Trial begins in Utah for a man accused of faking his death to avoid rape charges

A man accused of faking his death and fleeing to the United Kingdom to avoid rape charges faced an alleged victim in court Monday as a jury trial in Utah began.
The man known in the US as Nicholas Rossi, whose legal name is Nicholas Alahverdian, is accused of sexually assaulting two women in Utah in 2008. He has pleaded not guilty to the charges. Prosecutors are trying the cases separately, with the first set in Salt Lake County.
Rossi, 38, was arrested in Scotland in 2021 — a year after he was reported dead — when he was recognized at a Glasgow hospital while receiving treatment for COVID-19. He lost an extradition appeal after claiming he was an Irish orphan named Arthur Knight who had never set foot on American soil and was being framed.
Prosecutors say they have identified at least a dozen aliases Rossi used over the years to evade capture.
Rossi appeared in court in a wheelchair, wearing a suit and tie and using an oxygen tank. The alleged victim identified him from the witness stand, saying he's 'a little bit heavier, a little bit older' but mostly looks the same.
District Judge Barry Lawrence helped clarify for the jury some of the twists and turns of the case, explaining that different people may refer to Rossi by different names. The defense and prosecution agreed it's factual that Rossi was in Utah in 2008 and had a relationship that year with the woman who testified.
Prosecutors painted a picture of an intelligent man who used his charm to take advantage of a vulnerable young woman. He raped her when she pushed back against his attempts to control her, said Deputy Salt Lake County District Attorney Brandon Simmons.
The woman, who the judge asked not be identified publicly, described a whirlwind relationship with Rossi that began in November 2008 while she was recovering from a traumatic brain injury. The two began dating after she responded to a personal ad Rossi posted on Craigslist and were engaged within about two weeks.
The woman described being asked to pay for their dates, cover Rossi's rent so he wouldn't be evicted from his apartment and take on debt to buy their engagement rings.
'I was a little bit more of a timid person back then, and so it was harder for me to stand up for myself,' she said.
The relationship spiraled quickly after their engagement, with Rossi 'becoming controlling and saying mean things to me,' she testified. The couple got into a fight in which Rossi pounded on her car and used his body to block her from pulling out of the parking garage. She finally let him inside and drove him home but said she had no plans of continuing a relationship.
She agreed to go into his house to talk, but he instead pushed her onto his bed, held her down and 'forced me to have sex with him,' she testified. The woman described lying still, paralyzed with fear.
Dismissive comments from her parents convinced her not to go to the police at the time, she said. She did, however, try to bring Rossi to small claims court over the engagement rings but dropped the case.
Rossi's lawyers sought to convince the jury that the alleged victim built up years of resentment after Rossi made her foot the bill for everything in their monthlong relationship, and accused him of rape to get back at him a decade later when she saw him in the news.
Rossi will also stand trial in September for another rape charge in Utah County.
Rossi grew up in foster homes in Rhode Island and had returned to the state before allegedly faking his death. An obituary published online claimed he died on Feb. 29, 2020, of late-stage non-Hodgkin lymphoma. State police, along with Rossi's former lawyer and a former foster family, cast doubt on whether he was dead. A year later, hospital staff in Scotland recognized his tattoos from an Interpol notice and alerted authorities. He was extradited to Utah in January 2024.
'This case is like an old puzzle from the thrift store,' said MacKenzie Potter, one of Rossi's attorneys. 'It's 13 years old, not all the pieces are there, some pieces are from a different puzzle. And when you start going through everything, you're not going to get a complete picture.'
Prosecutors pushed back, saying that if any 'puzzle pieces' are missing, it's because Rossi's attorneys fought to have some evidence dismissed.

The responding officer reported that when he approached the vehicle, he could hear a child crying inside. The child had reportedly taken his shirt off because he was hot, and when asked why he was crying, he said that it was because he was hot. The officer reported that his hair was drenched in sweat, and he looked sluggish. The front door was unlocked, and so the officer was able to take the child out of the vehicle and take him to get fresh air. The officer placed him in a grassy area in the shade and gave him water and candy to help cool him down and make him feel better. Emergency medical services responded to evaluate the child, finding that he was lethargic and had unusually high blood pressure, but that he would be fine. A detective searched for the child's mother in all the offices in the building and was eventually able to locate Argote in the Driver's License Division. Argote allegedly told police that she was not gone for very long. Police examined surveillance footage, finding that Argote entered the building at 8:02 a.m., and that she did not come out to check on her son for over 68 minutes. In 2024, 39 children died from heatstroke from inside a car, according to the National Traffic Safety Administration, which was a 35% increase from 2023. The child's mother, Eliana Suaza Argote, 34, has been charged with one count of intentional or knowing child abuse, a Class A misdemeanor. She was released on bail and has a preliminary waiver hearing on Aug. 27, 2025. In the bodycam video, obtained by through a records request, a Heber City Police Officer can be seen approaching the vehicle and opening the door after he sees and hears a child crying. He opens the driver's side door, finding that the door is unlocked. According to court documents, responding officers arrived just after 9 a.m. Police believed that the car had been in the parking lot for over an hour. The engine was turned off, meaning there was no air conditioning, and all of the windows were completely rolled up. The video shows a conversation between the child and the responding officer, both speaking Spanish. The officer asks why the child is crying, and he responds that he is hot. In documents, the officer wrote that the child looked 'sluggish,' was drenched in sweat, and had taken his shirt off due to the heat. 'Come with me,' the officer tells the child in Spanish. He tries to get him out through the front driver's side door, as the back doors are locked. 'It's hot as h— in there,' he tells another officer on scene while retrieving water for the child. The responding officer can be seen reaching through the vehicle to unlock the back door and let the child out. Police lead the child to a shaded area on the grass in front of the Driver's License Division building. Officers called for an emergency medical services (EMS) vehicle to respond. One of the officers goes inside to find the child's mother, and the other remains with the child. He explains that they're looking for his mother, and offers the child a snack from his patrol vehicle. The child tells the officer that he's seven years old. The other officer returns and says that she couldn't locate anyone by the name the child told them. Right at that time, an ambulance arrives at the scene, and the two officers explained the young boy's condition. The bodycam video concludes after the child is taken into the ambulance by EMS. According to documents, responders found that he was lethargic and had high blood pressure, but would be okay. Court documents say that the child's mother, Argote, was eventually located inside and claimed that she was not gone for very long. Surveillance footage revealed that she had entered the building just after 8 a.m. and had not come outside to check on her child for over 68 minutes. SALT LAKE CITY (ABC4) — A man was arrested in Salt Lake City on Saturday for stealing a car that had an infant in the backseat, according to Salt Lake City Police. The mother was able to get her infant child out of the vehicle before the man fled, according to police. Carlos Daniel Castellanos, 23, was arrested on charges of child kidnapping (first-degree felony), theft of value over $5,000 (second-degree felony), robbery (second-degree felony), among other charges related to illegal use of credit cards and illicit drugs. Just before 11 a.m. on Thursday, Aug. 7, Salt Lake City Police responded to a robbery at the Gateway Mall parking garage, located at 62 S Rio Grande St. The victim told police she was parked in the garage with her infant child in the backseat when she stepped away from the car while it was running. According to police, Castellanos was skateboarding in the parking garage and was told to leave by Gateway security. As Castellanos was leaving the garage, he allegedly saw the unoccupied running vehicle and got in the driver's seat. He reportedly began driving away when the victim, who was nearby, realized her car was moving and tried to stop it. According to police, the woman was dragged by the vehicle for several feet before Castellanos allegedly realized that there was an infant in the backseat. Castellanos then stopped the vehicle and yelled for the victim to get her child. The mother was reportedly able to open the car door and retrieve her child before Castellanos fled in the vehicle. On Friday, Aug. 8, the victim called police and reported that her credit cards that were in her stolen vehicle were being used at a local 7-Eleven. Police reviewed surveillance footage at the store and found images of a male suspect that matched the individual involved in the Gateway car theft. Just before 11:40 p.m., police found and detained Castellanos at Taufer Park. He later admitted to detectives that he stole the car at Gateway while the child was inside. He reportedly also admitted to stealing the victim's credit cards and using them at 7-Eleven. During Castellanos' arrest, police found methamphetamine and marijuana in his possession. Castellanos was booked into Salt Lake County Jail on the aforementioned charges. No further information is available at this time. Charges are allegations only.
