Multi-party confab on security today

The Khyber-Pakhtunkhwa government is set to host an All Parties Conference (APC) on law and order today at the Chief Minister's House in Peshawar. Invitations have been sent out by Chief Minister Ali Amin Gandapur to political parties and representatives from various schools of thought. However, three major political parties — Jamiat Ulema-e-Islam Fazl (JUI-F), Pakistan Peoples Party (PPP), and Awami National Party (ANP) — have declined to attend. The Pakistan Muslim League-Nawaz (PML-N) acknowledged receiving the invitation but is yet to confirm attendance, while Jamaat-e-Islami has announced it will participate. The APC has been convened to discuss the deteriorating security situation in the province. Chief Minister Gandapur emphasized the need for a joint strategy to counter terrorism, stating, "Restoring peace is a collective responsibility. The re-emergence of terrorism is alarming and must be confronted unitedly. We must rise above differences for the sake of peace." ANP Provincial President Mian Iftikhar Hussain said his party would have participated had the APC been called by the Pakistan Tehreek-e-Insaf (PTI) as a political entity. "This is a government-led initiative, and decisions are already pre-determined. Therefore, ANP will not take part," he remarked. PPP Provincial President Muhammad Ali Shah Bacha dismissed the APC as a symbolic exercise, citing what he called a "non-serious" provincial government. "They should focus on public issues instead of protests and sit-ins," he added. JUI-F spokesperson Abdul Jalil Jan also confirmed the party will not attend the APC. Meanwhile, PML-N provincial spokesperson Ikhtiar Wali claimed the party has not yet received a formal invitation. He also noted that the prime minister has summoned a tribal Jirga today.

ISLAMABAD: A local court on Monday dismissed Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur's exemption application in alleged possession of illegal weapons and liquor case and issued his arrest warrants. Judicial Magistrate Mubashir Hussain Chishti, while announcing its reserved verdict, issued warrants for Gandapur and has ordered the police to arrest Gandapur and present him in court at the next hearing to be held on Tuesday (today). Earlier, the court resumed hearing, but neither Gandapur nor his legal counsel appeared before the court. Despite multiple calls for the case, no representative showed up, the judge remarked. Expressing displeasure over the absence, the court granted a final opportunity to the accused. 'Gandapur is given time until 2:30 pm on Monday to record his statement under Section 342 of the Criminal Procedure Code (CrPC),' the judge ordered. The court took a break until 2:30 pm. The magistrate warned that if Gandapur and his lawyer failed to appear by then, their right to record a statement under Section 342 will be forfeited. Judge issues K-P CM's arrest warrants again

A judicial magistrate in Islamabad has once again rejected Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur's request for exemption from attending proceedings of a case related to possession of liquor and illegal weapons and maintained his arrest warrants. On Monday, Gandapur again failed to appear in the court of Judicial Magistrate Mubashir Hassan Chishti despite being summoned. His lawyers were also absent. Judge Chishti remarked that even after multiple calls for the case, no one appeared in court. He granted a final deadline for Gandapur until Monday 2:30pm to record his statement under Section 342 of the Criminal Procedure Code. The court then adjourned the proceedings until that time and warned that failure to appear would result in the forfeiture of the right to record the statement. When the session resumed, Gandapur's lawyer Raja Zahoor-ul-Hasan came to the rostrum and filed a request for exemption from appearance, citing Gandapur's engagement in the Senate elections. Judge Chishti, however, asked him either to record the 342 statement or lose the right to do so. The lawyer gave an undertaking assuring that Gandapur would appear in the next hearing. He said seven co-accused had already been acquitted, and a petition for Gandapur's acquittal was also pending. The judge noted that the K-P CM had previously committed to appearing in court and recording the statement himself, and that the date had been set according to his own convenience. The lawyer stated that the Peshawar High Court had granted bail to Gandapur in all related cases, and requested one more date for the 342 statement to be recorded. Judge Chishti told the lawyer to submit the necessary applications, saying he would issue an order shortly. Later, the court rejected the exemption request and maintained the arrest warrants, ordering that Gandapur be arrested and produced in court. The judge adjourned proceedings until July 22 (today). The case dates back to Oct 2016, when the Islamabad police claimed to have recovered five Kalashnikov assault rifles, a pistol, six magazines, a bulletproof vest, alcohol and three tear gas shells from a vehicle belonging to the PTI leader outside Bani Gala. The case was registered at Bara Kahu Police Station. The same judge on July 19 issued non-bailable arrest warrants for the K-P chief minister and directed the station house officer (SHO) concerned to ensure his production before the court.

Earlier on Saturday, the magistrate issued non-bailable arrest warrants for Gandapur and ordered the relevant station house officer (SHO) to ensure his production. Although the prosecution completed recording witness statements in May 2024, Gandapur has yet to submit his own statement under Section 342 of the Criminal Procedure Code. The case dates back to October 2016, when Islamabad police claimed they had recovered five Kalashnikov assault rifles, a pistol, six magazines, a bulletproof vest, a bottle of alcohol, and three tear gas shells from a vehicle belonging to the PTI leader parked outside Bani Gala. Gandapur has consistently denied the allegations, stating that he was travelling with two licensed Kalashnikov rifles and that a valid arms licence was present in the vehicle. As for the alleged liquor recovery, he asserted that the bottle in question actually contained honey, not alcohol.

Gandapur to challenge governor-administered oath of MPAs

PESHAWAR: Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur has decided to move the court against the oath-taking of MPAs on reserved seats held at Governor's House. The chief minister said that the oath-taking in Governor's House is a blatant violation of the constitution. In a statement issued on Sunday, Gandapur asserted that holding the oath-taking at the Governor's House contradicts Article 65 of the constitution, which clearly states that the oath must be taken on the assembly floor. He clarified that the speaker of KP Assembly did not refuse to administer the oath, but the session was adjourned due to lack of quorum. He added that the speaker has summoned the assembly session on July 24, emphasising that any oath outside the assembly, particularly at the Governor's House, is unconstitutional. Gandapur stated that Article 255 (2) of the constitution applies only under extraordinary circumstances. If the chief minister and speaker refuse, only then can the chief justice nominate someone to administer the oath. He opined that the oath administered at the Governor's House was illegal and therefore it would be challenged in the court. 'The petition has been drafted and it will be moved in the Peshawar High Court tomorrow.' Earlier, Advisor to the Chief Minister of Khyber Pakhtunkhwa on Information, Barrister Dr Saif said that the opposition parties' decision to take oath on reserved seats will be remembered as one of the darkest chapters in the country's parliamentary history. He said that by misusing the 26th Constitutional Amendment, a dagger has been thrust into the heart of democratic politics. He said that the parties 'rejected by the people' in comparison to PTI have now been handed PTI's reserved seats, which is a blatant insult to the public mandate. 'The opposition, despite winning, remains dissatisfied, while PTI, despite the imposed defeat, is content owing to the unwavering support of the people.' Referring to the oath-taking ceremony at the Governor's House, Barrister Dr Saif alleged that the event symbolized taking oath over the 'corpse of democracy.' He accused the Election Commission of misrepresenting facts and stated that the Khyber Pakhtunkhwa government strongly condemns this misrepresentation.
