US judge dismisses some claims in Uber sexual assault lawsuits

The federal judge overseeing more than 2,300 lawsuits seeking to hold Uber liable to passengers who were sexually assaulted or harassed by drivers dismissed some key claims in the nationwide litigation.US District Judge Charles Breyer in San Francisco rejected some fraud and product liability claims on Tuesday.His decision addressing 20 "bellwether" Uber cases could be a template for similar cases against the San Francisco-based ride-sharing company. A trial is scheduled for December 8.Lawyers for passengers did not immediately respond to requests for comment on Wednesday. Uber and its lawyers did not immediately respond to similar requests.Passengers said "Designated Driver" ads promoting Uber as a safe alternative to drunk driving should have disclosed that intoxicated people, especially women and especially late at night, faced an elevated risk of sexual assault by drivers.The passengers also said app notifications containing Uber drivers' names, photos and "star ratings" should have disclosed drivers' prior misconduct and criminal histories.In his 37-page decision, Breyer dismissed fraud claims based on ads saying "Don't drink and drive, call an Uber" and "Stay safe tonight. Use Uber."The judge said reasonable consumers would view those ads merely as encouragement to use Uber, rather than drive drunk.But he also said Uber's handling of app notifications "could form a deceptive scheme to obfuscate the risk of serious harm" when women accepted rides from drivers with histories of misconduct.Uber said it did not intend to fraudulently withhold information, and no passengers claimed they relied on the app notifications.Breyer also dismissed claims that Uber's app was defective because it failed to prevent high-risk pairings of drivers and passengers.He refused to dismiss product liability claims based on the app's lacking a feature to match passengers with drivers of the same gender.The judge previously dismissed some other claims in the bellwether cases.In its US safety report for 2021 and 2022, Uber said it received 2,717 reported incidents of the most serious categories of sexual assault and misconduct.Uber also said only 0.1% of the more than 1.8 billion U.S. trips in those years had reported safety incidents, mainly about "minor" issues such as complaints about driving or verbal arguments.The case is In re Uber Technologies Inc Passenger Sexual Assault Litigation, US District Court, Northern District of California, No. 23-03084.

The assault, which was caught on CCTV, shows the toddler being slapped, bitten, dropped to the ground twice or thrice, and beaten with a plastic bat. Shockingly, the daycare owner was allegedly present but did nothing to intervene. STORY CONTINUES BELOW THIS AD Here's what happened The shocking assault at Noida daycare Monica and Sandeep Kumar, parents of the 15-month-old girl, had been sending their daughter to the daycare in Sector 137 since May 21. Sandeep, who works in the IT department of a UK-based multinational company, had made sure to check the safety arrangements himself before enrolling her, including confirming that five CCTV cameras were installed across the premises. The daycare, run by the residents' association, is one of many such facilities operating in residential complexes across Delhi NCR. Charu, the daycare's owner, personally assured the couple of their child's safety. 'Before sending our daughter, we had checked all safety measures at the daycare. There were five CCTV cameras in all rooms, the hall, and kitchen areas. The owner assured us during admission that it's the daycare's responsibility to keep every child safe,' Sandeep told The Times of India. But on Monday, when Monica went to pick up her daughter, something felt wrong. The toddler was crying uncontrollably and seemed unusually distressed. Later, while changing her clothes, Monica spotted circular marks on both of her thighs. 'My wife asked the teachers about the bite marks, but was told she had some infection from home. She ran to a doctor immediately. The doctor confirmed it wasn't an infection, but marks of human teeth. He also told my wife that it appeared our daughter had been tortured because she was visibly scared. My wife came home and informed me. I left office without any delay,' Sandeep recalled. STORY CONTINUES BELOW THIS AD When they confronted the daycare owner, she flatly denied that any abuse had occurred. The couple requested CCTV footage to verify what had happened, but getting access proved to be an uphill battle. According to The Times of India, the staff claimed there were 'technical issues,' missing applications, and even snapped wires that delayed them from handing over the footage. The parents say the daycare kept stalling for four days until police intervened on Thursday. When the couple finally saw the recordings, they were horrified. The footage showed the attendant, Sonali, a teenager from Shahdara village, mercilessly punching the child, pushing her off a swing, dropping her onto the floor, beating her with a plastic bat, and even inserting a pencil into her mouth. Following the parents' complaint, police from Noida's Sector-142 station registered a case, conducted a medical examination of the toddler, and arrested the accused maid. Charges have been filed under sections 115(2) (voluntarily causing hurt), 351(2) (criminal intimidation), and 352 (intentional insult with intent to provoke a breach of peace) of the Bharatiya Nyaya Sanhita (BNS). Following the parents' complaint, police from Noida's Sector-142 station registered a case, conducted a medical examination of the toddler, and arrested the accused maid. Doms Industries jumps 8% on Q1 beat, positive outlook; JM Fin says 'Buy'

Doms Industries share price today: Shares of stationery company Doms Industries surged 8 per cent to hit an intraday high of ₹2,468.5 on the NSE after it reported better-than-expected earnings in the June 2025 quarter (Q1FY26) and recovery in its core business. At 10:55 AM, Doms Industries stock was trading 7.3 per cent higher at ₹2,453.8 per share on the NSE. In comparison, NSE Nifty50 was up 0.4 per cent at 24,461 levels. The market capitalisation of the company stood at ₹14,924 crore. The stock has recovered 18 per cent from the 52-week low of ₹2,092 touched on January 28, 2025. Doms Industries Q1 results In the June 2025 quarter (Q1FY26), Doms Industries posted consolidated revenue from operations of ₹562.3 crore, up 26.4 per cent year-on-year (Y-o-Y) from ₹445 crore. The company's earnings before interest, tax, depreciation and amortisation grew 14.3 per cent to ₹98.7 crore from 86.4 crore in the year-ago period. It posted profit after tax (PAT) of ₹59.1 crore, up 8.8 per cent Y-o-Y from ₹54.3 crore. JM Financial on Doms Industries According to analysts at JM Financial, the company's crore stationery business growth was 18 per cent, better than 14 per cent seen in the previous quarter, and incremental growth was led by higher sales from the recently acquired Uniclan business. Additionally, within core business, while the combined gross revenue of Scholastic stationery, Scholastic art material & Kits & combos grew by 6.4 per cent, strong momentum in Pens, Paper stationery and Hobby & craft resulted in high teen's growth for the overall stationery business, which is a key positive. Uniclan's performance was on expected lines, aided by additions in capacity & channel partners, the brokerage said in a note. On a conservative basis, the company management is expecting consolidated sales growth of 18-20 per cent, Ebitda margin of 16.5-17.5 per cent and PAT margin of 10 per cent for FY26E. "We like Doms' execution so far as well as its strategy of increasing total addressable market (TAM) and extending to additional categories (like toys, bags, baby care, etc.). Going ahead, the pace of commissioning of new capacities will be key for acceleration in writing instruments. Execution on Paper stationery & Uniclan business (distribution expansion) over the medium term will be another key monitorable," JM Financial said in a note. The brokerage has maintained a 'Buy' rating on the stock with a target price of ₹2,845.
