HC stays govt mandate for quota in minority institutions for Class 11 admissions
A bench of Justices M S Karnik and N R Borkar passed the order on a bunch of petitions filed by some minority institutions, challenging the May 6 resolution issued by the government's school education and sports department applying the constitutional/social reservations in minority education institutes.
The high court said it found substance in the petitioners' arguments and hence the mandate of social reservation will not be applicable for Class 11 admissions in minority educational institutions.
The HC bench said it was granting a stay on the clause of the resolution that included minority educational institutes for the reservation.
It directed the government to file its affidavit in reply to the petitions and posted the matter for further hearing on August 6.
The high court on Wednesday questioned the government's rationale behind the resolution and asked if it was willing to withdraw the same or issue a corrigendum clarifying that minority institutes would not be included in the reservation.
On Thursday, government pleader Neha Bhide told the court that she has no instructions from the government to withdraw the resolution or issue a corrigendum.
As per the pleas, Article 15 of the Constitution excludes minority educational institutes, aided or unaided, from applicability of reservations for socially and educationally backward classes.
The petitions claimed that under Article 30 , the right of admission is exclusively with the management of the institution.
A similar GR was issued in 2019 but it was withdrawn after petitions were filed then, they said.

(HT PHOTO) One of the judges who passed that order, B Sudershan Reddy, 79, was on Tuesday named by the INDIA bloc of Opposition parties, in which the Congress is the largest constituent (by MPs), as its vice presidential candidate. That was one of the last orders of Reddy in the Supreme Court, where he was a judge between 2007 and 2011. An expert on the Constitution –– he has written a book on the Preamble –– and an admirer of both BR Ambedkar and Jawaharlal Nehru, Reddy was born in an agricultural family on July 8, 1946 at Akula Mylaram village of Kandukur block in Ranga Reddy district of Telangana (then part of the princely state of Hyderabad). Reddy graduated in law from Osmania University in Hyderabad in 1971. He enrolled as an advocate and worked under senior advocate K Pratap Reddy. Having argued various cases in city civil courts in Hyderabad and later in the then combined high court of Andhra Pradesh, Reddy later became the government pleader on August 8, 1988 in the high court, arguing cases pertaining to the revenue department. He continued in the post till January 8, 1990. Reddy was elected as president of Andhra Pradesh high court advocates' association in 1993-94. He was elevated as the additional judge of the high court on May 2, 1995. And he was appointed as chief justice for Gauhati high court on December 5, 2005. On January 12, 2007, he was elevated to the Supreme Court of India; he retired on July 8, 2011. Among his notable verdicts was one declaring Salwa Judum, a local militia propped up by the state government in Chhattisgarh to fight Maoists, as anti-constitutional. Along with justice SS Nijjar, he said arming civilians was 'unethical and dangerous' and was violative of Article 14 (Right to Equality) and Article 21 (Right to Life). After his retirement, he was appointed as the first Lokayukta of Goa in March 2013. He resigned from the post on personal grounds in October 2013. A staunch supporter of formation of separate Telangana, Reddy was an active participant in various movements in support of bifurcation. He also raised his voice in support of bifurcation of the combined Andhra Pradesh high court. Madabhushi Sridhar Acharyulu, former Central Information Commissioner, who has known Reddy for over three decades by virtue of his legal profession, having worked as a professor at NALSAR University of Law, said that as a judge, Reddy was deeply committed to the rule of law and he has dedicated his life to upholding constitutional values in the Indian democratic framework. 'Some judges have etched their names in history through their unwavering integrity, distinctive vision, and faith in democratic principles — justice B Sudarshan Reddy is one among them.'

Voter Adhikar Yatra: Rahul Gandhi alleges partnership between ECI and BJP
On the third day of 'Voter Adhikar Yatra' Leader of Opposition in Lok Sabha Rahul Gandhi continued his attack on the Election Commission of India (ECI) accusing the poll body of having a partnership with the Bharatiya Janata Party (BJP). Mr. Gandhi, while addressing a public meeting at Bhagat Singh Chowk in Nawada, said, 'A partnership is ongoing between BJP and the Election Commission. They are stealing votes together. The Constitution has given the right to vote, which is being snatched by Narendra Modi, Amit Shah and the Election Commissioner.' He further said that the BJP, along with the Election Commission, has stolen votes in Maharashtra, Haryana, and Madhya Pradesh. He alleged that in Maharashtra, between the Lok Sabha and Assembly elections, the ECI created about 1 crore new voters. 'When we asked who these 1 crore new voters were, the ECI didn't have any answers. When we demanded videography, they changed the law. Now in Bihar, under the guise of SIR (Special Intensive Revision), the BJP and the Election Commission are stealing votes. We will not let them get away with vote theft, 'Mr. Gandhi said while accompanied by other leaders of the INDIA bloc. HC Pune Action Committee to submit representation to CJI in 10 days
Pune: Bombay High Court, Pune Action Committee is expected to submit a representation to the chief justice of India (CJI) in 10 days specifying the reasons for setting up a circuit bench in the city, said its chairman, senior lawyer , on Tuesday. Jain said a delegation of lawyers led by the bar association submitted a memorandum to the CJI conveying the demands of the legal fraternity to set up a bench in the city. The CJI advised the PBA to conduct a study explaining why Pune deserves a bench and submit a representation in due course. Quoting a book by lawyer Abhinav Chandrachud in 2023, Jain claimed the information collected by the committee revealed that after the British launched the judicial system during the colonial era, a circuit bench was set up at the council hall in Pune in the early 1940s. "We don't know why the bench was closed," he said. The city has legal talent, good infrastructure, transport connectivity, and a rise in population due to geographical reasons, which merits setting up of a circuit bench, he said. Jain added that the committee met state chief minister Devendra Fadnavis, among other ministers, and took letters of support from all MPs and MLAs, as well as local civic bodies and passed a resolution supporting the demand for a circuit bench. PBA president Hemant Zanzad said the lawyers in the general body meeting held at the sessions court, Shivajinagar, unanimously decided to appeal to the members of the Bar Council of Maharashtra and Goa to write individual letters in support of their demand for opening the bench.
