Community-targeted killings need to be probed by NIA, says forum

Time of India14-06-2025
Mangaluru: All India Practising Lawyers Council president and high court advocate S Balan demanded that the murders of Ashraf and Abdul Rahiman be handed over to the
National Investigation Agency
(NIA).
Balan told reporters here on Saturday that the murders of Ashraf and Abdul Rahiman are 'community-targeted killings', which is a scheduled crime.
He demanded an NIA probe into it, besides invoking the Unlawful Activities (Prevention) Act (UAPA) against the accused in both cases.
Balan, who led a fact-finding delegation of the council, said that Rahiman of Kolthamajalu was a victim of community-targeted murder. "The accused in the Rahiman murder case were very close to the family of the deceased. We visited Rahiman's house and interacted with the family and relatives.
Those accused participated in the protest meeting held in Bajpe, where leaders made provocative speeches. The police should not have allowed the VHP to hold a public rally in Bajpe after the murder of Suhas Shetty," he said.
Further, Balan said that Ashraf, who was mob lynched in Kudupu, did not have any connection to the communal crimes reported in the district. He said that Ashraf was killed only because of his religious identity.

He accused the central govt of demonstrating a discriminatory attitude towards Muslims by not referring the two murder cases to the NIA, despite their qualification for the same. He said that the murder case of rowdy-sheeter and Hindutva activist Suhas Shetty was referred to the NIA, even though it was an 'individual targeted revenge killing', a non-scheduled crime. "Handing over Shetty's murder to the NIA is a misuse of constitutional provisions and political power," he said.
On the involvement of PFI members in the murder of Shetty, which was considered a ground for an NIA probe, Balan said PFI is not a declared terrorist organisation, but only an unlawful association.
Balan stressed the need for the state govt to amend the Karnataka Control of Organised Crimes Act, stating that existing laws cannot curb hate speech.

Factory worker held for raping 10-year-old girl in Delhi's Narela

A 30-year-old factory worker was arrested for allegedly raping a 10-year-old girl and threatening her in an abandoned building in Narela Industrial Area, outer Delhi, on Wednesday night. The suspect was caught at the crime scene by locals who assaulted him before handing him over to police. According to a police officer who asked not to be named, the girl was playing in the lane outside her house in Narela Industrial Area. (Representational image) The accused has been booked for rape and criminal intimidation under sections 65 and 351 of the Bharatiya Nyaya Sanhita (BNS) and section 6 of the Protection of Children from Sexual Offences (Pocso) Act. The case was registered at the Narela Industrial Area (NIA) police station. Deputy commissioner of police (outer-north) Hareshwar V Swami confirmed that the NIA police station received information about the rape of a minor girl and the apprehension of the suspect late Wednesday night. A police team reached the spot and took the suspect into custody. According to a police officer who asked not to be named, the girl was playing in the lane outside her house in Narela Industrial Area when the suspect, a neighbour, allegedly lured her to a ruined and abandoned building. He then raped her after threatening her with dire consequences if she raised an alarm or informed anyone about the crime. 'When the family members started looking for the girl, someone from the neighbourhood informed them that she was last seen with the 30-year-old neighbour. The family members and some locals caught the neighbour raping the minor girl in the abandoned building. Enraged, they thrashed him and then informed the police. The girl was admitted to a nearby government hospital for medical attention,' the officer said. The girl's father is also a factory worker while her mother died a few years ago, according to the police officer.

Panel recommends termination of service of Ramjas College prof accused of sexual harassment

New Delhi Following the complaint, the professor had been asked to stay off campus and not to interact with the students. (Representative photo) Officials of the Delhi University's Ramjas College on Thursday said that the college's internal complaints committee (ICC) has recommended termination of service of a professor accused of sexual harassment. The file has been transferred to the vice-chancellor's (V-C's) office, and a final decision will be taken by the V-C, they said. V-C Yogesh Singh said, 'I have not looked at the file yet.' The case was reported in December 2024, when a minor student had accused the professor of sexual harassment and filed a complaint with the ICC. 'The ICC has been probing the matter since last December and has recommended termination of his service. The ICC file has been handed to the V-C's office and the final decision now rests upon the V-C's approval,' a senior college official said. On May 20, HT reported that according to a police officer aware of the case details, the first information report (FIR) was lodged on May 7 under sections 10 (aggravated sexual assault) and 12 (sexual harassment) of the Protection of Children from Sexual Offences (Pocso) Act, and sections 74 (outraging modesty of a woman) and 79 (words or gestures to outrage a woman's modesty) of the Bharatiya Nyaya Sanhita. 'The professor complied with our notice to join the investigation and has been legally bound to participate in further proceedings,' the police had told HT in May. Following the complaint, the professor had been asked to stay off campus and not to interact with the students.

J&K HC denies bail to Kupwara resident in narco-terror case

The high court of Jammu & Kashmir and Ladakh dismissed the bail plea of Syed Iftikhar Andrabi, 53, of Handwara in Kupwara district in a high-profile narco-terrorism case being investigated by the National Investigation Agency (NIA). The division bench ruled that the trial was at an early stage and premature to conclude that the accusations were baseless. (File) A division bench comprising justice Sanjeev Kumar and Sanjay Parihar upheld the order of the Special NIA Court, Jammu, which had earlier rejected Andrabi's bail application in connection with the case registered under the NDPS Act, Unlawful Activities (Prevention) Act and IPC. The appellant was represented by advocate Warisha Farasat and her team. She contended that Andrabi, a political activist, had been falsely implicated after his release from preventive detention in 2019 and has already undergone nearly five years in custody. The defence argued that there was no direct evidence against him and sought parity with co-accused who were granted bail. On the other hand, the NIA, represented by Vishal Sharma, deputy Solicitor General of India (DSGI), assisted by Chandan Kumar Singh, special public prosecutor (NIA), opposed the bail plea, asserting that Andrabi had direct links with Pakistan-based handlers of Lashkar-e-Taiba and Hizbul Mujahideen and was part of a cross-border syndicate engaged in drug trafficking and terror financing. The division bench observed that on the disclosure of the appellant, 3.2 kg of heroin and cash amounting to more than ₹35 lakh were recovered. 'His mobile phone data suggested his communication with operatives across the border,' observed the DB. While acknowledging that Andrabi had spent almost five years in custody, the court held that the seriousness of charges and evidence on record outweighed his plea for bail. The division bench ruled that the trial was at an early stage and premature to conclude that the accusations were baseless. 'The material laid by prosecution prima facie shows complicity of the appellant in narco-terror activities,' the court said and dismissed the appeal.
