Defence to file new submission in police officer murder trial under Section 300(d)

IPOH: The defence team in the murder trial of DSP Mohd Nazri Abdul Razak, accused of killing 17-year-old Muhammad Zaharif Affendi Muhd Zamrie in 2023, will file a new written submission under Section 300(d) of the Penal Code.
Defence counsel M. Athimulan informed the High Court that their previous arguments had primarily addressed Section 300(c), but the prosecution is now relying on Section 300(d).
Athimulan requested an adjournment of six weeks to revise their submissions, which the court granted.
The prosecution will then have four weeks to respond. Judge Datuk Bhupindar Singh Gucharan Singh Preet scheduled the full hearing of submissions for October 1 and 2.
Deputy Public Prosecutor Afzainizam Abdul Aziz clarified that while the prosecution had mentioned Section 300(d) in their opening statement last November, the defence had not addressed it in their submissions.
'We stated reliance on both Sections 300(c) and 300(d), but the defence focused mainly on Section 300(c). Now, they must address Section 300(d) to avoid issues at the appeal stage,' he said.
Section 300(c) defines murder as an act intended to cause bodily injury likely to result in death, while Section 300(d) covers acts known to be imminently dangerous and likely to cause death, regardless of intent.
Mohd Nazri faces charges under Section 302 of the Penal Code for the alleged killing near SMK Jati on December 15, 2023.
If convicted, he could face the death penalty or 30 to 40 years' imprisonment and at least 12 strokes of the cane. - Bernama

Penang deputy police chief Datuk Mohd Alwi Zainal Abidin said the 56-year-old man from Batu Kawan was deceived in an online investment fraud involving an application believed to be called "Xgi Horizon". "The commercial crime investigation department in South Seberang Perai received a police report from the victim on July 21. "The victim said he saw an investment advertisement on social media in early February that offered high profit returns. "The victim then started contacting the suspect, a man. He said the victim was asked to download an application and register as a member to start investing. "From Feb 18 to April 24, the victim made a total of 31 transactions into 10 bank accounts belonging to different companies. "The victim then made a police report and said he had lost RM624,617," he said. DCP Mohd Alwi said the case is being investigated under Section 420 of the Penal Code, for cheating. "I would like to remind the public that taking part in any investment schemes, especially those offered online is risky. "The public has been repeatedly reminded not to be easily deceived by scammers who use social media platforms to trick people. "One must be diligent and check with Bank Negara and the Securities Commission Malaysia to ensure that the entity or individual they are dealing with is authorised by the relevant agencies to offer, promote or sell any product or offer investment services," he said. He said it is essential to cooperate in the battle against online scam cases, especially investment fraud which has increased drastically through social media. "The dissemination of information related to this modus operandi when it comes to online fraud cases must be shared with family, friends and the community to create awareness so they do not become the next victim," he said. IPOH, July 23 (Bernama) -- The General Operations Force (GOF) seized electronic waste (e-waste) worth RM31.3 million during a raid on an illegal factory located within an oil palm plantation in Parit yesterday. Ulu Kinta GOF Northern Brigade Commander SAC Shahrum Hashim said the seized items included 81 blocks of e-waste weighing 105,300 kilogrammes (kg), 5,000 kg of coal, two four-wheel-drive vehicles and a trailer lorry. 'The investigation discovered that the illegal factory, located about five kilometres from the main road, is believed to have been carrying out unlicensed e-waste processing activities using specialised equipment without any approval from the authorities.

KUALA LUMPUR, July 23 (Bernama) -- The Malaysian Communications and Multimedia Commission (MCMC) has so far received 121 reports on scam advertisements using names and images of high-profile individuals on social media platforms, according to Deputy Communications Minister Teo Nie Ching. She said that among the prominent figures whose identities have been misused in such fraudulent ads are the King of Malaysia, His Majesty Sultan Ibrahim; the Sultan of Pahang Al-Sultan Abdullah Ri'ayatuddin Al-Mustafa Billah Shah; Sultan of Selangor Sultan Sharafuddin Idris Shah; and Prime Minister Datuk Seri Anwar Ibrahim. Teo also highlighted a recent incident involving herself, where she became a victim of a scam ad on Facebook, raising concerns about the role of platform operators, which appear to be acting as accomplices to such fraudulent activities.
