Relief for HCS officer: HC stay on chargesheet clears IAS path

Chandigarh: In a major setback to the state vigilance bureau of Haryana, the Punjab and Haryana high court has stayed a chargesheet filed by the bureau against a Haryana Civil Service (HCS) officer, who was facing prosecution in connection with irregularities in the selection of 2001-batch HCS officers.
This order paves the way for the elevation of the officer, Jagdeep Dhanda, into the coveted IAS under the state's promotion quota. The HC has also issued a notice to the Haryana govt seeking the state's reply on the officer's plea to quash the criminal proceedings.
In his plea, Dhanda contended that the entire sequence shows that it was only to exclude him from the process of selection to the IAS cadre that he was included as an accused in the charge sheet, though none of the ingredients of the alleged offences are established against him.
"State counsel accepts notice on behalf of the state and seeks time to file a detailed reply to the petition… In the meanwhile, operation and effect of the impugned charge sheet, dated June 30, 2023, qua the petitioner shall remain stayed," the HC ordered.
Justice Tribhuvan Singh Dahiya passed these orders while hearing the petition filed by HCS officer Jagdeep Dhanda.
Counsels representing the petitioner, senior advocate Gurminder Singh and advocate Inder Pal Goyat, submitted that there was no material before the investigating agency to conclude against the petitioner, nor have any been referred to.

The counsels also relied upon the opinion given by the advocate general, dated Nov 24, 2023, in the matter that the said FIR had no bearing on consideration of the select list for promotion to the IAS cadre.
Based thereupon, the petitioner was issued an integrity certificate for the purpose, and the same was sent to the UPSC also, the HC was informed.
However, the counsel representing the state contended that the petitioner remains an accused in the charge sheet filed and, therefore, has no right to be considered for promotion.
The matter has now been fixed for August 22 for further hearing.
Wide Ramifications
Although the order has been passed by the HC on one officer's plea, the order would also have ramifications on other officers who were also charge-sheeted in the same case and are in line for promotion to the IAS. Several officers of the 2001 batch have been charge sheeted by the SVB under the Prevention of Corruption Act. Some of such officers are Sarita Malik, Kamlesh Kumar Bhadoo, Kuldhir Singh, Vatsal Vashisht, Veena Hooda, Surender Singh, Jag Niwas, and Ranjit Kaur (now retired).
The Case
The state vigilance bureau (SVB, now ACB) Haryana submitted a charge sheet against 29 persons, including the then HPSC chairman, members, examiners of the commission, and some of the HCS officers of the 2001 batch, pointing to massive irregularities in the selection of this provincial state civil services examination held during the then INLD regime led by Om Prakash Chautala. The trial of the case is pending at the district court in Hisar.

Lokayukta Police, who regained powers to probe cases under the Prevention of Corruption Act, 1988 after the abolition of the Anti Corruption Bureau (ACB) in September 2022, have registered 218 Disproportionate Assets (DA) cases and raided 219 State Government officials in Karnataka since 2023. T. Ravi and D. S. Arun. Of the 218 DA cases registered by the Lokayukta Police during this period, 101 cases (46.3%) have been stuck in legal challenges while the High Court of Karnataka has stayed proceedings in 67 cases and quashed FIRs in 34 cases. A senior Lokayukta Police official said that most of the 101 cases have either been stayed or quashed on 'technical grounds'. 'A Superintendent of Police (SP) rank officer needs to give an order under Section 17 of PC Act, 1988 to investigate the DA case against a particular officer. The court has, in many cases, found fault in an SP giving an order to lodge an FIR and investigate in a single order, and not sequentially. In some cases, they have also said that the SP has to record in detail in the order as to why a particular case is being assigned to a particular officer,' a senior official said. The Lokayukta Police have challenged all these orders in the Supreme Court of India. 'We have already got favourable orders in a few cases, but many cases are yet to come up for hearing before the apex court. We are confident of clearing these legal challenges, but it will take time,' the officer said. Delay in investigation The data shows that of the 218 cases registered since 2023, the Lokayukta Police have completed investigation in only four cases and sought Sanction for Prosecution in them, of which the government has granted the same in two cases and the request is pending in the remaining two. Explaining the delay in investigation, a senior Lokayukta Police official said that they inherited 1,300-plus cases from the ACB in 2022. Investigation into those cases, and the new cases were being done simultaneously, leading to delay. Lack of action by competent authorities Lokayukta Police have submitted preliminary reports to the competent authorities concerned for further action in 150 cases. But of them, only 82 officials have been suspended. 'In many departments, even after raids and our reports, officials are not even suspended. This has been the case for many years,' a senior official said. UDD and RDPR has most number of cases Data shows that over the last two-and-a-half years, most raids have targeted officials from Urban Development Department (39 officials) and Rural Development and Panchayat Raj Department (36 officials), followed by Revenue Department (20 officials) and Energy Departments (17 officials). More raids being conducted on officials of a particular department is a function of focus on a particular department by our field officers. We have been nudging them to diversify their focus and also work on senior officials, as presently the focus is mainly on mid-ranking officials. For instance, in the 218 cases, only one All India Services officer has been raided,' the official said. The data shows that most number of DA cases were booked in Bengaluru city, the administrative capital of Karnataka. This was followed by Belagavi, Tumakuru, Mysuru and Kalaburagi districts.

CHENNAI: The Madras High Court has questioned the Directorate of Vigilance and Anti-Corruption (DVAC) over the delay in obtaining sanction from the competent authorities of the government to prosecute the accused persons in the alleged Rs 98.25 crore tender irregularities in Greater Chennai Corporation (GCC) and Coimbatore Corporation (CC) when SP Velumani was the municipal administration minister during the previous AIADMK government. Velumani and some government officials, including two IAS officers, have been arraigned as accused. Justice N Anand Venkatesh, in a recent order, directed respondent DVAC SP to file additional affidavit explaining why there was substantial delay in obtaining sanction. He directed the special court for cases registered under the Prevention of Corruption Act (PCA) in Chennai to submit a report on the delay in taking on file the charge sheets filed by the DVAC against the accused persons and companies as per orders passed in another contempt petition on April 4, 2024.
