
Karnataka proposes to increase daily working hours, overtime
In what has riled the trade unions in Karnataka, the State government has proposed to bring an amendment to the Karnataka Shops and Commercial Establishment Act, 1961, to increase the daily working hours to 10 from the current nine hours, besides allowing more overtime hours.
The proposed amendment, circulated by the Labour Department among the stakeholders to elicit their response, allows work hours to be increased to 10 a day and 48 a week. The proposal caps the total number of hours of work, including overtime, to 12 hours a day — up from the present 10 hours a day.
Union govt.'s direction
The Karnataka government, in its draft amendment, has cited the Union government's directions to all States to consider amending the working hour limits through legislative or regulatory changes appropriately. The Centre has also pointed out that similar amendment has been brought in Chhattisgarh, Gujarat, Maharashtra, Uttar Pradesh, and Uttarakhand — all BJP-governed State.
Among other amendments, there is a proposal to increase the total number of overtime hours per employee to 144 hours in a period of three continuous months from the present 50 hours.
What the Act governs
The Act governs a large number of shops and commercial establishments, including hotels, pubs, bars, restaurants, offices, and IT and ITES industries offering commercial services. The proposed amendment also seeks to remove those shops and commercial establishments employing less than 10 persons from the purview of the Act, which would mean they are exempted from filing annual returns.
A meeting of stakeholders has been convened here on Wednesday by the Labour Department to finalise the amendment being brought to the 1961 Act and the Karnataka Shops and Commercial Establishments Rules, 1963.

Setback for BCCI as court affirms Rs 538-crore arbitral awards to Kochi Tuskers
In a significant setback for the Board of Control for Cricket in India (BCCI), the Bombay High Court on Tuesday affirmed arbitral awards exceeding Rs 538 crore in favour of the owners of the now-defunct Indian Premier League (IPL) franchise Kochi Tuskers Kerala [BCCI v Kochi Cricket Private Limited and others].Justice R.I. Chagla, presiding as a single judge, dismissed the BCCI's challenge to the arbitral awards, ruling that the court could not act as an appellate authority over the arbitrator's jurisdiction of this Court under Section 34 of the Arbitration Act is very limited. BCCI's endeavour to delve into the merits of the dispute is in teeth of the scope of the grounds contained in Section 34 of the Act. BCCI's dissatisfaction as to the findings rendered in respect of the evidence and/or the merits cannot be a ground to assail the Award," the court observed. The Kochi Tuskers franchise, awarded to a consortium led by Rendezvous Sports World (RSW) and later operated by Kochi Cricket Private Limited (KCPL), participated in the 2011 IPL season. However, the BCCI terminated the franchise in September 2011, citing a breach of the franchise agreement—specifically, the failure to furnish a 10% bank guarantee amid internal disputes between the had contended that the delay was due to unresolved issues including stadium availability, regulatory approvals on shareholding, and a sudden reduction in the number of IPL matches. Despite the delay, BCCI continued engaging with KCPL for several months and accepted various payments, before abruptly terminating the franchise and encashing a prior guarantee issued by proceedings were initiated by both KCPL and RSW in 2012, with the tribunal ruling in their favour in 2015. It awarded ?384 crore to KCPL for loss of profits and Rs 153 crore to RSW for wrongful encashment of the bank guarantee, along with interest and legal contested the awards, arguing that the tribunal had exceeded its jurisdiction and misapplied legal principles. It insisted that KCPL's failure to provide the bank guarantee amounted to a fundamental breach, justifying the termination. It also objected to the award of both loss of profits and wasted expenditure, claiming the damages were excessive and in breach of the contractual BCCI challenged the validity of RSW's arbitration claim under the Indian Partnership response, KCPL and RSW argued that BCCI had, through its conduct, effectively waived the guarantee deadline and that the termination was unjustified and disproportionate. They maintained that the arbitrator's ruling was based on "a correct appreciation of the evidence on record".The Court concurred, finding no grounds to interfere with the arbitral findings. "The arbitrator's conclusion that the BCCI's termination of the Kochi franchise was a repudiatory breach of contract would call for no interference under Section 34 of the Arbitration Act," the Court held. CPM warns of ‘Emergency-like danger' to nation under Modi
VIJAYAWADA: CPM politburo member BV Raghavulu on Tuesday asserted that democracy and secularism in India face a threat greater than the Emergency period under Prime Minister Narendra Modi's rule, urging a united front to combat it. Speaking at a press conference at MB Vignana Kendram here, alongside politburo member U Vasuki and party State secretariat member Y Venkateswara Rao, Raghavulu outlined decisions made at a recent Central Committee meeting. He stated the party's resolve to inform the public about the true facts of the recent Pulwama terrorist attack and to explain the 'danger of Emergency-like conditions.' Raghavulu highlighted the need for public awareness regarding the recent terror attack in Pahalgam. He noted that while terrorists killed innocent civilians and India retaliated by destroying terrorist bases in Pakistan, President Donald Trump claimed he brokered a ceasefire between the two nations. The CPM demanded a special parliamentary session to reveal the facts, a request Raghavulu said the government refused. Raghavulu strongly criticised the Central government for allegedly aligning with American foreign policy and acting subserviently to Trump. He pointed out that the Indian government has not condemned the recent Israeli attack on Iran, despite India's friendly economic ties with Iran. He warned that a potential war would increase crude oil prices, already up by 10 per cent, harming India's economy. He stressed the need for global pressure on Israel to halt the conflict. Raghavulu accused the BJP-led Central government of supporting Israel and urged it to change its stance. He criticised the Indian government for attempting to equate the aggressors with the victims, suggesting its actions appear to cater to American interests and Trump's preferences. 'While claiming to be a 'Vishwaguru', it is acting as Trump's puppet,' he remarked. Raghavulu concluded by highlighting the upcoming 50th anniversary of the Emergency declaration on June 25, emphasising the need to inform the public about its dangers. He recalled the CPM's active role in fighting against the Emergency and how opposition parties united. He stated that just asthe nation was collectively saved from the Emergency then, today there is a need to protect secularism, democracy, and federalism from the 'danger of neo-fascist forces.'
