Delhi HC gives interim relief to property owners in Batla House

The Delhi High Court on Monday ordered status quo till July 10 on the demolition notices issued by the Delhi Development Authority against seven residents of Okhla's Batla House area.
The court posted the matter for hearing on July 10, when the other petitions related to the demolitions in the area are also scheduled for hearing.
The counsel for the petitioners argued that the DDA and the Delhi government had 'indiscriminately targeted properties beyond the identified area and without issuance of individual notices'.
The lawyer said that the petitioners' properties were marked for demolition following a survey on June 4, and they were informed about an 'imminent coercive action' despite the structures being outside the demolition zone and being covered under the PM-UDAY scheme, which gives legal property rights to people living in Delhi's unauthorised colonies.
'No demarcation report or verification of PM-UDAY eligibility has been provided to the petitioners till date. The threatened action thus amounts to a clear violation of the principles of natural justice, the right to livelihood and the equal protection guaranteed under the Constitution,' argued the plea.
The petitioners also referred to the interim protection granted by the court to other similarly placed persons.
On July 16, the court ordered a similar status quo while hearing a batch of pleas against the DDA demolition order.
The Supreme Court had on May 7 ordered the urban body to demolish unauthorised structures on 'Khasra number 279' in the area, spread across 0.702 hectares along the Muradi Road in Okhla.

NEW DELHI: The Supreme Court stressed Monday that "hate speech" is not covered under freedom of expression, even as it restrained police from four states from arresting Wazahat Khan, who was instrumental in the arrest of social media influencer Sharmistha Panoli for her communal posts on Pahalgam killings. FIRs have been lodged against him for posts on X expressing hate against Hindus. On Khan's plea that the FIRs were in retaliation for his complaint against Panoli and his comments had been deleted, the bench said, "It is not so simple. All these comments are hate-mongering". Wazahat Khan through senior advocate D S Naidu told a bench of Justices K V Viswanathan and N Kotiswar Singh the FIRs against his client were lodged as a retaliation against his complaint to West Bengal police against Panoli, leading to her arrest. He said Khan had made these comments in 2023, had since deleted them, and even posted a video apologising to "Hindu brothers and sisters". Naidu said Khan is already in police and judicial custody in connection with two FIRs in West Bengal and pleaded for consolidation of the FIRs in one place as the SC had done in the past in many cases, when the FIRs have been lodged for the same offence. "Your apology says the FIRs were a retaliation to you lodging a complaint against the social media influencer. We do not know where we are heading. Incitement to violence may not be only physical violence. It could be many other forms of violence. Hate speeches take us nowhere," Justice Viswanathan said. He reminded Khan's counsel about a proverb - "A wound inflicted by fire may heal, but not the one inflicted with tongue". The bench issued notice to all five states, including West Bengal, and to the Union govt on Khan's plea for consolidating the FIRs in one state, or on the alternative, club the FIRs in one state at one place within the state concerned. The bench posted further hearing on July 14.

State Congress on Monday launched a three-day Jan Jagran campaign on the ongoing controversy over the installation of Dr BR Ambedkar's statue. Bhopal district Congress workers headed by PCC chief Jitu Patwari organised a Samvidhan Satyagraha at Sant Hirdaram Nagar here in the state capital. On Wednesday June 25, top functionaries of the Congress will sit-in protest in Gwalior to demand the installation of the statue of Ambedkar within the High Court premises there. The BJP launched a scathing attack on the Congress and said it will observe June 25 as 'Black Day' to recall the emergency imposed by former Prime Minister Indira Gandhi on that day in 1975. The BJP claimed that the Congress humiliated Ambedkar when he was alive, and its demand to install the statue is just a "political gimmick to salvage its erroding support-base". Two days after the panchayat elections dates were announced in the state, the Uttarakhand High Court on Monday stayed all proceedings concerning the polls. This came after a petition was filed by Bageshwar-resident Ganesh Dutt Kandpal, saying the government's decision to nullify the existing reservation rotation for the panchayat polls and bring about a new rotation from this year has prevented him from being able to contest the election. Under the reservation rotation system, constituencies are reserved for various categories for three terms, after which the quota goes to other seats. With the existing rotation being nullified and a new rotation starting this year, Kandpal, represented by Advocate Shobhit Saharia, said a seat that had been reserved for the last three terms will again be reserved this year. This, Kandpal argued, has prevented him from contesting the election. The petitioner argued that the High Court had already issued guidelines on this matter in the past. The petition was filed on Thursday and the Division Bench of Chief Justice G Narender and Justice Alok Mahra heard the matter on Friday. On Monday, the court stayed the election proceedings until the state furnishes the notification for the new rules for panchayat polls. The state has also been asked to present its policy on reservation. Following the stay order, Panchayati Raj Secretary Chandresh Kumar said, 'The High Court has currently stayed the panchayat elections as there is no gazette notification issued for Reservation Rules 2025 yet. In this connection, I have spoken to the Government Press, Roorkee, to make a copy of the gazette notification available to the state government, which can be submitted in the High Court to lift the stay.' He said the state is 'committed to upholding the full dignity and directions of the court and to operating the Panchayati Raj system in accordance with the Constitution and the law'. On Saturday, the state Election Commission announced the dates for elections to the three-tier panchayats in 12 districts of Uttarakhand, excluding Haridwar. Elections were supposed to be conducted in two phases, with the nomination process beginning on June 25. Polling was to take place on July 10 in the first phase and on July 15 in the second phase, and counting on July 19. The Model Code of Conduct had been enforced in all areas of the state except urban areas and Haridwar district.
