MPs to seek legal opinion on allegations against auditor-general
The complaint, submitted in August 2022, alleged misconduct by Maluleke in relation to financial transactions involving her predecessor, the late Thembekile Kimi Makwetu.
Mlungisi Mabaso, a former chief people officer, claimed Maluleke, while serving as deputy auditor-general, improperly authorised an R860,000 advance on deferred compensation to Makwetu and a R575,000 payment for bond transfer costs. He also questioned a subsequent interest payment to Makwetu's widow.
The auditor-general's office denied wrongdoing and commissioned an external legal opinion by advocate Werner Krill and an investigation by Bowmans. Both found no evidence to support the allegations. According to a statement from the auditor-general in 2022, Mabaso was dismissed after an independent disciplinary process for gross misconduct, among other charges.
The matter was brought to the attention of the sixth parliament's committee, which held closed and open sessions in August and September 2022. However, no formal resolution was adopted and no communication was sent to the complainant. In February 2025, Mabaso resubmitted the complaint to the committee, alleging it had been improperly handled and requesting it be formally investigated.
Presenting the legal opinion, Fatima Ebrahim of the constitutional and legal services office, said while the previous committee had engaged with the matter, the absence of a formal outcome had contributed to perceptions of a lack of transparency.
'Unfortunately there's no report or resolution regarding the findings or conclusion of the previous committee on the matter,' she said.
Ebrahim recommended the committee apply its mind and reach a resolution, either to reopen the investigation or conclude it based on the available evidence.
The legal opinion emphasised the constitutional status of the auditor-general as a Chapter 9 institution and the importance of safeguarding its independence, impartiality and dignity.

Suspended IDT CEO Malaka and spokesperson Makgolane attempted to pay Daily Maverick investigative journalist Pieter-Louis Myburgh R60,000 in cash over the weekend to suppress an investigation into Malaka's personal dealings and questionable IDT contracts. The IDT, a very important, if lesser known, government body, spends upwards of R4-billion each year on social infrastructure projects, such as building schools and clinics, and falls under the Ministry of Public Works. Macpherson last week released a forensic report into a R836-million oxygen tender awarded to a ghost company that was first exposed by Daily Maverick. The report recommended that Malaka be suspended. Malaka was placed on precautionary suspension on Friday. Now Macpherson's remarks at Wednesday's briefing are expected to set the tone for the government's broader response. The attempted bribe, which took place during a meeting in Stellenbosch, was captured on camera. Myburgh photographed the cash, delivered in a white Dior shopping bag, and recorded video and audio of the exchange. Makgolane also sweetened the offer with promises of R100,000 in monthly payments and influence over IDT tenders. In a statement on the briefing, his department confirmed that Macpherson would respond directly to the 'serious allegations by Daily Maverick that Malaka sought to bribe journalist Pieter-Louis Myburgh'. Posting to social platform X yesterday morning, Macpherson said he planned to consult with the IDT board later in the day. The statement also warned that the matter appeared to be part of 'what is now likely a paid-for public campaign aimed at discrediting [Macpherson's] efforts to bring stability and good governance to the entity'. Ten SAPS, EMPD officers held for theft released on bail of R1,500 each
Ten police officers who appeared before the Germiston magistrate's court on Tuesday and Wednesday on charges of theft were each granted bail of R1,500 after an unopposed bail application. They are Fortune Dhlamini, Nomfuneko Felicia Sambane, Mangalore Moloko, Nhlanhla Tumelo Matsane, Thabo Mokgaboki, Matthews Mashala, Mesho Hector Mabasa, Dlalisa Eugene Zamokuhle, Kgagare Tseego and Sidebi Tendani. 'The case stems from a complaint laid by a shop owner in Edenvale, who alleges that during a raid on his business premises on June 4, the officers seized R35,000 in cash, cigarettes worth R150,000 and boxes of Panado tablets,' National Prosecuting Authority spokesperson Phindi Mjonondwane said. She said the officers, six from Ekurhuleni Metro Police Department (EMPD) and four from the SA Police Service, were part of a joint law enforcement operation aimed at monitoring compliance at shops in the area. 'According to the complainant, he was not present during the raid but was later informed by his cashier that the police had confiscated the items. The seized goods were allegedly placed in several refuse bags to be submitted as exhibits.' Police close probe into missing R465k Sedibeng mayoral chain
Gauteng police have confirmed that their investigation into the missing Sedibeng mayoral chain, valued at R465,000, has been closed. The ceremonial chain went missing after the state of the district address on June 23 2023. The mayor, Lerato Maloka, had allegedly put it on the shelf in her office after she finished the address and it was never seen again. A case of theft was opened in November that year, but the chain is yet to be found. Police spokesperson Col Dimakatso Nevhuhulwi confirmed that no arrests had been made. 'Investigations were conducted and the docket brought before the deputy public prosecutor, who declined to prosecute, hence the matter was closed on July 25,' she said. Asked why the matter was taken to the National Prosecuting Authority (NPA) though there was no suspect, Nevhuhulwi said: 'Some of the cases are first investigated then brought to Senior Public Prosecutor of the Director of Public Prosecutions, whether someone is arrested or not. And this is one of those cases.' DA MPL Kingsol Chabalala described the closure of the case as disturbing. 'This is a serious matter that leaves suspicions, as the case has be suddenly closed without any arrests or recovery of the mayoral chain,' he said. Chabalala has since written to Gauteng premier Panyaza Lesufi, calling for urgent intervention in what he describes as an 'unresolved matter'. In the letter, he raised concerns about transparency, accountability and the handling of public assets within the Sedibeng district municipality. 'The disappearance of a ceremonial asset valued at nearly half a million rand, coupled with the lack of transparency and accountability, undermines public trust in the municipality's leadership. 'Your intervention is critical to restoring confidence and ensuring that those responsible for any negligence or misconduct are held accountable. I trust that your office will treat this matter with the urgency and seriousness it demands. Please keep me informed of any actions taken or progress made in addressing this issue,' reads part of the letter.
