Eviction rates in Pierce County are on the rise again after a lull during the pandemic when renter protections were in place, court records show, rising to the highest level since 2018.
A year after Tacoma residents narrowly approved some of the most comprehensive renter protections in the Pacific Northwest, it's hard to tell if those protections have impacted the Pierce County eviction rate significantly. The county doesn't track eviction filing data by city or address. A group of tenant and landlord advocates is working to analyze Initiative 1's impacts on tenants and landlords, with results expected later this year.
Pierce County landlords filed 3,366 unlawful detainer cases in 2024 as of Dec. 10. That number was 2,862 in 2023; 1,981 in 2022; 535 in 2021; 717 in 2020; 2,641 in 2019 and 3,026 in 2018, according to data collected by the Pierce County Superior Court Clerk's Office. A breakdown of the data by month shows the rate of eviction filings rose almost every month of 2024.
Housing providers were on track to file more evictions last year than any other time in state history, according to the Eviction Research Network, which analyzed data collected between January and November 2024.
Supporters of Tacoma for All's Initiative 1, also referred to as the 'Tenant Bill of Rights' or the 'Landlord Fairness Code,' said without city-specific data it's hard to measure the initiative's impacts. Anecdotally, Lauren Romero, a contract attorney for Tacoma for All's new Tenant Legal Aid initiative, said the measure has helped her clients stay in their homes longer and encouraged more tenants to work with their landlords to resolve issues rather than go through eviction proceedings.
Some local housing providers and property managers said the measure harmed small landlords financially and encouraged more to leave the market or raise rents to stay profitable.
Both tenant advocates and property managers agreed that government officials need to find more comprehensive solutions to address the affordable-housing crisis in Pierce County and rising rates of homelessness. They cited government-funded rental assistance as one such solution.
As of July 1, 2024, Pierce County had a population of 928,696, according to the most recent census. Of the 375,765 housing units in Pierce County, 64.8% of them were occupied by home owners and 35.2% were occupied by renters between 2019 and 2023. The average cost of rental housing was $1,941 a month in 2024, according to the Zillow Observed Rent Index.
About 44% of the 222,906 people living in Tacoma live in rental housing, according to the census. The average price of rental housing in Tacoma was $1,739 in a month as of 2024, according to the Zillow Observed Rent Index.
Based on population, there are about 326,975 peeple living in rental housing in Pierce County and 98,079 in Tacoma. Renters in Tacoma make up about 30% of those living in rental housing in the county.
As previously reported by The News Tribune, at least 111,511 new units of housing need to be built in Pierce County by 2044 to keep up with population growth. Tacoma needs at least 46% more housing by 2044, and there is an acute need for affordable housing for moderate, low, very low and extremely low-income households, as well as emergency housing, emergency shelters and permanent supportive housing.
County-wide 37% of all households are cost-burdened or extremely cost-burdened, meaning residents spend more than 30% of their income on housing, according to Pierce County data. That's one of the highest percentages in the state, on par with King County.
Shortly after Initiative 1 passed in November 2023, the late News Tribune columnist and opinion editor Matt Driscoll and Michael Mirra, who led the Tacoma Housing Authority for 17 years, came together to form study group to examine the impacts of the measure. A group of about 19 volunteers — including Tacoma for All members, landlord representatives, Tacoma Housing Authority, lawyers, a faculty member of UW Tacoma, city staff and county staff — has continued to meet regularly, Mirra said.
The group's goal is to gather information about how Initiation 1 has impacted tenants and local landlords, investor portfolios and housing development, he said. Two surveys — one for tenants and one for landlords and developers — are expected to be available to the public in the next couple of weeks, Mirra said.
Per the city of Tacoma's charter, the City Council cannot amend or repeal an ordinance enacted by the vote of the people for two years after it passes. The main goal of the study group is to gather data and provide information to the council when it discusses keeping or modifying the ordinance later this fall, Mirra said.
'The ordinance is a notable change in the rules governing our residential rental market,' he said. 'There are a lot of interests entwined in those changes — from tenants, who the ordinance protects from evictions. Those who share the landlords' interest in evicting troublesome neighbors, more and more who are prohibited from evicting people for not paying the rent for almost half the year, in an ordinance that makes no distinction between inability to pay and unwillingness to pay.'
The group's progress was slowed when Driscoll passed away unexpectedly in July 2024 and the original UW faculty member left the project due to health issues, Mirra said. The surveys had been expected to go out in October, he said. Other challenges for the group have been a lack of funding and finding and analyzing data on evictions filed within Tacoma city limits.
'We're hoping the survey will round out what we are hearing' anecdotally about Initiative 1's impacts, Mirra said.
Housing providers and tenant advocates say there are many reasons the Pierce County eviction rate is rising. Among them is the gradual lifting of state and local pandemic protections, the supply of housing not keeping up with demand and more people being unable to afford rent.
Romero has a background in civil legal aid and eviction defense and works to help Tacoma tenants fight evictions. She worked on cases in Pierce County and unincorporated areas from September 2022 through April 2024.
In the fall of 2022, Romero said, she knew a wave of evictions was coming because wages were stagnating, tenant protections and moratoriums put in place during the COVID-19 pandemic were being lifted, stimulus checks were ending and many landlords were waiting to evict.
'Everybody knew it was coming,' Romero said. 'We just had a tidal wave of evictions.'
Romero said protections listed in Initiative 1 — like bans on winter and school year evictions from November through April and relocation assistance for rent increases of 5% or more — have leveled the power imbalance between Tacoma landlords and tenants and encouraged more private attorneys to take on eviction cases. Romero said she didn't expect the initiative to meaningfully change the eviction rate county-wide.
'There was a significant slowdown of [filings in] Tacoma city limits specifically. But then Pierce County at large was around the same rate that we had been seeing,' she said. 'It's really sad you can't get Tacoma-specific numbers.'
Zev Cook, who helped lead Tacoma for All's grassroots campaign to pass Initiative 1, said it was never the organization's goal to stop evictions 'on any meaningful level' but rather delay evictions for residents living in the most 'critical circumstances' and build a housing-justice movement that focuses on tenants.
Cook said although Tacoma tenants now have more protections against eviction and access to relocation assistance in some cases, meaningful change in Pierce County can't happen 'until we have a housing policy in Washington state that puts people and affordability first.'
As housing prices and rent increase in Washington, like many other places in the nation, Cook said salaries aren't keeping up and housing policy often favors for-profit developers who want to turn a profit by increasing rent. According to the city of Tacoma, roughly 77% of the jobs in Tacoma don't pay enough for a single worker to be able to comfortably afford housing on their own.
'We can pass these middle housing bills that open up development restrictions. I think that more density is generally a good thing. But the fact is, these policies and middle-housing bills and opening up zoning isn't going to solve the housing crisis and isn't going to result in the amount of housing that we really need built in the state of Washington,' Cook said. 'There's a long road ahead to being able to fight for and win housing as a human right for all Tacomans and Washingtonians. That's something that we are committed to.'
Sean Flynn is executive director and board president of the Rental Housing Association of Washington. Flynn argues measures like Initiative 1 worsen the housing crisis in Pierce County because they don't promote the development of new housing units or provide direct rental assistance to tenants. Instead, Flynn said, as a result of restrictions on landlords, more builders are deciding not to build in places like Tacoma, which in turn will decrease supply and increase prices.
'If you want people to stay in their housing unit, you need to help them either find the proper housing unit for them to be in, or you need to subsidize their rent,' he said. 'Most people don't pay their rent because they don't have the money. It's not rocket science. If you have the money, you pay the rent. Making it harder to evict them doesn't change the fact that they don't have the money.'
Flynn pushed back on the 'unfair, frankly unfounded and mean' narrative that housing providers are plotting to evict people, saying that no landlord wants to go through the process of hiring a lawyer and evicting a tenant. Housing providers are constantly trying to reduce risk and want to find tenants who are responsible and can pay their rent on time so the landlord can pay their own mortgages, taxes and bills, he said.
Most of the 6,000 statewide members of the Washington Rental Housing Association are small housing providers who live within 30 minutes of their units, Flynn said. Although landlords have good relationships and outcomes with their tenants in a 'super majority' of cases, Flynn said, the risk of being stuck with a bad tenant who isn't paying rent for months and treats the property poorly can be enough to motivate small landlords to leave the market altogether.
'I passionately believe that small housing providers add to the fabric of our cities and communities and to the state of Washington as a whole, that we shouldn't just have large pension funds providing housing in our state,' he said. 'The more risk that we put on our small housing providers, the more that leave, that gap in the market either doesn't get filled or is filled by large [corporations].'
Corey Hjalseth lives in Tacoma and rents out three single-family residences and a detached accessory dwelling unit on his property. A life-long Democrat, Hjalseth said he sympathizes with seniors on a fixed income and people who can't pay their rent but said that shouldn't come 'on the backs of independent housing providers to help them.'
Under Initiative 1, Tacoma landlords must provide relocation assistance to tenants who would rather relocate than pay a 5% rent increase. If a notified rent increase is over 7.5%, landlords must pay relocation assistance equal to two and a half months of rent. If the rent increase is over 10%, the landlord must pay the tenant three months of rent to relocate.
Hjalseth said although he and his wife bought their properties as an investment for their retirement, he tries to keep rent slightly below market rate. In order to reduce risk and ensure he can make a profit, Hjalseth said, he's had to raise rent by 4.5% each year. Since Initiative 1 passed, Hjalseth said, he's known of small housing providers who have sold their rental units rather than take on the risk, removing the units from the rental market and contributing to higher home prices. It's something he's considering, too.
'This is one of the states in the country that has skyrocketed in housing, both to purchase and to rent, and so we do have a problem,' he said. 'It's a supply-and-demand issue. And I applaud our new governor's focus on wanting to build [200,000] homes over the next four years — I think that's a great start. Trying to streamline local permit bureaucracy so that we can get builders building way faster, that's also a great start. But to artificially cap rents and have small, independent housing providers bear the brunt of that is not only unfair, but it's been proven economically to not work.'
Studies into the effectiveness of capping rental prices have shown that rent control appears to help affordability and reduce displacement for current tenants in the short run, but in the long run it can decrease affordability, fuel gentrification and result in other negative consequences on the surrounding neighborhoods, according to a 2018 Brookings research article. Brookings is a nonprofit organization that conducts in-depth, nonpartisan research to improve policy and governance. Tenants who live in rent-controlled apartments might not choose to move in the future despite changes in their household size, and landlords might not invest in maintenance because they can't recoup investment costs by raising rents, the article said.
Both Flynn and Hjalseth said government-sponsored housing vouchers to help tenants afford rent could be a better solution. Broker, property manager and chair of the Tacoma Housing Authority's Landlord Advisory Board Mark Melsness told The News Tribune he agrees.
Melsness said he has been involved in the Tacoma-Pierce County rental industry for more than 30 years, and his company Spinnaker Property Management oversees more than 1,000 homes, a variety of apartments and houses with rents ranging from $890 to $6,000 a month.
Since the passage of Initiative 1, Melsness said, anecdotally he's seen more Tacoma tenants be denied housing as landlords put greater scrutiny on rental applications in an effort to reduce risk. Melsness said he's also heard the rare story of tenants going months without paying rent, leaving their landlord unable to evict them based on the limitations in Initiative 1.
Those who can't pay rent not only end up with poor credit history but might end up owing money to a collection agency, both of which could make it harder to find housing in the future, Melsness said.
'Let's keep people in housing. Let's find a way to keep them in housing because it's cheaper than it is to cycle them back out into rapid rehousing,' he said. 'I think [Tacoma for All and landlords] want the same thing. We want to have great balance, so that the renter knows it's going to be safe and it's going to be clean and maintained and that if there's a problem, it's taken care of, and the housing provider is getting paid on time, and if there's an issue, it's reported and damages aren't continued.'

Organizers say they are asking the courts to put the initiative on the ballot in November. What they're saying They accuse city and county leaders of using a loophole and dragging their feet to prevent it from going before the voters in November. "I have a 29-year-old daughter, and she can't move away from home because she can't make enough money," said Aria Joslyn, member of UFCW 367 and a long-time Tacoma resident. Joslyn works as a cashier and was one of the workers rallying at Tacoma City Hall on Tuesday in support of a worker's bill of rights that was supposed to be on the ballot in November. "It holds the employers accountable for making sure that hours stay stable," said Joslyn. Supporters say Initiative 2 would have raised the minimum wage to $20 an hour, and required employers to give around two weeks notice prior to scheduling changes. They now accuse city and county officials of dragging their feet for so long, it won't make it on the ballot. "Essentially, the city council ran out the clock using an obscure legal loophole, and this is not in keeping with the spirit of democracy," said Ann Dorn, Chair of Tacoma for All. Timeline The group says in the lawsuit that they filed the signatures on June 24. But, they allege the county auditor didn't begin validating them until around two weeks later, July 7. After that, they say the Tacoma City Clerk took another day to validate it and send it to the city council. From there, organizers say the city council didn't take action until August 8, and according to the county auditor, that was three days too late. "They ran out the clock and kicked it down the road to February if we are lucky," said Michael Hines, President of UFCW Local 367. This is an excerpt from the complaint that was filed with the courts: "The County Auditor rejected Resolution 41733 for being three days too late to send a measure to the 2025 ballot, pursuant to RCW 29A.04.330(3). See Exhibit B (Resolution 41733, with rejection stamp). However, this timing was the direct result of Pierce County's failure to promptly validate the petition. "It is uncontested that Plaintiffs submitted sufficient signatures on June 24th, but the County Auditor did not begin the validation process until July 7th. It completed that process in two days, and then there were further delays at the City Level. It is fundamentally unfair, and contrary to statutory requirements, for local government to delay the processing of an initiative and to use that delay to deny ballot access." The mayor has expressed concern about the initiative at city council meetings, including the impact on non-profits, saying this during a special meeting on August 8th. "While we have the obligation to forward to the auditors' office, I still have deep concern about its passing and its unanticipated effects on all of those who live in the community," said Tacoma Mayor Victoria Woodards. The council did adopt a resolution Tuesday to appoint a 15-member task force to look at Tacoma's labor standards. It's something the mayor supports. It's also something that concerns Hines. "I think it's a ruse to put something competing on the ballot," said Hines. FOX 13 has reached out to the city council office for comment on the lawsuit, and we are waiting to hear back. DuPage to establish community land bank, trust to incentivize more affordable housing

More than two years after forming an ad hoc committee to augment affordable housing, DuPage County is taking a new approach to incentivizing low-cost development. The county is establishing a land bank. Authorized by the DuPage County Board last month, it will essentially put county-owned surplus land on reserve for future affordable housing projects. With DuPage being a virtually built-out county, the idea is to carve out space for more local affordable units by breathing new life into underutilized properties, county staff and officials say. 'People that work in DuPage and contribute to our economic stability (being) able to afford to live and raise their families here seems like it should be a fundamental right, but it's something that we're struggling with,' DuPage County Board Chair Deb Conroy said. 'We want to fix it.' The average median household income in DuPage County as of 2023 was $106,961, according to census data. Meanwhile, as of last month, the median sale price of a home in DuPage was $425,000, per data from Redfin, a national real estate brokerage. As for renters, the typical cost of rent in DuPage County in May was $2,113 a month, a 5.1% year-over-year increase, according to the Zillow Observed Rent Index, which measures changes in asking rents over time. Land banks have existed for a long time, said Paul Hoss, the county's planning and zoning administration coordinator. The concept just hasn't been implemented in DuPage before. The county is, however, uniquely primed to see the idea through. For years, DuPage has been building an inventory of county-owned property through its standing 'Neighborhood Revitalization Program,' which seeks to repair or remove dilapidated or abandoned buildings in unincorporated areas. Through the program, the owner of property in disrepair is given the chance to address issues on their own. If they don't, the county tackles the work and bills the property owner. If the owner abandons the property, the county puts a lien on it. Should that lien go unsatisfied, the county can seek to foreclose and could acquire the property as collateral for the unpaid lien. Alternatively, the county is sometimes just gifted dilapidated property through the program. Either way, DuPage has been able to accrue a 'de facto' inventory of property that can now act as a starting point for a land bank, Hoss said. Not stopping there, the county — hand in hand with establishing a land bank — will also be seeking to partner with a nonprofit community land trust (CLT), per board action taken last month. A community land trust is a similar mechanism to a land bank but instead of property, the CLT manages funds that can be loaned out to developers or property owners for the purpose of developing a certain type of housing that a government is looking for, Hoss said. The board has directed staff to prepare a request for qualifications to seek out a CLT. Both the CLT and land bank are the product of a recent effort to ramp up affordable and attainable housing throughout the county. In March 2023, Conroy established the Ad-Hoc Housing Solutions Committee to further the creation and expansion of DuPage's affordable housing stock. As part of that work, the committee engaged with Washington, D.C.-based consulting firm Grounded Solutions Network to partner with the county on its housing strategies and solutions. The effort, an 18-month venture, culminated in a comprehensive housing action plan. 'These folks helped us organize our thoughts and crystallize what we needed to do moving forward,' Hoss said. Grounded Solutions presented its plan at a board meeting earlier this spring, including pitches for a DuPage land bank and trust. District 1 Board Member Sam Tornatore said that since the creation of the Ad-Hoc Housing Solutions Committee, which he co-chairs, 'The progress has been significant.' 'It may not be as quickly as some people would want it, but we had to develop a foundation in order to get where we're at right now,' he said. With the county's new affordable housing strategies, Conroy said she especially hopes to make housing accessible more to the county's 'missing middle,' or those who make too much money to qualify for subsidized housing but not enough to afford market-rate housing or to buy a home. 'It affects (anyone) from college graduates to seniors downsizing to professionals that are in teaching or firefighting or police,' Conroy said. 'You know, those professions which are so important to the fabric of our communities, (they're) struggling to be first-time homeowners … here in DuPage (where) it's difficult to find anything under half a million dollars that has more than two bedrooms and maybe a bath and a half.' Conroy said she's 'incredibly proud of the investment that my board and staff have made into this.' 'It's been a very long process,' she said. 'It's taken a lot of time.'

Most military families on base don't know their rights as tenants, survey finds

More than half of military families don't know about their housing rights, official feedback systems or the offices set up to manage issues with their private housing landlords, a survey found. Two out of three respondents said that issues with military housing had affected their family's quality of life, and almost half said they had paid out of pocket for repairs or improvements to their homes. The survey, conducted by the Military Housing Coalition and released today, found that nearly 56% of respondents were not aware of their tenant rights, and 48% did not feel their base housing office provided adequate oversight. The fiscal year 2020 national defense bill established the Tenant Bill of Rights, granting military families 18 rights around their privatized military housing, including access to a formal dispute resolution process with their landlords. The education around these protections and other housing resources are supplied by Government Housing Offices at each military base. Heather Hall, the founder of the Military Housing Coalition and a military spouse, told Task & Purpose that the last few years of advocacy work aren't meaningful unless families know about their protections and the help that's available to them. 'As much as people have been pounding the ground like myself and other advocates out there to say this is an oversight piece,' Hall said, 'they still don't know that that's an available resource to them.' The coalition received responses from over 1,100 active-duty members, military spouses, DoD civilians, and retirees — a small sample of the hundreds of thousands who live in private military housing. On U.S. military installations, these private landlords operate 99% of family housing, which is made up of more than 200,000 units, according to the GAO. 'We are committed to providing our warfighters and their families the safe and quality housing they deserve. We appreciate the support of military and veteran community partners on improving awareness of DOD's Housing Feedback System, and Congressional committees to make much needed housing reforms,' a Pentagon spokesperson said in a statement to Task & Purpose. Military quality of life had become a major topic in Washington, D.C. in 2019, leading to major changes and additions in the fiscal year 2020 defense bill. Separately, in 2021, Balfour Beatty, one of the military's largest private housing landlords, agreed to plead guilty and pay $65 million in fines for 'pervasive fraud' which included falsified maintenance records. Hall said the momentum around improving private military housing from the beginning of the decade seems to have dissipated post-pandemic. Major changes were made to 2020 defense bill to address housing and in 2021, Balfour Beatty, one of the military's largest private housing landlords, agreed to plead guilty and pay $65 million in fines for 'pervasive fraud' which included falsified maintenance records But in recent years, a majority of military quality of life topics in Congress have addressed fixes to barracks, troop pay increases, and childcare. 'That's not an excuse to just completely be like, 'OK, we're done talking about housing. We're done having this conversation in Congress, we're done having hearings.' And essentially, that's what happened,' Hall said. 'It's sad that we've put all of this legislation into place over the years and yet we're still fighting that original battle that we still have bad actors.' Across bases, Government Housing Offices go by different names, which the coalition thinks should be standardized. Personnel in these offices are directed to hold information sessions with families who are new arrivals to the bases and present them with their bill of rights and offer resources for any issues that may arise. According to the survey, 26.5% of respondents didn't know about the office's role in the first place, which mirrored findings from an April 2023 Government Accountability Office report that described confusion over implementation of the dispute resolution process and the roles of official Department of Defense military housing advocates. In August 2024, the Department of Defense launched its Housing Feedback System for active-duty troops and their dependents 'to submit feedback on their current leased unit, ensuring that their voices are heard and their concerns are addressed in a timely manner.' But in the MHC survey, 67.5% said they were unaware of the feedback system. At the time of the survey, there were 34 public entries despite 183 respondents indicating they submitted their own feedback, which the coalition said raised transparency concerns. 'Many respondents reported being unaware of their rights as tenants and the resources available to them – factors that critically undermine their ability to seek help or resolve problems effectively,' according to an executive summary of the MHC survey. 'These findings reinforce the urgent need for stronger communication, improved tenant education, and coordinated, systemic reforms across the military housing landscape.' 'The reason I do this is because I don't want anyone to feel like they're in a situation like I was back then — that I didn't feel like I had anyone,' Hall said. 'Maintenance and the community management, sometimes they get the angry spouse, but you have absolutely no idea what this spouse is dealing with at the time.' Military spouses made up nearly 82% of responses, 'highlighting the critical role they play in identifying and reporting housing issues,' the coalition noted in survey materials provided to Task & Purpose. The coalition advocates for adding spouses as tenants on private military housing leases since oftentimes they aren't, which restricts their access to certain rights like the dispute resolution process. Nearly 63% of respondents said on the survey that their housing conditions had negatively affected them or their family's quality of life, especially their mental and physical health. The majority of problems reported on the survey were about mold, mildew, pest infestations, HVAC failures, water intrusion and appliance issues — issues that have been reported countless times by news outlets and have been the subject of concern at Congressional hearings on military budgets. The coalition is asking for the DoD to standardize the way private landlords address mold and water intrusion in military homes. 'Some companies are doing the right thing and trying to implement policies and asking that their contractors have certifications for handling those kinds of issues,' Hall said. 'But then we still see residents that are staying in other housing providers, that mildew and mold are being painted over or it's being dismissed as dust and not being taken seriously and it's resulting in physical health issues to our families.' While Hall's husband was deployed, her daughter was in and out of the hospital with respiratory issues, which she believes was the result of mold exposure. Sometimes her daughter would run a 102 fever and have symptoms come and go. Hall said it made her own family members question the validity of her daughter being sick. 'I couldn't prove that it was the home, but she didn't have it before and she didn't end up having it after and I looked like a crazy person. I felt like I was crazy,' Hall said. 'My husband was gone. If it wasn't for my mom coming into town and helping me, I have no idea what I would have done because I was just physically and mentally exhausted.' When maintenance workers pulled up her kitchen flooring, they discovered black mold. Hall said she 'lost it.' She was in the middle of managing the housing problems, maintaining her son's school and sports schedule and driving her daughter back and forth to Kansas City for a pediatric pulmonologist. Around the same time, an administrative error interrupted her husband's pay so sometimes she wondered how she was going to pay for gas to get her daughter to the pulmonologist. She was mentally and physically exhausted. 'That's the mental strain on these families is, they know something's wrong but they can't prove it,' Hall said. 'I understand the legalities behind it to these companies, and I don't think that there's willful negligence here. I don't think that anyone in any of these companies goes to work every day thinking that they're going to do something wrong and do something willfully, but you can't prove it.' Around 45% of respondents said they paid out of pocket for repairs or improvements for their military housing units. That result tracks with several complaints in another recent lawsuit against Balfour Beatty, which included a Navy family in Florida told Task & Purpose that the damages from mold and a broken HVAC system cost them thousands, including the husband's reenlistment bonus. 'The fact that anyone said yes that they have made a repair to their home, living on base out of their own pocket due to negligence, really that kind of stung a little bit. Nobody should have to fix their own home, especially when they choose to live on base,' Hall said. 'They should depend on the provider to fix their home.'
