Gandapur to challenge governor's oath-taking of 25 lawmakers on reserved seats

Khyber-Pakhtunkhwa (K-P) Chief Minister Ali Amin Gandapur has announced plans to legally challenge the oath-taking ceremony of reserved seat lawmakers held at the Governor House on Sunday, terming it unconstitutional.
'Administering oaths at the Governor House on reserved seats violates the Constitution, which clearly states it must be done on the assembly floor. The speaker never refused—only adjourned the session due to lack of quorum,' Chief Minister Gandapur maintained.
The statement came after Khyber-Pakhtunkhwa (K-P) Governor Faisal Karim Kundi has administered the oath to 25 members of the provincial assembly on reserved seats for women and minorities, following an intervention by the Peshawar High Court (PHC) on Sunday.
According to Express News, the chief minister has decided to file a petition in the Peshawar High Court (PHC) against the swearing-in of members elected on reserved seats for women and minorities outside the provincial assembly.
Advocate General of K-P, Shah Faisal Utmankhel, cited Article 65 of the Constitution, which he said mandates that assembly members must be sworn in on the floor of the House. 'The speaker did not refuse to administer the oath; the session was adjourned due to lack of quorum,' he explained.
Utmankhel added that the assembly session was already scheduled for July 24. 'In this context, administering oaths at the Governor House is unconstitutional. Article 255(2) only allows for exceptions in cases of impracticality,' he said.

He further clarified that the chief minister and the speaker did not refuse their constitutional roles, and that a session was duly convened. The government, he said, will challenge the governor's move in court. 'The petition is ready and will be filed tomorrow due to court holidays today.'
The speaker of the provincial assembly is also expected to file a separate petition challenging the Governor House ceremony.
Meanwhile, K-P Information Adviser Barrister Saif sharply criticised the ceremony, calling it 'an oath taken over democracy's dead body.' He said the speaker had not cancelled the session but merely postponed it due to incomplete quorum.
'This act tramples on democratic traditions,' said Saif. He also accused the Election Commission of 'misleading the public' and acting on directives from the federal government. 'The ECP is determined to eliminate PTI,' he added, warning of legal consequences.
Saif called the oath 'unconstitutional and illegal' and said the Election Commissioner would be held accountable for the controversial February 8 elections as well. 'What's being done to the Constitution and law is unprecedented,' he said.

The oath taking ceremony was held at Governor House in Peshawar. Representatives of the Election Commission, Khyber-Pakhtunkhwa Assembly staff, and other relevant government officials were also present at the oath-taking ceremony.
Earlier in the day, a scheduled assembly session to administer the oath was disrupted when quorum was challenged soon after proceedings began. As a result, Speaker Babar Saleem Swati adjourned the session until July 24 at 2 PM.
Opposition parties subsequently approached the Peshawar High Court (PHC) to ensure the swearing-in of the newly elected lawmakers. In response, the court directed the provincial governor to administer the oath in lieu of the assembly speaker.

Listen to article Another dispute has erupted in the Islamabad High Court (IHC) as Justice Sardar Ejaz Ishaq has declined to accept the order of a two-judge bench to transfer civil appeals, pending in the high court for adjudication, to the district judiciary, and refusing to transfer the appeals in his docket. The division bench, comprising Justice Azam Khan and Justice Inam Amin Minhas, had ordered the transfer of 1,594 civil appeals to the district judiciary following the Civil Courts Amendment Act 2025 that redefines the appellate jurisdiction in civil matters. Justice Ishaq termed the bench's judicial order illegal. "I come to the rather embarrassing conclusion that the decision of the Division Bench in Civil Reference no 1/2025 was coram non judice, per incuriam, and an exercise of administrative authority cloaked as a judicial decision", he said in an order. Justice Ishaq said that the division bench's order violated the Article 175 (2) of the Constitution. He wondered why it did not occur to the judges of the bench or to the bar representatives that the parties might have to pay additional fees to the lawyers for hearings of appeals in district courts. "Had the interest of the litigants genuinely mattered to the Office, to the Division Bench, and to the Bars representatives, they could easily have interpreted. IHC judge defies bench on appeals transfer the amendment prospectively", said the order passed by Justice Ishaq. The judge further said that when the legislatures made such an express command for transfer – coupled with conferral of exclusive jurisdiction then it must be followed, "but when it stops short and simply changes the jurisdictional forum without specifying exclusive jurisdiction to a forum, then it follows inexorably from the presumption that the Legislature is presumed to be aware of all the laws that the Legislature intended to leave it to the Courts to apply the precedent law to decide the fate of pending cases, and the preponderance of precedent", the order said. "I say with a heavy heart that the Office, my learned brothers, as well as the Bars representatives, have not cared a bit about the plight of the litigants before the High Court, the utter inconvenience they will suffer by a de novo hearing of their appeals by the District Courts, the additional financial burden they will have to bear by paying fresh fees to the counsels for cases that have been, in most part, substantially argued before the High Court and, above all, they did not care in the least about the much higher pendency before the Judges in the District Courts, who also conduct civil and criminal trials, and with unrivalled nonchalance preferred to off-load the High Court's burden on them," it continued. "I feel sympathy for the Judges in the District Courts, who in all likelihood would wonder why could the eleven Judges of the High Court not girdle their belts to decide 1,594 appeals instead of offloading them to an almost equal number of Additional District Judges who are much, much more burdened with work then we are". The court also ordered the office to circulate the copy of this order to all the judges for their information and, should any of them agree with me, then for them to consider saying so in a written communique to the Chief Justice". "Further, the Office will also send a copy of this order to the Islamabad Bar Council and to the two Bar Associations for circulation amongst the members of the Bars", the order said. The hearing of case was adjourned until last week of September.

PHOTO: FILE The K-Electric (KE) after several years of delay has started payments of electricity duty amounting to Rs32 billion, it has collected from consumers through monthly bills, to the Sindh government. As per the agreement, the power utility has agreed to pay Rs1.25 billion to the provincial government in two installments. This move is part of a broader agreement under which KE has committed to pay Rs9.142 billion out of a total outstanding amount exceeding Rs32 billion. A payment schedule has also been issued. According to the agreed timeline, the power utility will pay Rs4.258 billion to the Sindh government by September 2025. Additionally, the K-Electric will now be required to regularly remit the electricity duty it collects from consumers through monthly bills. The issue of non-payment of electricity duty was taken up by the Public Accounts Committee (PAC). Meanwhile, the Rs25 billion dues between KE and the Karachi Water and Sewerage Board remain unresolved. K-Electric has warned government departments of potential disconnection if bills are not paid on time. The power utility in its letter to the secretary of the Sindh Energy Department referred to the discussion between KE team and PAC members on June 31, during which payment with respect to Electricity Duty (ED) was deliberated upon. As agreed, reconciled electricity consumption dues of the Karachi Water and Sewerage Corporation (KWSC) will be held for adjustment against ED accumulated up to August 2024 and the excess amount of ED for the said period shall be paid by KE in line with the agreed installments as reflected in the schedule. Furthermore, KE will also deposit the respective ED amount for the period from September 2024 to September 2025, no later than 30th September 2025, into the respective Government Treasury. Moreover, it was also discussed that payment to KE for electricity dues by Sindh government and its various departments should also be paid on timely basis failing which, KE would be at liberty to take appropriate action including, but not limited to, disconnection of the respective electricity connections albeit in accordance with law.
