Wayanad landslides: HC quashes case against two persons for comments against CMDRF donations

Kochi: Tackling people expressing dissent or criticism through criminal cases is an affront to the democratic values enshrined in the Constitution, high court has held.
Justice V G Arun delivered the ruling while quashing a criminal case and further proceedings against V S Gowri Sankari of Thiruvananthapuram and U Prasant Bellulaya of Kasaragod, accused of posting negative comments in a WhatsApp group about the solicitation of contributions to the chief minister's distress relief fund (CMDRF) for the rehabilitation of Wayanad landslide victims.
The Bakal police had booked the petitioners under Sections 192 (wantonly giving provocation with intent to cause a riot) and 45 (assisting or encouraging another person to commit a crime) of BNS, Section 51 of the Disaster Management Act, 2005, and Section 120(o) (causing nuisance to any person by repeated or undesirable communication) of the Kerala Police Act.
HC observed that the mere fact that comments are unpalatable to some people, or even to the govt, is no reason to initiate criminal prosecution.
The remarks, though critical of the govt, were within the bounds of law. Finding the comments to be fair criticism, HC held that continuing the prosecution would amount to an abuse of process of law and a violation of the freedom of speech and expression guaranteed by the Constitution.
The bench further noted that the comments referred to alleged misutilisation of donated funds and criticised the political party in power. Assuming that such remarks could incite a riot or cause nuisance was "preposterous", HC said. It also observed that the govt's request for contributions could not be treated as a 'direction,' and therefore, cautioning WhatsApp group members before making donations would not amount to refusal of a direction under Section 51 of the Disaster Management Act.

This clearly shows who benefitted from this exercise," he recalled how B R Ambedkar had told the Constituent Assembly that "franchise is one of the most fundamental things in a democracy" and that no person eligible for voting should be excluded merely as a result of prejudice. He also accused the ruling establishment of capturing institutions and politicising the investigating agencies.

A 20-year-old woman prisoner, who is five months pregnant, allegedly fled from the JJ hospital, where she was admitted for treatment, on Thursday. The JJ Marg police have registered a case and launched a search for the woman. According to the police, the woman identified as Rubina Shaikh, 20, was staying at Vashi in Navi Mumbai along with her mother, sister and brother, who is a minor. During a crackdown on illegal Bangladeshi nationals staying in the area, a police team from the Vashi police station conducted a raid in January this year. After verifying the documents of Rubina and her family members, the police found they were illegally staying in India. The family had acquired several documents like Aadhaar card and PAN, a police officer said. They had even applied for passport based on the forged documents, the officer added. The Vashi police then registered a case against Rubina and three of her family members under sections of cheating and forgery of the BNS along with sections of the Passport Act 1950 and Foreigners Act 1946. Rubina was arrested on August 7 and kept in the Byculla prison after she was sent to judicial custody by court. In Byculla prison, she complained to the jail guards that she was not feeling well and the jail authorities then admitted her in JJ hospital on August 11, police said. During treatment, on August 14, she managed to flee on the pretext of going to the washroom. A case has been registered at the JJ Marg police station against Rubina, said a police officer.
