Showroom sells a used car for Dhs68,000, stalls payment to vehicle's owner

Al Ain Civil, Commercial and Administrative Cases Court obligated a showroom for selling new and used cars to return Dhs68,000 to a customer and fined it Dhs15,000 for failing to transfer the price of a car to a customer.
Earlier, the customer asked the showroom to help him sell his car and consequently he was asked to transfer the ownership of the car to the showroom's name to make it easier to sell it.
Later, an agreement on the sale price was reached, but the showroom did not commit to transferring the amount to the car owner and began to stall.
The car owner filed a lawsuit against the showroom in which he requested the court to obligate it to pay him Dhs68,000 plus a legal interest at 9 per cent per annum from the date of the claim until full payment.
He also requested the court to obligate the showroom to pay him Dhs30,000 in compensation for the material and moral harms he had befallen plus the incurred fees, expenses, and lawyer's fees.
The car owner pleaded that he owned a car, and the defendant was a licensed showroom for selling new and used cars.
As he wanted to sell his car, he agreed with the showroom for his car to be displayed at the showroom and then sold at the highest satisfactory price.
The car continued to be displayed until the showroom informed the car owner that it had agreed with a buyer to sell the car for Dhs68,000, which the car owner agreed to.
However, the showroom informed the car owner again that the buyer wanted to buy the car through a UAE bank and consequently the car owner was requested to transfer the ownership of the car to the showroom to be able to sell the car and complete the procedures faster.
The showroom asked the car owner to use his digital ID and carry out the procedures for waiving the car and promised him to transfer the amount as soon as the procedures were completed.
The car owner stated that the showroom, however, continued to stall on this matter and refused to transfer the amount to him although the car had already been sold and the sale price had already been received.
This prompted the car owner to file a lawsuit, requesting the court to issue a verdict in his favour.
He supported his lawsuit with a copy of the WhatsApp conversations and a copy of the car ownership document.
The court explained that it was evident from the documents that the car owner had handed his car over to the showroom and declared that the showroom had sold it and collected its price Dhs68,000.
The showroom did not dispute the origin of the debt and acknowledged the car owner's right to claim it.
The court thereby ordered the showroom to pay the amount claimed and estimated the compensation due at Dhs15,000 for all the material and moral harms that the car owner had befallen.

The Abu Dhabi Family, Civil and Administrative Cases Court ruled that a guardian must pay Dhs74,081 to an individual in a case involving the guardian's minor son stealing a car, driving it, and causing an accident resulting in the car's damage. The court also ordered the guardian to pay the fees and expenses of the lawsuit. The court heard that a minor without a driving licence stole a car without the owner's permission. Due to his recklessness and lack of consideration for road conditions and traffic instructions, as well as his failure to respect applicable laws, he caused an accident that resulted in damage to the car. This resulted in irreparable damage, rendering the car unfit for use. The car owner was therefore forced to rent a car from a rental office, which resulted in significant financial losses. He filed a lawsuit demanding that the minor's guardian pay him Dhs200,000 for the value of the car, compensate him for renting a vehicle for over one year and six months, and pay the value of the vehicle release invoices. This was to be paid in his personal capacity and as the natural guardian of his son, who caused the damage as a result of his proven mistake. The owner also demanded legal interest at a rate of 9% from the date of the legal claim until full payment and the payment of fees, expenses and attorney's fees. As a juvenile under sixteen years of age, the minor was referred to the Public Prosecution Office, which investigated the incident and ultimately referred him to the Misdemeanour Court. A criminal case was filed against him as a family prosecution case, and he was found guilty. As the minor and his guardian could not appeal this ruling, it became final and binding. The Court appointed an expert to determine the damages incurred by the car owner as a result of the accident, as well as the market value of the damages caused by the minor. In his report, the expert concluded that the car was not roadworthy and a total loss, as the cost of repairing it exceeded 50% of its market value of Dhs80,000 at the time of the incident. The market value of the wreckage was estimated at Dhs15,000. Therefore, the car owner was entitled to Dhs65,000 for the car's market value, plus Dhs1,081 for releasing the car from impoundment. According to the expert's assessment, the car owner is also entitled to compensation for loss of use of his vehicle in the amount of Dhs5,000 and compensation for moral damages in the amount of Dhs3,000. Therefore, the court ruled that the minor's guardian must pay the car owner Dhs74,081. Regarding the car owner's claim for compensation for the cost of renting a vehicle for over one year and six months, the court clarified that the case documents contained no evidence that he had rented a replacement car. Instead of invoices for the rental of a replacement car, a price quote for the rental of a replacement car was attached. Therefore, the court ruled to reject this part of the claim for financial compensation in its current form.

This rise is attributed to a combination of factors, including increased demand, limited supply in certain areas, and a shift in tenant behavior towards renewing existing leases. While rentals still remain high, last week brought some good news when we reported that the rental prices of properties in some areas of the city were dropping. This was despite an increase in demand for studios and one-bedroom apartments due to the crack down on illegal subletting and partitioning around the city. Gulf News reported that in the last few months, rental prices around Dubai had either stayed the same or dropped slightly. Discovery Gardens has seen a decline of 1% in the last two months. It is reported that rentals in International City have remained the same, even though it has been a popular spot for subletting. However, Gulf News has also reported that recent leasing contracts for July in other areas have also seen a drop. The places that have seen some more favourable contracts are Jumeirah Village Circle (JVC) and Jumeirah Village Triangle (JVT) as well as in Arjan, Majan and The Greens. This has been the case since early July. If these trends continue in the coming weeks, this will be the first time since 2020 that rentals have dropped in multiple locations in Dubai. However, some Dubai rental prices are actually on the rise in areas like Dubai Silicon Oasis where new rent contracts show significant increases in the 5% to 10% range.
