KUALA LUMPUR, July 3 — Following Tun Tengku Maimun Tuan Mat's retirement as Chief Justice (CJ) of Malaysia upon turning 66 this week, Chief Judge of Malaya (CJM) Tan Sri Hasnah Mohammed Hashim will be temporarily carrying out duties for the CJ post until a new CJ is appointed.
This announcement was made today by the judiciary via the Federal Court's Chief Registrar's Office.
'This office has been instructed to notify that in line with the Federal Constitution's Article 131A and Section 9(1)(b) and Section 9(3) of the Courts of Judicature Act [Act 91], the Chief Judge of Malaya will exercise the powers or perform the duties of the Chief Justice position (including its functions) until that position is filled,' it said in a brief statement.
Hasnah as the CJM is the third highest-ranked judge in the judiciary, and will now temporarily carry out the duties of the top-ranked CJ position.
This is because the second highest-ranked judge, President of the Court of Appeal (PCA) Tan Sri Abang Iskandar Abang Hashim, has also retired this week and would not be able to temporarily take on the CJ's duties.
Currently both the CJ and PCA positions are still vacant, as there are no new appointments for the two top positions in the judiciary yet.
Section 9(1)(a) states that the PCA would exercise the powers and perform the duties of the CJ if the CJ position is vacant, while Section 9(1)(b) provides for the CJM to perform the CJ's duties if the PCA position is also vacant.
Section 9(3) provides for a Federal Court judge to exercise the PCA's powers and perform the PCA's duties, if the PCA position is vacant.
Article 131A enables a Federal Court judge to also perform the CJ's functions under the Federal Constitution, if that Federal Court judge is performing the functions of the CJ post because it is vacant.

Idris also said that what matters to PAS is helping PN perform better than Pakatan Harapan, not fighting over who should be the prime minister. 'The appointment of the prime minister depends on the name submitted to the king. Even discussing this requires consensus within PN,' he said. 'Let us win first. Then whoever is qualified can take the role. The position of prime minister is not something PAS is fighting over.' He said this approach is deeply rooted in the leadership style of party president Abdul Hadi Awang, who once declined to contest a state seat in Terengganu during the 14th general election despite pressure to lead the state. Its secretary-general, Datuk Dr Asyraf Wajdi Dusuki, said this move aligns with the establishment of a Legal Secretariat at the Umno headquarters, which is tasked with monitoring and addressing defamatory content involving the party and its leadership. "Umno has not traditionally resorted to lawsuits or legal notices, but given the rampant misuse of social media to attack our leaders, it is time for the party to respond more assertively,' he said after officiating the Bukit Bintang Umno division delegates meeting today. Asyraf Wajdi added that other political parties have long used legal channels to counter false allegations and negative perceptions, and Umno will now adopt a similar strategy to hold irresponsible individuals accountable. In a related development, he said Umno has agreed to establish an Outstation Voters Department as a strategic initiative to engage with voters who reside outside their home constituencies, particularly in the run-up to the next general election. Nearly 40 per cent of voters in certain parliamentary constituencies, he noted, are based in areas such as the Klang Valley and Selangor. "At the recent Supreme Council meeting, we approved a proposal from the Bukit Bintang division to form this department. It will allow us to conduct targeted programmes and provide continuous support to these voters in constituencies that Umno and Barisan Nasional aim to win,' he said. — Bernama
