Rahul Gandhi's lawyer fears ‘harm to Congress leader', later makes U-turn

THE LAWYER representing Congress leader Rahul Gandhi in the criminal defamation case filed by Satyaki Savarkar, the grandnephew of Hindutva ideologue V D Savarkar, on Wednesday submitted a pursis in the Pune court hearing the case, but later made a U-turn, saying he had filed the application without consulting Rahul. The pursis stated that there was 'substantial apprehension that Rahul Gandhi may face harm' in light of his current political stand and Satyeki's 'lineage from Nathuram Godse'.
On Wednesday, lawyer Milind Pawar, who is representing Rahul, filed the pursis, which is a formal written submission placed before court. Pawar had earlier said the court had admitted the pursis after he filed it in the afternoon.
'Rahul Gandhi has condemned the present government by raising the slogan 'Vote Chor Sarkar'. He has produced documentary evidence alleging serious electoral irregularities, directly implicating the Election Commission in actions which, by their very nature, provoke hostility from those whose political power and ideological interests stand challenged. The apprehension of harm to Rahul Gandhi is neither abstract nor unfounded. In light of the documented history of violent and anti-constitutional tendencies linked to the complainant's lineage, and considering the prevailing political climate, there exists a clear, reasonable, and substantial apprehension that Rahul Gandhi may face harm, wrongful implication, or other forms of targeting by persons subscribing to the ideology of Vinayak Damodar Savarkar,' it stated.
'Prudence demands that this apprehension be placed on record at this stage. The complainant himself has asserted descent from the associates of Mahatma Gandhi's assassins. In view of the grave history associated with such lineage, the defence harbours a genuine and reasonable apprehension that history must not be permitted to repeat itself,' it stated.
However, in the evening, Pawar issued a press statement, 'The pursis dated August 13 was filed by me in the court without instructions from the client. The contents of the pursis were drafted by me without consulting my client Rahul Gandhi. My client has taken strong exception to filing of this pursis and has expressed his disagreement with the contents. I shall file a formal application tomorrow for withdrawal of the said pursis before the court.'
When contacted earlier after the pursis was filed, Satyaki Savarkar had said, 'The statements made by defence in the pursis are completely baseless and appalling. They have claimed apprehension of harm to Rahul Gandhi which is baseless because he has been exempted from physically attending the proceedings. The defence has been filing such frivolous applications and pursis every now and then and are trying to delay the entire case.'
Meanwhile on Wednesday Satyaki Savarkar's lawyer Sangram Kolhatkar moved the court seeking action against Rahul alleging he had committed perjury. 'In the past, all relevant documents have been duly provided to the advocate representing the accused, who has acknowledged the receipt. Despite this, the accused is now falsely claiming that no such material was received. This is a clear attempt to mislead the court. We therefore urge the court, in the strongest terms, to initiate appropriate action against the accused for this deliberate misrepresentation and committing perjury,' Kolhatkar said.

The CEO has asked him to hand over the form to the BLO concerned, who already stands exposed for a goof-up, the Left leader asserted. "He (the BLO) has confessed to his mistake and told the CEO that Mintu's name got struck off instead of another person," said Kunal. If the BLO spoke the truth, the name of the dead person must be there on the draft electoral rolls, the CPI(ML)-L secretary said, adding that Mintu is being made to run from pillar to post because of this "comedy of errors". Replying to a query from journalists, he said, "We have identified altogether 21 people, so far, who have been wrongfully declared dead, leading to deletion of their names. Of them, 10 were produced before the Supreme Court. He added that the apex court was convinced of the mistake in only two instances - one was of Mintu and the other was that of a woman in Raghopur. Incidentally, Raghopur is the assembly seat of the leader of the opposition Tejashwi Yadav, whose party RJD is an alliance partner of the Left. "We do not know how effective the intervention by the Supreme Court is going to be. The Election Commission has been brazening it out, falsely claiming that political parties are not coming up with any claims or objections. We shall keep helping as many people as possible in getting their names included in the voters' list," Kunal said.

Pawar moved the application before the special MP-MLA court, seeking permission to withdraw the pursis, even though the matter was not listed for hearing that day. His plea read: 'The present case is pending before the court and is fixed for hearing on September 10. Today, the defence intends to file withdrawal pursis dated August 13 in this case. However, the said matter is not on today's board. It is respectfully prayed that this matter be kindly taken on board today in the interest of justice.' The submission concluded: 'The pursis is hereby withdrawn as not pressed at this stage.' After filing the withdrawal on Wednesday, Pawar issued a press statement in the evening acknowledging that the original pursis had been filed without Gandhi's approval. 'The contents of the 'pursis' were drafted by me without consulting my client Shri Rahul Gandhi. My client has taken strong exception to the filing and expressed disagreement with its contents,' the statement read. The now-withdrawn application had referred to complainant Satyaki Savarkar's familial relationship to Nathuram Godse and Gopal Godse, both accused in the assassination of Mahatma Gandhi. It also cited Gandhi's constitutional role as Leader of Opposition, his press conferences alleging electoral malpractice by the Election Commission of India (ECI), and his recent parliamentary exchanges with the Prime Minister on Hindutva. It argued that these factors, coupled with the complainant's ideological affiliations, gave rise to a reasonable apprehension of danger to Gandhi. 'In light of the documented history of violent and anti-constitutional tendencies linked to the complainant's lineage, and considering the prevailing political climate, there exists a clear, reasonable and substantial apprehension that Rahul Gandhi may face harm, wrongful implication, or other forms of targeting by persons subscribing to the ideology of Vinayak Damodar Savarkar,' the pursis stated. The recent increase in life tax on vehicles effected by the State Government is nothing short of a ruthless blow to the poor and middle-class families of Telangana, former minister and Bharat Rashtra Samithi (BRS) leader T. Harish Rao has said. Condemning the government decision, Mr. Rao accused the government of exploiting people through oppressive taxation policies. He said Chief Minister A. Revanth Reddy had proved his deputy M. Bhatti Vikramarka's words right that the Congress had immense experience in collecting revenue by turning this experience into a burden on the common man. Without any justification, the Congress Government had issued GOs 53 and 54 increasing life tax on new vehicles and squeezing the poor and middle class under additional financial pressure. Purchasing even a two-wheeler costs over ₹1 lakh in the present day. Farmers, small traders and daily wage workers depend on these vehicles for livelihood and raising the life tax from 12% to 15% on two-wheelers above ₹1 lakh is nothing but extortion, the BRS leader said. For instance, if a two-wheeler's showroom price is ₹1.10 lakh, the previous tax was ₹13,200 and with the hike it would become ₹16,500 – an additional burden of ₹3,200 per two-wheelerke. Across Telangana, this life tax hike would extract over ₹1,000 crore from the people. Owning a car is an aspiration for many families and most middle-class buyers rely on loans to fulfil this dream. But the Congress Government had shattered those hopes as cars priced between ₹10-₹20 lakh would not attract 18% life tax, up from 17%. resulting in an extra burden of nearly ₹20,000 per vehicle. For vehicles priced above ₹20 lakh and ₹50 lakh, the life tax was been raised by 2% and 3%, respectively, burdening more households. The government didn't stop there and increased taxes on commercial vehicles too from 20% to 22% for vehicles costing above ₹20 lakh and up to 25% for those over ₹50 lakh. Ultimately, this tax burden would be passed on to the market and affect the general public through increased prices of goods and services. In addition, the Congress government is handing over road management under the HAM (Hybrid Annuity Model) to private companies for 15–20 years. To fund this model through loans, the government is quietly increasing taxes as a backdoor way to loot people under the pretext of development, Mr. Rao added.
