
Court throws out suit by motorcyclist, says claim of car collision false
PETALING JAYA : A sessions court in Alor Setar, Kedah, has dismissed a negligence suit filed by a motorcyclist after ruling that his claim that a car collided with his motorcycle in 2017 is false.
Judge Noor Zaihan Ali said T Vimalan had failed to prove his case on the balance of probabilities.
She said Vimalan had admitted during cross-examination that the collision did not involve a car, while another witness, V Dhayanandh, also conceded that Vimalan skidded and fell on his own.
Zaihan also pointed out that the driver of the car, Hashim Bakar, had only lodged a police report two years after the accident.
The judge, however, assessed damages to injuries suffered by Vimalan at RM352,000.
Vimalan had claimed that he was knocked down by a car driven by Hashim along the Masjid Aman intersection in Alor Setar at about 4am on Nov 3, 2017.
In his statement of claim, he said he suffered multiple injuries, including complete brachial plexus injury to his right upper limb.
He sought about RM1 million in damages for loss of earnings and orthosis to support his right arm from the owner of the vehicle, Yusof Bakar.
The insurer of the car, Tokio Marine Insurance, suspected that something was amiss and instructed adjusters to investigate and verify the accident.
They managed to trace Dhayanandh, a friend of Vimalan's friend, who lodged a police report stating that the plaintiff had skidded and injured himself on his own.
Vimalan produced 14 witnesses, including Hashim, who claimed to have collided with his motorcycle.
The insurer had called Kota Setar police criminal investigation department chief Zahrin Abdul Rahman, who affirmed that there was no evidence that a car had collided into Vimalan's motorcycle.
Lawyer Imavathi Subramaniam represented Tokio Marine Insurance while Samreet Singh Sagoo represented Yusof and Hashim. Vimalan was represented by Inderjit Singh.

Deputy public prosecutor Datuk Badius Zaman Ahmad proposed bail at RM10,000, while lawyer Muhammad Rafique Rashid Ali, representing Muhammad Hilman, requested RM3,000 bail with one surety. 'It is impossible for my client to abscond. He is well known throughout Selangor and Malaysia and has cooperated fully with the authorities,' he submitted. Child sexual exploitation WhatsApp group with over 700 people — who's the mastermind? Home minister says cops still probing
PUTRAJAYA, Aug 20 — Datuk Seri Saifuddin Nasution Ismail has reportedly confirmed that the police are looking into any masterminds behind a child sexual exploitation WhatsApp group involving 12-year-old girls. New Straits Times quoted the home minister saying investigators have not determined this fact yet, and stressed the case must be handled carefully and in line with procedures since minors are involved. 'There are specific protocols for handling cases involving children – photographs cannot be shown, names cannot be disclosed, and so forth. 'The police are therefore carrying out their duties through the Criminal Investigation Department's (CID) Women and Child Investigation Division (D11),' he told reporters after the Home Ministry's monthly assembly here. He said cases involving children require a detailed understanding of their age, level of thinking, and motivations. 'What led the child to decide to leave school? Leaving school entirely because they saw this as a way to make money. All of these factors need to be examined,' he said. He added that the child's involvement required careful police handling with support from psychiatric specialists because of her age and vulnerability. Yesterday, Saifuddin said the police have recently uncovered a case where children as young as 12 were being exploited online to sell images of themselves. Saifuddin said the ring started after a 12-year-old girl created a website with four of her friends, and a WhatsApp group where their child sexual exploitation materials were shared grew to 762 members. He did not state whether the members of the group involved adults or minors. However, he stressed that cases involving children could not be tackled by enforcement alone and required wider involvement. His revelation came when responding to Jerai MP Sabri Azit, who had asked whether the police are acting against 'swinger' — where consenting adults swap their partners, usually spouses, for sex.

Five teens plead not guilty after charged in Kota Kinabalu Children's Court with abusive words against Zara Qairina
KOTA KINABALU, Aug 20 — Five teenage girls were charged at the Children's Court here today with using abusive words against Form One student Zara Qairina Mahathir last month. The charges against the five were read before Sessions Judge Elsie Primus in closed proceedings. Deputy public prosecutor Nor Azizah Mohamad said that the charge against the was for acting with common intention, allegedly uttered abusive words directed at Zara Qairina, which were heard by the victim and could have caused her distress. Elsie Primus allowed bail of RM5,000 against the five minors in closed proceedings and set the next date of mention to September 25. The offence was allegedly committed at Block A-3-6 of the Rabiatul Adawiyah Dormitory at Sekolah Menengah Kebangsaan Agama Tun Datu Mustapha Limauan W.D.T 15, Papar, between 10 pm and 11 pm on July 15. The charge was framed under Section 507C(1) of the Penal Code, read together with Section 34, which carries a maximum jail term of one year, or a fine, or both upon conviction. The lawyer representing Zara Qairina's family, Hamid Ismail, earlier said that a gag order has been imposed on the case under Section 15 of the Child Act 2001. Counsel for the first accused minor, Datuk Ram Singhm had applied for the gag order, saying that the law provided protection for the child. Zara Qairina was pronounced dead at Queen Elizabeth Hospital in Kota Kinabalu on July 17, a day after she was admitted. The Sekolah Menengah Kebangsaan Agama (SMKA) Tun Datu Mustapha student in Papar was found unconscious in a drain near her hostel at 4 am on July 16. The Coroner's Court in Kota Kinabalu has since fixed Sept 3 to begin the inquest proceedings into her death.
