Court awards R5.5million in damages after twin swop at birth

The Pretoria High Court granted R5.5-million in damages to twins after they were swapped at birth

The consequences of a tragic incident more than 20 years ago, when two sets of twin girls were accidentally swapped at birth, unfolded in the Gauteng High Court, Pretoria, with the Gauteng MEC for Health ending up having to pay R5.5million in damages.
Judge Nomonde Mngqibisa-Thusi awarded damages to the biological mother of one set of twins - only identified as Mrs M, as well as to three of the other twins. The fourth twin did not form part of the litigation, brought on behalf of the plaintiffs by the law firm O Joubert Attorneys.
The four plaintiffs' claims follow a baby swap at the Heidelberg Hospital more than 20 years ago. Mrs M, a single mother, cared for what she thought were both her biological children, while another family, only identified as Mrs and Mr T, cared for what they believed were both their biological children.
One of each set of twins - which were separated at birth - were identical twins, but they grew up apart. The swap only came to light in 2018 after DNA testing was done, which concluded that each family had a child which was not their biological daughter.
This was discovered when one of the twins, who was still at school at the time, in 2016 saw another girl during a netball match with another school, which looked very similar to herself. Some of her teammates also became confused between the two.
The twin became suspicious and did some research on Facebook and later met the girl which turned out to be her identical twin. The DNA tests, which could only be done after the girls had turned 18, proved beyond a doubt that they were biological sisters.
Mrs M has since 2020 taken care of both the twins she raised, as well as her own, who grew up with the other family. It was said that the other family no longer wanted to take care of the twin which they thought was their own, when they discovered the truth.
It turned out that due to negligence on the part of hospital staff, Precious and Pretty were presented to Ms M as her daughters, and Mbali was presented to Mr and Mrs T as being their daughter.
Ms M and the three daughters now living with her are claiming damages for the trauma, pain, and suffering they had to endure since the discovery of the swap in 2018.
Ms M's claim included maintenance for raising a child all these years which was not her own. She is also claiming general damages for her suffering and pain. A psychologist also suggested that she, as in the case with the three twins, received long-term counselling.
It was said that the effect of living in the false belief that the parents who had raised them were not their biological parents had a devastating effect on the twins. Although three of the twins now live happily with Ms M, the court said the reality had a devastating effect on them.
It was also difficult for the twin who is the biological daughter of Mr and Mrs T, but grew up with Ms M, when the T-family did not want to have anything to do with her and were not interested in getting to know her. This was in huge contrast to Ms M, who did everything possible to get to know her biological daughter.
The court meanwhile granted R1.7-million in damages to Ms M and amounts varying from R1.3million to R1.8million to the three daughters.

Former eThekwini mayor Zandile Gumede and her 21 co-accused are charged with multiple counts of fraud, racketeering, corruption, money laundering, contravention of the Municipal Finance Management Act and the Municipal Systems Act, relating to the Durban Solid Waste (DSW) tender of more than R320 million. The State on Monday at Durban High Court proposed to the current witness, that those figures in the tender's bid specification were provided by Allan Robert Abbu. Abbu, at the time, was the Deputy Head for cleansing and solid waste. The media is prohibited from naming State witnesses. However, Abbu's counsel, advocate Jay Naidoo SC, disputed this, saying that the previous witness X, who had drafted the tender advertisement, said Abbu gave her a document that had the figure of the number of households that needed to be serviced. Naidoo said if the State could tell him where witness X said Abbu was dictating the numbers of households to be serviced while he stood behind her, it would be different. 'Her evidence was that Abbu was in and out of her office,' he said. He said the document that contained the household numbers that Abbu gave to witness X is not disputed by the defence. The State is currently leading evidence of witness Y, who said part of her job was to confirm project budgets and estimate them. Witness Y told the court that the number of households that were in the BAC report prepared by witness X was tripled, and some were doubled.

Police in KZN have launched a massive manhunt for Lungisani Velentine Mkhize who escaped from lawful custody earlier today. According to the Zululand Observer, the escape occurred on the John Ross highway, under the N2 bridge, outside Empangeni. According to KZN Hawks spokesperson Lieutenant Colonel Mhlongo, Mkhize and his alleged accomplice, Sphelele Gwala, assaulted a police captain on the head while he was driving. 'The police captain reduced speed as they approached the robots. The duo assaulted the driver on the head and quickly opened the doors [of the vehicle] to escape. There were two officers in the vehicle, and both accused were cuffed. It is not clear how they uncuffed themselves. 'Gwala was shot in the leg after he jumped out of the police vehicle. Mkhize managed to escape and is still at large,' says Mhlongo. He adds that an ambulance was called and treated Gwala at the scene before transporting him to an undisclosed hospital, where he is under 24-hour police guard. The pair were recently convicted of the double murder of Road Traffic Inspectorate officers Sizwe Sithole (48) and Mxolisi Lamula (36), who were gunned down on August 30, 2021, on the N2 in the Nkodibe area in Mtubatuba. 'The pair were en route to Mtuzini High Court for sentencing [at the time of their escape],' said Mhlongo. Traffic officers' murder At the time of their murder, the on-duty Sithole and Lamula were seated inside their marked traffic vehicle, which was parked on the Nkodibe on-ramp, at around 18:00. They were shot at close range by Mkhize and his accomplice while still inside their vehicle. They died instantly in a hail of bullets, their vehicle riddled with bullet holes. About 15 cartridges from a pistol and an R5 or AK-47 were found at the scene. Mkhize was arrested in September 2021 with his accomplice. They were both charged with double murder. The bail application hearing for a man arrested after almost one million child sexual abuse images was alledly found in his possesion, has been postponed to Thursday. According to Ridge Times, the 59-year-old man looked dishevelled as he was led to the dock of the Standerton Magistrate's Court this morning. He is facing charges of possessing and distributing child pornography, one count of sexual grooming, and one count of compelled sexual assault. The latter, as defined under South African law, occurs when someone forces a third party to commit a sexual act against another person's will. The man was not asked to plead, rendering it still illegal for the media to publish the well-known resident's name. Bail hearing testimony The investigating officer, Warrant Officer Lelani de Lange from the Serial Electronic Crimes Unit, testified for the state that bail should not be granted. She described the accused as a 'pedophile', stating that a total of 954 000 images were found on hard drives. More than 59 000 images were found on one device, with the rest on other external hard drives also found in the man's possession. These included images of children being sexually abused and could also include AI images depicting child pornography. According to De Lange, the distribution charge relates to the numerous child pornography websites the man had joined. 'To be part of these sites, members are also expected to share images,' she said. She testified that this municipal employee should not be granted bail because he might interfere with a young victim; he is a danger to society as he lives next to a pre-school; and police believe the man suffers from depression and has suicidal tendencies. Defence arguments Speaking on behalf of the accused, lawyer André Moolman said there are no medical records to indicate that his client suffers from depression. He referred to the evidence in the case as insufficient and emphasised several technical issues. Moolman told the court that his client's photos were leaked to the media, causing further complications. He said his client has been married for 31 years, is well-known in the community, and could lose his employment if he is not granted bail, which would negatively affect his wife. Moolman also stated that his client suffers from scoliosis, sleep apnea, high blood pressure, and type 2 diabetes. He claimed that the accused cannot sleep without his CPAP machine, which is currently not available to him. Magistrate Sabelo Tembe presided. Members of the Justice for All group picketed at outside the court as they do not want bail to be granted to the accused.
