Deadly I-35 pileup comes amid push to make it harder to sue trucking companies
AUSTIN (KXAN) — The arrest of a semi-truck driver in connection to Thursday night's deadly pileup comes a day after Lt. Gov. Dan Patrick laid out his priority list at the Capitol. Among them, two bills he describes as 'protecting Texas trucking' and 'curbing nuclear verdicts.'
The driver, Solomun Weldekeal Araya, 37, was charged with five counts of intoxication manslaughter with a vehicle and two counts of intoxication assault with vehicle involving serious bodily injury in connection with the crash, according to the Austin Police Department.
'Look, there's no greater tragedy than this,' said Austin attorney Adam Loewy reacting to the 17-vehicle crash on I-35 that killed a child, an infant and three adults and injured 11.
'You had a baby die because of this,' said Loewy. 'You had adults die because of this.'

Loewy, who is currently representing victims hurt in a different 18-wheeler crash in this same area a month ago, worries about families seeking accountability and justice.
Under Senate Bill 30 — what Patrick touted as 'curbing nuclear verdicts' — judges could have discretion to lower jury verdicts that are over $1 million in wrongful death cases and $250,000 in personal injury lawsuits.
'Texans for Lawsuit Reform, TLR, which has been a big player in Texas for about 30 years … once again filed a bill to try to make it more difficult than ever to hold 18-wheeler companies accountable,' Loewy said.
'I am hopeful that the legislature again rejects their efforts,' he added.
In a statement, TLR called the crash a 'horrible tragedy' but defended its push for more protections for the trucking industry.
'Bills filed in the Texas Legislature this session that TLR supports will not prevent anyone involved in this tragic collision from pursuing a lawsuit, recovering all that is entitled to them from the driver and the company that hired the driver, and even recovering damages to punish both the driver and company if appropriate,' said TLR President Lee Parsley.
'The bills, however, will prevent plaintiff lawyers from pursuing lawsuits that lack merit,' Parsley added, 'which will help alleviate congestion in our courts so that legitimate lawsuits can move forward quickly and in a fair environment.'
Deadly truck crash foreshadows fight between business, safety at Capitol
In 2021, lawmakers passed House Bill 19. It splits civil lawsuits against commercial vehicles into two trials, limiting what and when juries can hear certain information about a company.
Last October, KXAN spoke with the president of the Texas Trucking Association, which is part of the Lone Star Economic Alliance — a group backing efforts to expand lawsuit reform this legislative session.
'Your critics will say HB 19 and these other measures are meant to just protect and shield businesses over the expense of victims; what would you say to them?,' KXAN investigative reporter Matt Grant asked at the time.
'Sure, I'd say that the frivolous lawsuit environment is an absolute business for these attorneys that prey on business creators, job creators in this state,' said TTA President John Esparza.
Asked if felt the majority of lawsuits are frivolous, Esparza responded: 'A good number of them are.'
'They might have had a chance.' Widower pushing for truck safety devices
Houston Attorney Eric Allen disagrees.
His firm is representing the family of Tracy Rambosek, who was killed in Bell County last year by a truck driver allegedly texting at the time.
'The moral implications of limiting damages in the name of saving insurance dollars is repulsive and disgusting,' Allen said. 'You can't put a value on a human life, yet you're going to limit that value in the name of insurance premiums? You tried it with medical malpractice and insurance rates and medical bills are only higher.'
'The real reason that you do this is political,' he added. 'Always has been, always will be.'

Teen's Body Found in Beloved Lake as Deaths Pile Up
Authorities announced that a body has been found on a popular lake in Austin, TX, after a teenage boy went missing over the weekend. A spokesperson for the Austin Police Department said the teenager went missing Sunday when he and his family hopped on paddleboards and kayaks for a stroll on Lady Bird Lake, a popular summer destination for both locals and tourists. It's unclear when, but the teenage boy went missing. Authorities immediately launched a search and rescue effort, to no avail. Then, on Tuesday at around 7:45 a.m., a paddleboarder made the grim discovery when they spotted the body floating in the water near the intersection of West Riverside Drive and South Lamar have since said that the body discovered Tuesday morning was a teenage boy who investigators say was "unknowingly standing near an underwater shelf." Authorities believe the teenage boy slipped or fell off the underwater shelf, which authorities say is a sudden drop-off in the lake. Lady Bird Lake is a dammed section of the Colorado River. The artificial lake stretches more than five miles. While police have not yet positively identified the body recovered on Tuesday, they say the clothing matches the missing teenager's outfit. Police also said that the teenage boy's lifejacket and belongings were still on his kayak. According to data obtained by Fox 7, at least 38 bodies have been found in or around Lady Bird Lake since 2022. The outlet reports that, of those bodies found, 30 were male, and just over 60 percent were between 30 and 49 years old. Only two were teenagers, including the body discovered on Tuesday. In just the last three years, the cause of deaths for most of the bodies discovered on Lady Bird Lake have been attributed to accidental drownings, Fox 7 reports. Suicide, drug overdoses and natural causes are second on the list. Fox 7 also reports that only one case has been ruled a murder and some half a dozen cases remain emphasized that no foul play is suspected in Tuesday's discovery. Family detained in Hays County raid says no gang ties existed, expert questions tattoo evidence
AUSTIN (KXAN) — A Venezuelan father detained alongside his wife and two young children during a March immigration raid in Hays County maintains the family has no connection with the violent gang authorities claim they were targeting. The operation, which took place in the early morning hours of April 1, resulted in the apprehension of 47 people, including nine minors. Federal and state authorities alleged the gathering involved members and associates of Tren de Aragua, a Venezuelan gang that originated in prisons before expanding across Latin America. VIDEO: New look at operation leading to 40 people possibly linked to Venezuelan gang arrested in Hays County According to Texas Tribune reporter Alejandro Serrano, who interviewed the Venezuelan father, the family was celebrating birthdays at a rented house when law enforcement arrived with flashbang grenades around 5 a.m. 'He said they weren't given a reason,' Serrano told KXAN's Will DuPree. 'They were at a what he described, [as a] birthday party gathering, sort of a family and friends sort of event and in the early hours of April 1, the party was busted by a variety of law enforcement agencies.' The father told Serrano that immigration agents later questioned him about the tattoos on his shoulders, suggesting they indicated gang membership. The man disputed this claim, explaining the star-shaped tattoos were personal choices from his youth, unrelated to any criminal organization. Criminologists who study organized crime in Latin America question the use of tattoos as evidence of Tren de Aragua membership. Serrano spoke with two experts who research Venezuelan gangs. 'Venezuelan gangs, including Tren de Aragua, don't use tattoos as identifiers, as far as their research shows and other people's research that they pointed me to,' Serrano said. More than 40 people possibly linked with Venezuelan gang taken into custody in Hays County The Tribune's investigation found no criminal records for 35 of the individuals detained in the operation when their names were searched through federal, Travis County and Hays County court databases. Only two people from the raid face state charges related to drug possesion. The remaining detainees were arrested on suspicion of illegal entry to the United States. After 23 days in detention in Frio County, the Venezuelan family returned home wearing ankle monitors to discover significant consequences from their absence. Their landlord had issued an eviction notice, bills had accumulated and their 5-year-old son was expelled from school due to unexcused absences. 'They have removal orders, and they also have fear now that they described. They're kind of scared to do anything,' Serrano said. 'They left Venezuela because of persecution, so now they kind of describe being in this situation where they recognize they might be sent back.' The father maintains employment with two jobs and possesses legal work permits and Social Security documentation. The family has a pending asylum case but now faces deportation orders. The Hays County operation reflects a pattern of immigration enforcement under the Trump administration's invocation of the Alien Enemies Act of 1798 against Tren de Aragua. The wartime law allows for swift deportation of suspected gang members with limited legal recourse. More than 230 men accused of gang membership have been deported to a maximum security prison in El Salvador under this authority, though reports indicate few had documented histories of serious violent crimes. Federal agencies involved in the Hays County operation, including ICE, the Department of Homeland Security, and FBI, have not responded to requests for comment or provided evidence supporting their gang affiliation claims, according to the Tribune. The search warrant related to the operation contains limited information about authorities' prior knowledge, and a district court judge has sealed accompanying documents detailing the warrant request. Court challenges to the administration's deportation authority have emerged across multiple judicial districts, creating a patchwork of rulings that have largely blocked such expedited removals. The Supreme Court has ruled that detainees must receive proper opportunities to raise legal challenges, though it has not specified required procedures. As legal proceedings continue, the Venezuelan family remains in Austin, working to rebuild their lives while facing an uncertain immigration future and questioning why they were targeted in the first place. Texas Legislature passes bill protecting utility workers from assaults, harassment during disasters
AUSTIN (KXAN) — Those who would attack, harass or impede utility workers following a natural disaster will face enhanced criminal charges when a recently passed bill becomes law in September. Senate Bill 482 would apply higher charges to any person who, with 'criminal negligence,' 'interrupts, disrupts, impedes, or otherwise interferes' with utility workers performing their duties. The bill passed out of the Texas Legislature on May 20. These protections already apply to emergency services workers and their service animals, animal control workers and public health inspectors while they perform their duties. The law neatly adds utility workers to that list. Under Texas law, a misdemeanor assault against one of these workers gets enhanced to a third-degree felony. Also, charges of harassment or obstruction of public duties would also be enhanced under SB 482. 'This bill is bipartisan, pro-worker, and common sense,' said Texas AFL-CIO President Rick Levy in a press release. 'Our utility workers shouldn't be subject to threats and harassment on the job — no one should. These front-line workers deserve our respect and protection.' SB 482 author Sen. Carol Alvarado, D-Houston, cited incidents that occurred during recovery efforts after Hurricane Beryl as to why she filed the bill this session. 'In the wake of Hurricane Beryl, utility workers restoring power faced not only the physical challenges of repairing downed power lines but also alarming hostility from some members of the public,' she wrote in her statement of intent. 'These workers were met with harassment, verbal threats and, in some cases, physical assaults that put their safety at risk. They persisted in their essential work despite these dangers, highlighting the need for stronger legal protections for utility workers during emergencies.' AP: Anger over Houston power outages after Beryl has repair crews facing threats from some residents Hundreds of workers, including Austin Energy crews, responded to Houston following Beryl. Ed Allen, financial secretary for the Houston local of the International Brotherhood of Electrical Workers (IBEW 66), said the union's members 'went through hell' in the aftermath of Beryl. 'Our members went through hell following Hurricane Beryl — enduring threats and even assault — all while trying to get the power back on for folks,' said Allen in a press release. 'This is about safety. Our repair crews work tirelessly during natural disasters, and this bill will keep them a bit more protected.' Texas AFL-CIO Financial Secretary Leonard Aguilar said utility workers were assaulted, and some had guns pointed at them by residents. 'It took a while for the power to come back on, no fault of IBEW local 66, it was just, it was such a large area that had to have power restored. The people were getting upset, and rightfully so, but they didn't have to take it out on those workers that were out there every day, basically 24 hours a day,' he said. 'Just many different ways of just being difficult with the workers and making it difficult for them to do their jobs.' Workers restored power to 98% of Houston after 10 days, according to electric company CenterPoint Energy. That outpaced recovery efforts following Hurricane Ike in 2008; power was restored to only 74% of customers by the 10-day mark. No one testified against the bill when it was in the Texas Senate's Criminal Justice Committee, according to legislative records. Representatives from utility companies and labor unions testified alongside each other in support of the bill. The bill ultimately passed 30-1 in the Texas Senate and 130-16 in the Texas House of Representatives — Aguilar said this is what's necessary to help keep Texas' workers safe. 'This is the way it's supposed to be done across the street at the Texas Capitol. This should be an example of how we should be moving forward to protect workers,' Aguilar said. Aguilar also said the bill is a good step towards protecting Texas' workers, but that more is needed as the state can be 'difficult' for workers. 'Workers are putting it on the line, day in and day out; not just during disasters, but just when they wake up every day to go to work. Texas is a difficult state to work in,' he said. 'We have to do better as a state to make sure we are protecting the workers. Without the workers, we can't keep the state running.' The bill is now before Texas Gov. Greg Abbott.
