
Teenager (18) posted intimate images of girl (15) on Snapchat, court told
In the case before Kilrush District Court on Tuesday, the accused – now aged 20 – appeared in connection with three alleged offences over the posting of the intimate images in November 2022.

Judge Alec Gabbett said the case comes under Coco's Law, formally known as the Harassment, Harmful Communications and Related Offences Act 2020, which criminalises the non-consensual distribution of intimate images.
In the case, the accused is charged with publishing or distributing an intimate image of the female without her consent with the intention to cause her harm contrary to Section 2(1) and (3) of the Harassment, Harmful Communications and Related Offences Act 2001.
As the female teenager was a minor at the time of the alleged offence, the man is also facing two charges under the Child Trafficking and Pornography Act.
The man is accused of knowingly having in his possession child pornography, the image of the female aged under 17 which, the charge says, depicts her genitals on November 15th, 2022.

The man – accompanied to court by his mother and a sister – is also charged with producing child pornography for the purpose of distribution, publication, exportation, sale or show contrary to Section 5(1) of the Child Trafficking Act and Pornography Act, 1998.
In court, Garda Nadine Keane said it will be alleged that the accused had in his possession a collage of four intimate images of the female on November 15th, 2022, and posted them to his online Snapchat stories on the same date.
Garda Keane said one of the images depicting the girl's genitalia was a Category Two image as categorised under the Child Trafficking Act and Pornography Act.
Judge Gabbett said that Category One would be regarded as the most serious followed by Category Two.

Garda Keane said the images were left online for a number of hours before they were taken down by the man who allegedly posted them.
She said the female – who turned 18 earlier this year – made a statement of complaint to gardaí and was interviewed by specialist Garda interviewers.
Garda Keane said the case was investigated by the Clare Division Protective Services Unit based at Crusheen. She said that when charged at Kilrush Garda Station on May 29th, the accused made no reply after caution.
The garda said the Director of Public Prosecutions has directed that the case be heard in the district court on a plea of guilty only.

After hearing an outline of the facts, Judge Gabbett said he was declining district court jurisdiction and the case will now be transferred to the circuit court where more serious penalties apply on conviction.

The judge said he was declining jurisdiction due to the seriousness of the alleged offences, the categorisation of the images and that the case warrants consideration by the circuit court taking into account the impact on the alleged injured party.
Judge Gabbett said that if the accused was aged under 18 at the time, he would have kept the case in the district court.
In the district court, penalties for the Coco's Law offence can be up to one year on prison on conviction and Sgt John Burke said that before the circuit court, a 14-year prison term can apply on conviction.
Judge Gabbett remanded the man on continuing bail to appear at Kilrush District Court to July 15th. The judge imposed reporting restrictions on the identity of the accused and the injured party due to the age of the injured party at the time of the alleged offences.

The abuse investigation into Sean Gardner, formerly of Chow's Gymnastics and Dance Institute in West Des Moines, is testing the reforms put in place after the Larry Nassar sex abuse scandal rocked USA Gymnastics. An Associated Press review found that while Gardner was swiftly removed from coaching in 2022, a criminal investigation stalled, the public was kept in the dark about the claims, and Gardner was able to get a job at an Iowa hospital. Gardner faced multiple claims of sexual abuse by students over a period of years at Chow's, and had installed a hidden video camera at his former gym in Mississippi to record young girls using the bathroom, according to an FBI affidavit. Gardner hasn't returned AP messages seeking comment and a public defender assigned to represent him also didn't return messages. Accused coach worked at elite Iowa gym Gardner went to work at Chow's Gymnastics in 2018, saying he landed his dream job at the academy where U.S. gymnasts Shawn Johnson and Gabby Douglas trained before becoming gold medalists at the 2008 and 2012 Olympics. He soon became director of Chow's Winter Classic, an annual meet that draws more than 1,000 gymnasts to Iowa. He also coached a junior Olympics team during his four-year tenure at Chow's, which was founded by Liang 'Chow' Qiao, a former Chinese gymnast who opened it after moving to the United States. Several of Gardner's students earned college gymnastics scholarships. Investigation began after sexual abuse reports in 2022 In March 2022, a girl reported to the U.S. Center for SafeSport, a watchdog group created after the Nassar scandal to handle abuse investigations, that she had been sexually abused by Gardner, according to an FBI affidavit. The girl said that Gardner used inappropriate spotting techniques in which he would put his hands between her legs and touch and rub her vagina, during sessions between 2018 and when she left the gym in 2020, the affidavit says. Months later, another girl told SafeSport that Gardner had similarly sexually abused her during workouts and once dragged her across the carpet so hard that it caused burn marks on her buttocks, according to the affidavit. Those reports were shared with West Des Moines police, and SafeSport issued a temporary ban on Gardner from coaching for unspecified misconduct. But the criminal investigation quickly stalled after none of the girls stepped forward to pursue criminal charges. Criminal investigation took years to gain steam The investigation was dormant until April 2024, when another former student came forward to the West Des Moines police to report she was sexually abused by Gardner at Chow's. The AP is not identifying the student in line with its policy of not naming victims of alleged sexual abuse. The now 18-year-old told police she began taking lessons from Gardner when she was 11 or 12 in 2019, and she initially saw him as a father figure. Before she moved away in 2021, she told police, he gave her a hug and said she could text and follow him on Instagram and other social media sites, where he went by the nickname 'Coach Seanie,' because gym policy barring such contact no longer applied. She told police Gardner made her do inappropriate stretches that exposed her anus and vagina outside her leotard and that she suspected he used his cellphone to film her in that position. The teen told police that Gardner fondled her while spotting her, repeatedly touching her vagina. Gartner gave non-consensual hugs, rubbed her back and butt and discussed his sex life, she said. Police find videos and photos from hidden camera in Mississippi While serving a search warrant at Gardner's Iowa apartment in May, investigators seized a cellphone and computer equipment. Those images appear to have come from a hidden camera in a restroom. Additional examination by the FBI uncovered videos that showed at least seven young girls using the gym bathroom at Jump'In Gymnastics in Purvis, Mississippi, where Gardner worked until 2018. On one of the videos Gardner is shown entering the bathroom and turning off the camera, the FBI says. The owner of the gym, Candi Workman, hasn't returned AP messages seeking comment. Gardner made an initial court appearance in Des Moines on Friday on a charge of producing visual depictions of minors engaging in sexually explicit conduct, which can carry up to 30 years in prison. He was ordered detained pending further proceedings in Mississippi. Man (51) involved in incident with gardaí in Dublin city centre dies in hospital
A 51-year-old man has died after he suffered serious injuries following an interaction with gardaí in Dublin city centre. The man was involved in an incident with gardaí close to the Holiday Inn on O'Connell Street last Friday. Advertisement Fiosrú, the Office of the Police Ombudsman, is independently investigating the incident and said it has commenced a criminal investigation into it. It said the incident, which happened on O'Connell Street at around 4.15am, involved the serious harm of the man, who later died. Fiosrú said that one of its on-call team of investigators attended the scene. It has been liaising with the Dublin City Coroner and the Office of the State Pathologist in relation to a post-mortem examination. Fiosrú has appealed for any witnesses to the incident to come forward. This includes any passing vehicles, including taxis that may have dashcam footage from that location or on a mobile device.
