Sathankulam case: Accused cop wants to turn approver

MADURAI: Former inspector S Sridhar, who is one of the key accused in Sathankulam custodial death case, has moved a plea before the trial court seeking permission to become an approver. Also, he requested the judge to grant him pardon and discharge him from the case.
Sources said, the Additional District and Sessions Judge I, Madurai, G Muthukumaran, who is conducting the trial, directed the CBI to file a response to Sridhar's plea and adjourned the case to Thursday.
Sridhar filed the petition under Sections 306 and 307 of CrPC (Sections 343 and 344 in BNSS) which deals with tendering pardon to an accomplice of a criminal case at any stage before judgment, even when the trial is ongoing. Sridhar said if he is permitted to turn approver and become prosecution witness, he would fully disclose the true events that transpired on the fateful day, when P Jeyaraj and his son J Beniks were brutally assaulted by the other accused inside the police station.

The court also rejected ED's reliance on alleged FEMA violations, saying such infractions don't automatically trigger PMLA provisions and can't be used as a 'backdoor' In a sharp rebuke to the Enforcement Directorate (ED), the Madras High Court has quashed the agency's move to freeze Rs 901 crore in fixed deposits of RKM Powergen Private Limited, warning that the agency is 'not a super cop" empowered to investigate everything that comes to its notice. A division bench of Justices MS Ramesh and V Lakshminarayanan ruled that in the absence of a predicate offence, ie a scheduled offence under the Prevention of Money Laundering Act (PMLA), the ED has no jurisdiction to invoke its powers. There must first be a scheduled criminal activity and proceeds arising from such activity. Only then does ED's mandate under PMLA begin, the bench clarified. The judgment comes as the latest twist in the long-running saga surrounding the contentious 2008 allocation of the Fatehpur East coal block, later cancelled by the Supreme Court in 2014 after it was revealed the block lay within a protected forest area. Although the CBI initially registered a case in 2014, it filed a closure report citing lack of evidence. However, a special court in 2017 ordered further investigation. Based on this, the ED had frozen RKMP's accounts in 2015, but that action was already struck down by the high court the same year. Despite the court's 2022 direction restraining further investigation under PMLA due to the absence of a predicate offence, the ED revived its probe after the CBI filed a supplementary chargesheet in 2023. That eventually led to the freezing of RKMP's fixed deposits in early 2025. Rejecting this fresh freeze, the high court found no new material or grounds to justify the ED's action. It pointed out that the agency's seizure memo merely parroted the statute without any application of mind. The court also rejected ED's reliance on alleged violations of FEMA (Foreign Exchange Management Act), saying such infractions don't automatically trigger PMLA provisions and cannot be used as a backdoor for initiating proceedings. Importantly, the bench clarified that even the filing of a chargesheet by the CBI does not automatically justify ED's entry unless it specifically establishes that proceeds of crime stem from a scheduled offence. The court underscored the principle that 'without a predicate offence, the ED simply cannot act". A Delhi court on Wednesday (July 23, 2025) deferred till August 5 its order on framing of charges against Rashtriya Janata Dal (RJD) president Lalu Prasad, his wife Rabri Devi, their son Tejashwi Yadav and others in a case linked to alleged irregularities in the IRCTC. On May 29, the court reserved its order after the arguments were concluded on the aspect of charge. Lalu Prasad, Rabri Devi and Tejashwi Yadav have refuted corruption and other charges levelled against them by the Central Bureau of Investigation (CBI) in the case. The charges also include criminal conspiracy and cheating, and carry a maximum jail term of seven years. Prasad, who was the Railway Minister during the UPA-I government, earlier questioned the validity of sanctions obtained by the CBI to prosecute him. The agency told the court on February 28 that there was sufficient evidence to prosecute the accused persons. The case is linked to alleged irregularities in the grant of operational contracts of two Indian Railway Catering and Tourism Corporation (IRCTC) hotels to a private firm. IRCTC case: Delhi court grants bail to Lalu, wife Rabri and son Tejashwi According to the CBI charge sheet, a conspiracy was hatched between 2004 and 2014 in pursuance of which BNR hotels of the Indian Railways located in Puri and Ranchi were first transferred to the IRCTC. They were later leased to the Patna-based Sujata Hotels Private Limited for operations and maintenance. The tender process, the CBI alleged, was rigged and manipulated and the conditions were tweaked to help the private party — Sujata Hotels. The charge sheet also names former group general managers of IRCTC V.K. Asthana and R.K. Goyal and Vijay Kochhar and Vinay Kochhar, both directors of Sujata Hotels and owners of Chanakya Hotel. Delight Marketing Company, now known as Lara Projects, and Sujata Hotels have also been named as accused in the charge sheet.
