After the two men started to argue, police said Gilbert drew a black handgun and fired one round.
The victim was not struck, as he ducked to avoid the shot. The bullet hit an exterior cooler and penetrated a wall, according to DeLand police.
Officers said surveillance video captured the incident and Gilbert fleeing the scene in a tan 1999 Nissan Quest van.
Investigators spoke with witnesses and the victim, who identified Gilbert through a photo lineup.
Law enforcement officers found Gilbert on Sunday morning in Daytona Beach.

Body of missing teen found in Florida after he texted mom for help

TAMPA, Fla. (WFLA / WNCN) —A body found near a Florida retention pond is confirmed to be that of a teenager who went missing last week while visiting family. According to the Manatee County Sheriff's Office, preliminary evidence collected from the scene has identified the body as 18-year-old Giovanni Pelletier. The teen's family also confirmed the identification on social media. Pelletier, of Fuquay-Varina, North Carolina, was last seen walking away from a vehicle along Interstate 75 in Manatee County on Aug. 1, prompting a statewide search for the teen. On Friday, law enforcement located the body in a retention pond at the southbound off-ramp of I-75 and State Road 70. Pelletier was visiting Florida to meet up with 'his father's side of the family,' Jeremy Brown, the teen's stepfather, told Nexstar's WFLA. He was excited to go, but texted his mother, Bridgette Pelletier, shortly after leaving with his cousins. 'He was picked up by three cousins that came from Mims, [Florida],' volunteer and licensed private investigator Shelley Croft explained to WFLA while the search for Pelletier was ongoing. 'He wanted to kind of get to know that side of the family that he does not know. They had only communicated via text messages and FaceTime calls. They came down here to Englewood, picked him up, and 21 minutes after he left the home, he sent his mom a text message that said 'Mom help me.'' Those cousins told Charlotte County deputies that as they were heading north on Interstate 75, Giovanni began acting erratically before getting out of the car and walking away. They said this happened in the area near State Road 70 in Manatee County. Later that night, Giovanni texted his mother and other family members. His cellphone and backpack were ultimately located in the same area he had last been seen. 'I am living every parent's worst nightmare, trying to find the strength to give him the goodbye he deserves,' Bridgette wrote on Facebook, according to Nexstar's WNCN. An autopsy is scheduled for Sunday. The cause of death is still unknown.

VIDEO: Powerball jackpot winner tackled, tased after kicking Pinellas deputy

ST. PETE BEACH, Fla. (WFLA) — Newly released video showed exactly what happened as a new Powerball jackpot winner from Kentucky got a bad run-in with Pinellas County deputies last April. According to an arrest affidavit, James Farthing, 50, of Georgetown, Kentucky, was at the Island Grand at Tradewinds when he got into a fight with another man on April 29. Cause of death revealed for Brandon Blackstock, ex-husband of Kelly Clarkson: report Body cam video showed a deputy rushing to separate the two men, restraining the other combatant. That's when Farthing tried to kick the other man, only to kick the deputy in the face instead, the Pinellas County Sheriff's Office said. 'Are you kidding me?!' the deputy shouted as Tradewinds staff pushed Farthing away from him. After handcuffing the other combatant, who was not charged in the incident, the deputy got up and approached Farthing, ordering him to get up against the wall. 'Put your hands behind your back, and get against the f—– wall!' Farthing initially followed the deputy's orders, but when the deputy pushed the man toward the wall, he stumbled and then tried to flee from law enforcement. However, his escape attempt was short-lived as the deputy began deploying his taser while another deputy tackled the screaming shirtless man to the ground. After being restrained, Farthing tried to apologize to the deputy. 'I'm sorry!' he said. 'Save your f—— sorries for later!' the deputy shouted back. Farthing, who won and split the $167.3 million Powerball jackpot prize with his mother on April 28, was charged with resisting an officer without violence, battery on a law enforcement officer, battery, and parole violation. His 42-year-old girlfriend, who told deputies her name was Jacqueline Fightmaster, was charged with disorderly intoxication. Court records show that Farthing pleaded not guilty to the alleged crimes and had a pretrial hearing set on Aug. 11. Copyright 2025 Nexstar Media, Inc. All rights reserved. Fiery Florida crash leaves 1 teen dead, 3 injured; 17-year-old charged

SUMTER COUNTY, Fla. (WFLA) — One teenager is dead, three more are injured, and one is facing felony charges after a fiery crash in Sumter County, the Florida Highway Patrol said. On Monday afternoon, a Dodge Charger was traveling south on I-75 'recklessly and at a high rate of speed.' The driver was a 17-year-old boy from Inverness, and there were four boys in the car with him, ages 13, 15, 16 and 17. FHP said the driver was attempting to overtake slower traffic, swerved to avoid a collision, and went off the road. The Dodge struck a tree on the side of the highway and erupted in flames, after which the driver got out of the car, removed the license plate, and fled on foot. Troopers and Sumter County Sheriff's deputies tracked him to a chicken coop on a nearby property and took him into custody. All four passengers and the driver suffered injuries in the crash and were taken to local hospitals, where one, a 16-year-old, later died. The driver and two other passengers suffered minor injuries, and the fifth passenger suffered serious injuries, FHP said. The teen driver has been charged with multiple felonies, including vehicular homicide and leaving the scene of a crash involving death. Copyright 2025 Nexstar Media, Inc. All rights reserved.
