
Suhakam officer files judicial review against Commission

Kota Kinabalu: Dr Alfonso Min, a senior officer of the Human Rights Commission of Malaysia, has filed a Judicial Review application at the High Court here against Suhama and its Disciplinary Committee. His judicial review leave application filed by his lawyer Dato' Sri K. Rakhbir Singh, challenges the Commission's prolonged disciplinary proceedings and continued failure to render a decision following a show cause process initiated earlier this year. Dr Alfonso joined Suhakam in 2013 and has served with distinction for over 12 years. He last held the post of Ketua Penolong Setiausaha (Gred 48) based in Kota Kinabalu. During his tenure, he contributed significantly to administrative, legal, and human rights functions within the Commission. The current proceedings stem from a show cause letter issued by Suhakam dated January 28 2025. Dr Alfonso submitted a written reply within the time stipulated and subsequently issued a formal written reminder to Suhakam on May 17 2025 via letter and email, urging the Commission to make a decision. Despite this, Suhakam took no steps to resolve the matter or conclude the disciplinary process. The matter was left indefinitely suspended, creating unnecessary hardship, reputational harm, and uncertainty over Dr Alfonso's employment status. As a result of Suhakam's inaction and ongoing procedural irregularities, Dr Alfonso is now compelled to seek judicial intervention. In his application, filed by Lawyer Rakhbir Singh, he challenges the legal validity of the disciplinary framework relied upon by Suhakam, contending that it is unconstitutional and had been superseded by the Statutory Bodies (Discipline and Surcharge) Act 2000. 4 students detained over assault of classmate

Kuala Lumpur: Four 13-year-old students have been detained by the police to assist in investigations into the assault of a classmate at a shopping centre in Kajang. Kajang police chief Naazron Abdul Yusof said the boys were detained following a report lodged by their classmate at 12.57pm yesterday. He said investigations found that the incident occurred at about 11am on July 30, when the complainant and his classmates went to the shopping centre to address a disagreement. 'During the incident, a viral video captured the complainant being assaulted by two students, while two others recorded the act on their mobile phones,' he said in a statement. Naazron added that the victim received medical treatment at a nearby hospital, where he was confirmed to have sustained minor facial injuries. The four students involved were arrested in Kajang at 8.35pm yesterday and remanded for two days until Aug 2 to assist in investigations. The case is being investigated under Section 323 of the Penal Code for voluntarily causing hurt, Section 506 of the same law for criminal intimidation, and Section 14 of the Minor Offences Act 1955. Naazron advised students to obey school rules and to avoid actions that could affect their future. Suhakam calls for diversion policy after 14-year-old remanded for allegedly assaulting teacher in Kajang
KUALA LUMPUR, Aug 1 — The Human Rights Commission of Malaysia (Suhakam) has urged the government to implement a formal diversion policy for children in conflict with the law, following the remand of a 14-year-old student who allegedly assaulted his teacher. The boy was reportedly detained for two days after punching and threatening the teacher when reprimanded for skipping a physical education class at a secondary school in Kajang on Monday. While condemning the act of violence, Suhakam stressed that punitive responses to children must give way to more rehabilitative approaches. 'Such a policy is not a denial of accountability but a shift towards restorative and rehabilitative justice which is proven to be more effective and humane for children,' it said in a statement today. A diversion mechanism, the commission explained, allows children accused of minor or non-violent offences to be redirected away from the criminal justice system into community-based programmes focused on education, counselling, and behavioural support. 'This approach would not only reduce the risk of criminalisation and social stigma but also address underlying issues such as trauma, neglect, or mental health,' it said. In the same statement, Suhakam said the incident should serve as a 'catalyst for reflection on broader systemic issues', such as whether schools have effective behavioural support systems, whether students have timely access to mental health services, and whether teachers are equipped with conflict resolution and trauma-informed strategies. Although Suhakam stood 'in solidarity with the teacher involved' and stated that 'violence in any form is unacceptable,' it reminded authorities and the public that children in such cases must be treated in a manner that upholds their dignity and rights under the Child Act 2001 and Malaysia's international obligations, including the UN Convention on the Rights of the Child (CRC). It also reminded media outlets and the public that Section 15 of the Child Act prohibits the publication of any identifying details of children involved in criminal or custody proceedings. 'Public identification, speculation, or vilification of minors is harmful and may breach this provision,' the commission warned. Suhakam urged the Ministry of Education, school administrators, and other relevant bodies to strengthen holistic, preventive systems that support the well-being of both students and educators. 'Malaysia must move beyond punitive responses and embrace a child justice system that reflects compassion, equity, and the best interests of the child,' it said, adding that it remains committed to working with the government and civil society to realise this vision.

Sosma reform: Suhakam seeks bail rights, shorter detention, and transparency
KUALA LUMPUR: The Human Rights Commission of Malaysia (Suhakam) has outlined five core reforms it hopes will emerge from ongoing stakeholder consultations on the Security Offences (Special Measures) Act 2012 (Sosma). The commission is also asking the government to release draft amendments before they are tabled in Parliament. Secretary-general Altaf Deviyati said the commission's longstanding concerns include extended detention without judicial oversight, restricted access to bail, limited access to legal counsel during initial detention, and broad discretionary powers granted to enforcement agencies. "We believe these provisions not only challenge Malaysia's international obligations but are also inconsistent with the Federal Constitution," she told the New Straits Times. Among Suhakam's proposals is the reinstatement of judicial discretion in granting bail, particularly for non-violent and non-terrorism-related offences. The commission also calls for the maximum initial detention period to be shortened from the current 28 days, which it views as excessive. Altaf said access to legal counsel must be guaranteed from the point of arrest, and that the right to a prompt and public hearing should be assured. "Currently, detainees are waiting far too long just to get their first hearing," she added. Finally, Suhakam recommends narrowing Sosma's application to truly exceptional and well-defined national security threats. "Ordinary criminal offences should be addressed under existing laws," Altaf said. Its secretary-general said that Suhakam has been participating in engagement sessions through the Parliamentary Special Select Committee since November last year. "Public consultation is essential in any democratic law-making process," Altaf said, adding that transparency will ensure a more balanced approach between national security and fundamental liberties. Altaf said that the commission acknowledges Malaysia's security needs but maintains that amendments must address ongoing and potential human rights violations. Beyond legislative changes, Suhakam also advocates for systemic reforms to prevent abuse under Sosma and similar laws. These include strengthening internal and external oversight, creating an independent complaints mechanism, and improving judicial training and awareness of human rights standards. "We also need greater transparency in how laws like Sosma are enforced, including the regular publication of arrest data," Altaf said. She added that Malaysia should ratify international human rights treaties such as the United Nations Convention Against Torture (UNCAT) and the International Covenant on Civil and Political Rights (ICCPR) to reinforce protections against arbitrary detention and mistreatment.
