Peter Anthony To Serve Three-year Sentence After Court Of Appeal Dismisses Review
A Court of Appeal three-member panel here, consisting Justices Datuk Azman Abdullah, Datuk Noorin Badaruddin and Datuk Hayatul Akmal Abdul Aziz, today dismissed Peter's review application.
In reading the court's decision, Justice Azman said there was no breach of natural justice as the applicant (Peter) had been accorded the right to be heard at his appeal.
He added that the absence of the issue relating to a police report lodged by a witness, the late Mohd Shukur Mohd Din, in the broad grounds of the Court of Appeal did not amount to a miscarriage of justice as the matter had been clearly addressed in the appellate court's full judgment.
'We find that there was no miscarriage of justice as P4A (the police report) was argued extensively,' he said.
Justice Azman also said the court's assumption has been supported by the Court of Appeal's full grounds of judgment, where the issue on the police report was thoroughly discussed, adding that it was not the court's duty to rehear evidence and facts that have been decided on.
In the police report dated Aug 9, 2018, Mohd Shukur, then UMS deputy vice-chancellor, claimed that his statement recorded by the Malaysian Anti-Corruption Commission (MACC) in Kota Kinabalu on July 20, 2017 was untrue, as he had been placed under pressure. He alleged that the last paragraph of his statement was concocted to implicate Peter.
The police report was only discovered by Peter after his trial concluded. In February last year, he applied to the Court of Appeal to adduce new evidence under Section 61 of the Courts of Judicature Act 1964. The court admitted the police report, though Mohd Shukur had since passed away.
Peter sought a review of the March 4 decision this year by a different Court of Appeal panel which upheld his conviction, three-year prison term and RM50,000 fine imposed by the Kuala Lumpur Sessions Court in May 2022. The 54-year-old has already paid the fine.

Charges against Zara's alleged bullies could change with new evidence, says minister
Home minister Saifuddin Nasution Ismail said the inquest is to establish the cause of Form 1 student Zara Qairina Mahathir's death and not to find fault. (Bernama pic) PETALING JAYA : Charges against the five teenage girls for allegedly verbally bullying Form 1 student Zara Qairina Mahathir may be amended if new evidence emerges, home minister Saifuddin Nasution Ismail said today. He said it was not unusual for charges to be amended during the course of proceedings. 'Of course, the charges can be amended. It's a normal part of the legal process. Sometimes the accused is initially charged under Section 302 of the Penal Code (for murder), which is later reduced to Section 304 (for culpable homicide not amounting to murder). 'That's how the process works,' he said when winding up the debate on the 13th Malaysia Plan in the Dewan Rakyat for his ministry. He was responding to a question from Afnan Hamimi Taib Azamudden (PN-Alor Setar) on whether the charges could be revised should new evidence surface during the inquest into Zara's death. Saifuddin said the inquest was intended to establish the cause of Zara's death and that it was not an exercise in finding fault. Earlier today, the five teenagers were charged in the children's court in Kota Kinabalu, Sabah, with verbally abusing Zara, who died last month. They were charged with uttering abusive words against the victim which could have caused her distress. They are accused of committing the offence at Block A-3-6 of SMK Agama Tun Datu Mustapha in Limauan, Papar, between 10pm and 11pm on July 15. Zara was found unconscious at 4am on July 16 after allegedly falling from the third floor of her school's hostel in Papar, Sabah. She died at Queen Elizabeth I Hospital in Kota Kinabalu the following day. Her body was exhumed on Aug 9 to allow for a post-mortem amid allegations of bullying. The Attorney-General's Chambers yesterday defended its decision to charge the five teenagers, clarifying that the charges under Section 507C(1) of the Penal Code related specifically to acts of bullying and were not connected to Zara's death. The AGC also dismissed a suggestion by lawyers representing Zara's family that further investigations or an inquest could later justify a more serious charge under Section 507D(2), saying this was 'speculative and not supported by accurate facts'. The lawyers had urged the AGC to postpone the charges against the five minors.

Malaysia Sees ASEAN As Strategic Growth Region Amid Global Challenges
BUSINESS KUALA LUMPUR, Aug 20 ( Bernama) — Malaysia views ASEAN as a region with vast untapped potential -- poised to become a dynamic engine of growth and resilience amid global uncertainties, according to the Ministry of Investment, Trade and Industry (MITI). MITI Deputy Secretary General (Trade) Mastura Ahmad Mustafa said ASEAN is more than just a large market, it is a reservoir of innovation, creativity and energy with a population nearing 700 million, almost one third of whom are youth. 'Our demographic dividend, coupled with a rapidly growing consumer class, rising connectivity and accelerating digital adoption, gives ASEAN a unique advantage. 'If nurtured in accordance with the principles of sustainability and inclusivity, these strengths will not only fortify our region's growth but also position ASEAN to play a defining role in shaping the future of the global economy,' she said in her speech at the welcome dinner for the Senior Economic Officials' Meeting (SEOM) 3/56 and Related Meetings today. Under the ASEAN chairmanship, Mastura said Malaysia is working to deepen regional integration, strengthen supply chain resilience, foster sustainable and responsible investment and advance digital innovation. 'More importantly, we are committed to creating opportunities for businesses of all sizes, especially micro, small and medium enterprises to participate meaningfully in ASEAN's growth story,' she added. In a separate statement, MITI said key discussions at SEOM 3/56 focused on Malaysia's Priority Economic Deliverables under its 2025 ASEAN chairmanship; updates on the 2025 Annual Priorities under the AEM/SEOM purview; implementation of ASEAN agreements; advancement of the Digital Economy Framework Agreemen; and ASEAN's sustainability agenda, including carbon neutrality, circular economy, and the ASEAN Power Grid. MITI is hosting the SEOM 3/56 and Related Meetings from Aug 18 to 23 in Kuala Lumpur. The ministry said that discussions with ASEAN Dialogue Partners focused on reviewing progress and addressing key issues related to the implementation of existing Free Trade Agreements (FTAs), as well as the status of work plans and ongoing economic cooperation initiatives.
