Legal heir entitled to compensation under MV Act even if not dependent on deceased: Allahabad HC

In an important judgment, the Lucknow bench of the Allahabad high court has observed that a legal heir cannot be deprived of compensation beyond the limits of no fault liability as provided under Section 140 of the Motor Vehicles (MV) Act, 1988 on the ground that the said heir was not a dependent of the deceased. The court observed that the claimant used to stay with her father and brother. Hence, it cannot be said that merely because the claimant was married, she would have no right or that she would not be a dependent. (For Representation)
The issue before the high court for consideration was whether a married daughter can be excluded to claim compensation beyond the prescribed limit as mentioned in Section 140 of the MV Act, 1988.
Passing the judgment on August 6 on two appeals filed by the state, Justice Jaspreet Singh observed, 'It should always be kept in mind that human life has much value, it would be anomalous to state that a person may lose a dear one or member of the family and merely because the legal representative is not dependent on the deceased hence, he or she would be confined only to the no fault liability amount as prescribed under Section 140 of the Act of 1988 and adding some amount under the conventional heads, this would be a travesty of justice and mocking at a loss of an important human being, due to negligence of another.'
In this matter, the respondent had filed a claim under Section 173 of the Motor Vehicles Act, 1988, as her father and brother expired after being hit by a truck while riding a motorcycle. The motor accident claims tribunal awarded her a sum of ₹2,13,200 and Rs1,16,400 along with 6% interest per annum.
While filing the two appeals challenging the tribunal's award (order), the state contended that it was the motorcycle rider (now deceased) who was not careful while driving and on account of their own negligence the accident occurred and not on account of negligence of the truck. It was also contended that since the claimant was the married daughter of one of the deceased, hence she cannot be said to be dependent on her father.
The court observed that the claimant used to stay with her father and brother. Hence, it cannot be said that merely because the claimant was married, she would have no right or that she would not be a dependent. Accordingly, the court dismissed both the appeals filed by the state.

Each box carried the warning, "Sale in Rajasthan only – Not to be sold online." One of them took her to a hotel where he shot her obscene videos after giving her sedatives and started blackmailing her later, demanding Rs 2 lakh. The girl, 17, was in for another shock when she shared her ordeal with the other male friend. He too colluded with the accused and obtained her videos, and started demanding Rs 2 lakh from her in exchange for the videos. Left with nowhere to go for help, the girl eventually confided in her mother, who immediately lodged a police complaint. She said on May 25, her daughter went to a shopping mall to attend the birthday party of a friend. She invited one of the accused to the party. But instead of taking part in the celebrations, she said he took her daughter to a hotel near a bus stand, where he offered her a cold drink laced with sedatives. When the girl lost her consciousness, he recorded her obscene videos and started blackmailing her. He threatened to make it viral if she did not pay the amount he sought, the girl's mother said. The officer investigating the case said instead of first telling her parents about it, the girl first shared the incident with another friend, and even gave him her the password to her social media account to deal with the main accused. Mangaluru: The Karnataka Dalit Horata Samiti condemned the attack on YouTubers and a reporter from a private Kannada news channel in Dharmasthala recently. Samiti district leader SP Anand told reporters on Saturday, that while the Dakshina Kannada police arrested one person in connection with the incident, around 50-60 individuals were involved in the attack. "All those responsible must be arrested and booked under stringent laws," he demanded. Anand pointed out that one of the injured, cameraman Abhishek, belongs to the Dalit community. "The FIR should also include provisions of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, along with sections related to robbery," he said. The Samiti plans to petition the DK superintendent of police and home minister on the matter. According to Anand, the miscreants alleged that false propaganda was being spread on social media about Dharmasthala's sacred place. "We too respect Dharmasthala and are not against it. We only want the police to identify those who orchestrated the attacks," he said. He welcomed the Special Investigation Team's probe into the alleged mass burial case in Dharmasthala and urged it to bring out the truth. "It is an attack on the democratic process, which is aimed at uncovering the truth," he said. Samiti leader Anil Kumar alleged that the assault was a deliberate conspiracy to suppress facts.
