
‘Bosses must send foreign workers off'
In a statement yesterday, Saifuddin Nasution said the decision was made following a joint committee meeting between the Home Ministry and the Human Resources Ministry.
'We agreed with the recommendation by the Immigration Department to strengthen the management of the Check Out Memo for foreign workers.
'With today's agreement, employers are now required to be present at the international exit points to manage the exit registration of foreign workers, just as they are required to manage the entry of foreign workers.
'Employers who fail to comply with this requirement could face restrictions on new quota applications and other immigration-related procedures,' he added.
Saifuddin Nasution also said the meeting yesterday allowed foreign workers to submit applications to change employers to take up jobs in different sectors.

'Previously, the government only allowed changes for foreign workers within the same employment sector, subject to conditions such as company restructuring, company closure, company expansion, or approval from a committee managed by the Labour Department.
'With this new decision, employers are allowed to apply for foreign worker transfer across different employment sectors. This policy change will bring various benefits not only to the government but also to employers and foreign workers.
'It reflects a good practice recommended by international labour organisations and has already been adopted by developed countries,' he said.
He added that all parties must take note and comply with the new regulations related to the employment of foreign workers.

He said the amendment involving Sections 507B to 507G of the Penal Code strengthened the legal provisions against acts of bullying. Saifuddin Nasution said since the amendment to Section 507 of the Penal Code was enforced and gazetted on July 11, police had opened 11 investigation papers related to bullying. Advertisement 'These investigation papers fall under Sections 507B, 507C and so on. This shows that the strengthening of the law has enabled the police to take action. 'Now, in the case of Zara, for example, in which the accused were charged on Wednesday, it is under one of the amended sections, making this the first case we have prosecuted (since the amendment),' he said when winding up the debate on the 13th Malaysia Plan (13MP) for the Home Ministry in the Dewan Rakyat. He was responding to a supplementary question from Syed Saddiq Syed Abdul Rahman (Muda-Muar), who raised the issue of the police's allegedly slow response in investigating bullying cases, including a recent case in Johor. The Penal Code (Amendment) 2025 Act and the Criminal Procedure Code (Amendment) 2025 Act, aimed at addressing bullying more effectively and comprehensively, including cyberbullying, were passed in the Dewan Rakyat on Dec 10, 2024, and in the Dewan Negara on Dec 16 the same year. Earlier Wednesday, five teenage girls were charged in the Children's Court in Kota Kinabalu, Sabah, with using insulting words against Zara Qairina. The charges were framed under Section 507C(1) of the Penal Code, read together with Section 34 of the Code, which carries a penalty of up to one year's imprisonment, or a fine, or both, upon conviction. In line with this legal development, Saifuddin Nasution said the Ministry wanted the police to act swiftly in investigating every reported case of bullying. At the same time, he reminded all parties not to play up sentiments or create inaccurate impressions as though there was an attempt to protect any individual or cover up matters. 'When I reviewed the chronology and sequence of the police investigation, with the large number of witness statements taken in detail, I also felt sad that, with all the police's diligence, simply because of one part where the police were said to have failed, (which was) to conduct a post-mortem. Aug 4 was the first time the police submitted the investigation papers to the AG (Attorney General), and on Aug 3, Zara's mother had lodged a police report after noticing bruises while bathing Zara's body. So at the same time, in the investigation papers submitted to the AG, we recommended that Zara's grave be exhumed,' he said. Increasing retirement age will balance with providing opportunities for youth
KUALA LUMPUR: The Human Resources Ministry has assured that any review of the retirement age will strike a balance between retaining an experienced workforce and creating opportunities for the younger generation. Its minister Steven Sim said several factors must be taken into account in developing a long-term framework, including Malaysians' rising life expectancy, the health and productivity levels of older workers, national labour demand, and the youth unemployment rate. "The Ministry also considers the long-term impact on youth employment, ensuring that any policy change will not add further pressure to the national labour market. "The main focus is to maintain a balance between retaining experienced workers and providing opportunities for the younger generation to secure jobs suited to their qualifications," he said in a written parliamentary reply. Sim said the retirement age set under the Minimum Retirement Age Act 2012 is 60, which represents the minimum age at which an employee may retire. "However, the Act does not prevent employers from hiring workers above the age of 60 or extending their employment," he said. He was responding to Riduan Rubin (Independent–Tenom), who asked about the empirical rationale and long-term policy framework behind the ministry's review of the retirement age, to ensure it does not increase pressure on youth employment opportunities or leave a highly educated younger generation without suitable jobs. On May 23, Sim said the issue of retirement age is among 28 labour laws under the purview of the ministry currently undergoing review, reforms and updates. He said the matter was being considered carefully, taking into account the suitability of any changes in the Malaysian context, as there are both pros and cons to raising the retirement age.

Malaysia expands skills certification to level 8 to elevate TVET pathway
KUALA LUMPUR: The Human Resources Ministry is expanding the Malaysian Skills Certification System to include levels six, seven and eight beyond the current levels one to five. Minister Steven Sim stated this expansion will be achieved through amendments to the National Skills Development Act 2006. 'It aims to elevate Technical and Vocational Education and Training as a pathway that is equal and balanced with the academic pathway in the country's higher education system,' he said during his winding-up speech on the 13th Malaysia Plan in the Dewan Rakyat. Sim highlighted the significant increase in Sijil Pelajaran Malaysia leavers enrolling in TVET programmes, rising from 31.3% in 2020 to 53.6% in 2024. TVET graduate employability also improved remarkably from 87% to 95.6% during the same period. 'In tandem with this, allocations for TVET development have also been strengthened, from 5.9 billion ringgit in 2020 to 7.5 billion ringgit in 2024, proving the government's commitment in elevating TVET as a key pillar of the nation's human capital development,' he said. Regarding the Skills Development Fund Corporation becoming the sole manager of TVET financing schemes, Sim confirmed the agency can finance courses in all institutions registered with the Department of Skills Development. 'This year, 480 million ringgit has been allocated for the scheme,' he said. KESUMA is also improving the Skills Development Fund Corporation Act 2004 to allow financing for skills courses beyond DSD accreditation. 'For example, courses by Microsoft, OSH courses, accreditation by domestic bodies such as the Energy Commission, and international bodies such as the American Welding Society, among others,' he explained. 'With this enhancement, PTPK will certainly play the role of a national TVET fund as proposed,' Sim added. Sim also announced the Gig Workers Bill 2025 will be tabled next week to protect over one million gig economy workers. Nearly 40 engagement sessions with almost 4,000 stakeholders informed the bill's preparation, including 500 online feedback submissions. – Bernama
