thoroughly investigated, it would have far-reaching consequences.
The court order said investigation was still at infancy and to unearth the larger conspiracy, the interrogation of the three accused was imperative.
To say the interrogation intended to extract a confessional statement was not correct and those accused of grave offences could not be permitted to take the administration of justice for a ride, it added.

Kolkata: The West Bengal government has approached the Supreme Court seeking revision of the earlier order related to the clearing of pending dearness allowance. State secretariat sources said in the petition at the Apex Court, the state government had also sought certain clarifications on certain points of the order that was delivered last month. However, the sources added, while moving the petition, the state government is carrying out the preparatory process for paying 25 per cent of the pending dearness allowance dues within the stipulated date. "However, the Supreme Court is on vacation now. Therefore, even though the petition has been filed, it may not be listed for hearing until the vacation period is over. So the state government has kept the preparatory process on for paying the 25 per cent of the pending dearness allowances dues within the Supreme Court stipulated deadline, to avoid any possibility of contempt of court," said a senior official of the state government who did not wish to be named. The immediate payment of 25 per cent of the pending dearness allowance dues will result in an immediate drain-out of over Rs 10,000 crore from the state exchequer, as per calculations of the state Finance Department. Currently, government employees in Bengal receive dearness allowances at a rate of just 18 per cent, as against 55 per cent received by their counterparts in the Centre and many other state governments. The state Finance Department employees also apprehend that this drain-out might also impact some monthly payments under different welfare schemes run by the state government. Last month, Chief Minister Mamata Banerjee indirectly blamed the Union government for the DA crisis. She claimed that since the Union government had frozen payments under various centrally-sponsored schemes to the state government, the latter had to continue those projects with its own money, as a result of which there was constant pressure on the state exchequer.

Bollywood actor Dino Morea appeared before the Enforcement Directorate (ED) in Mumbai on Thursday in connection with a money laundering probe linked to an alleged ₹65 crore Mithi river desilting scam. Watch) In videos shot by paparazzi, Dino can be seen looking relaxed as he makes his way into the ED office. Dressed in a white shirt and jeans with a backpack on, he looked confident and even smiled for the cameras before making his way inside. He almost went the wrong way before the photographers present there pointed him in the right direction. He was summoned by the ED and reached the federal agency's office at Ballard Estate at around 10:30 AM. In his last outing in May, Dino had avoided the cameras after news broke. According to the news agency PTI, the ED conducted searches at more than 15 locations in Mumbai, Kochi, and Kerala on 6 June, including Dino's properties in Bandra West. According to official sources, the premises linked to his brother Santino, Brihanmumbai Municipal Corporation (BMC) officials, and some contractors were also searched. The investigation is being conducted under the Prevention of Money Laundering Act (PMLA). The ED case stems from a Mumbai Police Economic Offences Wing (EOW) FIR filed in May against 13 persons, including contractors and civic officials, for an alleged ₹65.54 crore scam in tenders awarded from 2017-2023 for desilting of the Mithi river which flows through Mumbai and acts as a stormwater drainage channel for the metro city. Dino and his brother were also questioned by the Mumbai police in this case last month for their alleged links with middleman Ketan Kadam and accused Jai Joshi. In 2021, the ED had attached Dino's assets as part of the money laundering investigation linked to an alleged bank fraud case against Gujarat-based pharmaceutical company Sterling Biotech and its promoters.
